Vice Chair Thomas called the Planning Commission meeting to order at 7:00 p.m.

PLEDGE OF ALLEGIANCE - Led by Commissioner Klinger
APPROVAL OF AGENDA
By Motion of the Planning Commission this is the time to notify the public of any changes
to the agenda, re- arrange the order of the agenda, and provide an opportunity for any
member of the Planning Commission or staff to request an item be removed from the
Consent Calendar for separate action and approve the excused absence of Chair Miller from
tonight's meeting.
Motion by Commissioner Klinger, second by Commissioner Campbell to approve the
agenda and the excused absence of Chair Miller.

ABSTAIN: None

PUBLIC COMMUNICATIONS
Vice Chair Thomas opened public communications. City Clerk Harper announced that no
emailed comments were received. Speakers: None. Vice Chair Thomas closed public
communications.

A. Approval of the December 5, 2022 Planning Commission Minutes
APPROVAL OF CONSENT CALENDAR
Motion by Commissioner Klinger second by Commissioner Massetti to approve the Consent
Calendar.

ABSENT: Miller
ABSTAIN: Campbell

CONTINUED ITEMS
Vice Chair Thomas requested an update on Chick fil-A. Community Development Director
Smittle stated that there was no update.

PUBLIC HEARING
B. Minor Use Permit (MUP 22-6)
225 10th Street
Applicant: Arde Shirazi
Request: Request for a Minor Use Permit (MUP 22-6) to allow the construction of a
detached two-car garage and an open roof deck on a single-family residence that is
nonconforming due to setbacks located in the Residential High Density (RHD-20)
zoning area.
Recommendation: After conducting the Public Hearing, staff recommends that the
Planning Commission adopt Resolution No. 22-20, APPROVING Minor Use Permit
22-6 with Conditions.
This project is determined to be a Class 3 (New Construction or Conversion of Small
Structures) Categorical Exemption pursuant to Section 15303 of the Guidelines for
the California Environmental Quality Act (Public Resources Code Section 21000 et
seq.) for the construction of an accessory structure/detached two car garage and an
open roof deck at an existing nonconforming residence.
Community Development Director Smittle introduced Associate Planner Marco Cuevas, Jr.,
who provided a comprehensive staff report. Commissioners questions were addressed.
Vice Chair Thomas opened the public hearing. Speaker: None. Vice Chair Thomas closed
the public hearing.
Motion by Vice Chair Thomas, second by Commissioner Campbell that the Planning
Commission adopt Resolution No. 22-20, APPROVING Minor Use Permit 22-6
with Conditions.

ABSTAIN: None

Senior Assistant City Attorney Greyson noted that there is a 10-day appeal period that
starts December 6, 2022.
DIRECTOR'S REPORT
Community Development Director Smittle formally introduced Planning Manager Shaun
Temple to the Planning Commissioners; and, thanked Interim Planner Art Bashmakian for
his service and dedication to the City of Seal Beach. Vice Chair Thomas welcomed Planning
Manager Shaun Temple on behalf of the Planning Commission.
COMMISSION CONCERNS
There were no Commission Concerns.
ADJOURNMENT
Vice Chair Thomas adjourned the Planning Commission meeting at 7:23 p.m. to a date
uncertain in January 2023, at 7:00 p.m.
