Request: VARIANCE 22-2. Request for Variance (22-2) to allow an encroachment into the
required rear and side yard setbacks enabling the placement of three previously constructed
accessory structures/patio covers and a carport on a conforming property in the Residential
Low Density (RLD-9) zoning area; and/or in the alternative. REASONABLE

Recommendation:
After conducting the public hearing and receiving testimony, staff recommends that the
Planning Commission take the following actions (1) Adopt the attached Resolution No. 23
02 denying Variance (VAR 22-2) request for three accessory structures and a carport on
two-story single-family residence on a property in the Residential Low Density (RLD-9)
zone on an existing property at 1733 Catalina Avenue; and, (2) Adopt the attached
Resolution No. 23-01 denying in part Reasonable Accommodation (RA 22-01) rejecting t
request for approval of the encroachment of a nonconforming and non -permitted carport
into the required western side yard setback and approving Reasonable Accommodation
22-1 in part as modified, with conditions, to allow encroachments into the required rear an
side yard setbacks of certain previously constructed nonconforming and non -permitted
accessory structures/patio covers in the back yard of a two-story single-family residence
on a property in the Residential Low Density (RLD-9) zone on an existing property at 173
Catalina Avenue. California Environmental Quality Act finding: exempt pursuant to Sectio
15303(e).

Motion by Commissioner Klinger, second by Vice Chair Thomas that the Planning
Commission Adopt the attached Resolution No. 23-01 denying in part Reasonable

Senior Assistant City Attorney Greyson noted that there is a 1 0 -day appeal period that
starts February 7, 2023.

Community Development Director Smittle noted that the time of the Planning Commission
there will be a change of Commissioners due to the installation of new Council Members.
-i the entire Commission for their service and a special thank you to Vice Chair
Thomas and Commissioner Klinger for the service on the Commission as this may be there
last meeting.
Vice Chair Thomas offered comments to his fellow Commissioners and staff and stated thal
he has enjoyed working with the Commissioners over the years as this may be his Iasi
meeting due recent election of two (2) new Council Members.
Commissioner Campbell announced that the Notice of Preparation comments starts today,
February 6, 2023, through March 7, 2023. She also announced that the Scoping Meeting
will be held on Wednesday, February 22, 2023, at 6pm at the Environmental Quality Control
Board (EQCB) meeting. Noted her concerns about the General Plan and Zoning documents
related to the scoping meeting.
Chair Miller adjourned the Planning Commission meeting at 8:48 p.m. to a date uncertain in
March 2023, at 7:00 p.m.
