Chair Miller called the Special Meeting of the Planning Commission to order at 7:02 p.m.

APPROVAL OF AGENDA
By Motion of the Planning Commission this is the time to notify the public of any changes
to the agenda, re- arrange the order of the agenda, and provide an opportunity for any
member of the Planning Commission or staff to request an item be removed from the
Consent Calendar for separate action.
Motion by Commissioner Klinger, second by Commissioner Massetti to approve the agenda.

PUBLIC COMMUNICATIONS
Chair Miller opened public communications. City Clerk Harper announced that two (2)
emailed comments were received Speakers: None. Chair Miller closed public
communications.
CONSENT CALENDAR
A. Approval of the August 1 , 2022 Planning Commission Minutes.
APPROVAL OF CONSENT CALENDAR
Motion by Commissioner Campbell second by Commissioner Klinger to approve the
Consent Calendar.

NOES: None
ABSENT: None
ABSTAIN: Thomas
Motion Carried
Vice Chair Thomas requested to change his `ABSTENTION" vote on APPROVAL OF THE
AGENDA to "AYE," as his intention was to abstain from voting on the CONSENT
CALENDAR as he was not present for the August 1, 2022 meeting.

PUBLIC HEARING
B. Minor Use Permit (MUP 22-4)
1101 Ocean Avenue
Applicant: Carlos Jasso
Request: Request for a Minor Use Permit (MUP 22-4) to allow exterior and interior
alterations that are less than 25 percent of the interior walls within an existing multi-
family residence that is nonconforming due to density, setbacks, and parking located
in the Residential High Density (RHD-20) zoning area.
Recommendation: After conducting the Public Hearing. staff recommends that the
Planning Commission adopt Resolution No. 22-12, APPROVING Minor Use Permit
22-4 with Conditions.
Community Development Director Smittle called upon Assistant Planner Cuevas who
provided a comprehensive staff report. The Commissioners questions were answered.
Chair Miller reopened the public hearing. City Clerk Harper announced that no emailed
comments were received. Speaker: Steve Kraemer. Chair Miller closed the public hearing.
Motion by Vice Chair Thomas, second by Commissioner Klinger that the Planning
Commission adopt Resolution No. 22-12, APPROVING Minor Use Permit 22-4 with
conditions.

Senior Assistant City Attorney Greyson noted that there is a 10-day appeal period that
starts September 20, 2022.
C. Minor Use Permit (MUP 22-5)
71 Riversea Road
Applicant: Martin Raymond
Request: Request for a Minor Use Permit to allow a second-story cabana addition
over an existing single-story manufactured home within Seal Beach Shores located in
the Residential High Density (RHD-33) zoning area.
Recommendation: After conducting the Public Hearing, staff recommends that the
Planning Commission adopt Resolution No. 22-13, APPROVING Minor Use Permit
22-5 with Conditions.
Community Development Director Smittle called upon Assistant Planner Marco Cuevas who
provided a comprehensive staff report. The Commissioners questions were answered.

comments were received. Speaker: Lynn Alfarro. Chair Miller closed the public hearing.
Motion by Commissioner Klinger, second by Chair Miller that the Planning Commission
adopt Resolution No. 22-13, APPROVING Minor Use Permit 22-5 with conditions.

Senior Assistant City Attorney Greyson noted that there is a 10-day appeal period that
starts September 20, 2022.
D. Zone Text Amendment 22-2 Amending Portions of Title 11 of the Seal Beach
Municipal Code Pertaining to Accessory Dwelling Units (ADUs) and Junior Accessory
Dwelling Units (JADUs) Consistent with State Law Requirements
Citywide — All Residential and Mixed-Use Zones * •
Applicant: Request:
Recommendation: That the Planning Commission hold a public hearing regarding
Zone Text Amendment 22-2 and after considering all evidence and testimony
presented adopt the Resolution recommending approval of Zone Text Amendment
22-2 to the City Council.
Community Development Director Smittle provided introductory comments regarding ADUs
and called upon Interim Senior Planner Bashmakian who provided a comprehensive staff
report. The Commissioners questions were answered.
Chair Miller opened the public hearing. City Clerk Harper announced that no emailed
comments were received. Speaker: None. Chair Miller closed the public hearing.
Motion by Chair Miller, second by Commissioner Klinger that the Planning Commission
hold a public hearing regarding Zone Text Amendment 22-2 and after considering all
evidence and testimony presented adopt the Resolution recommending approval of Zone
Text Amendment 22-2 to the City Council.

DIRECTOR'S REPORT
Director Smittle welcomed everyone back to in-person meetings. She also announced that
the Regular Planning Commission meeting was changed to a Special Meeting due to issues
with publishing the Regular Meeting agenda.
COMMISSION CONCERNS
There were no Commission concerns.
ADJOURNMENT
Chair Miller adjourned the Planning Commission meeting at 7:54 p.m. to Monday,
October 3, 2022, at 7:00 p.m.
