SUMMARY OF REOUEST:

It is requested that the City Council approve the attached Resolution which finds that
Parcel Map No. 2006-160 for Condominium Purposes is in substantial compliance with
the previously approved Tentative Parcel Map No. 2006-160, accepts and approves
Parcel Map No. 2006-160 for Condominium Purposes as presented, and instructs the City
Clerk to execute said Parcel Map as required and to forward the executed Parcel Map No.
2006-160 for Condominium Purposes to the County of Orange for further processing and
recording as required.
BACKGROUND:
On June 21, 2006, Tentative Map No. 2006-160 for a proposed condominium subdivision,
owned by 132 13111 Street, LLC, a California Cmporation, Co-Trustee Scott Levitt, was
approved subject to Subdivision Laws, City Municipal Code, and to the requirements and
conditions contained in Seal Beach Planning Commission Resolution No. 06-22. The
approved Tentative Parcel Map No. 2006-160 established a residential condominium
development for the subdivision of two (2) existing 25 foot wide by 117.5 foot deep
residential lots into one (I) 50 foot wide by 117.5 foot deep residential condominium lot
located at 132 13111 Street between Electric Ave. and Ocean Ave.

Approval of Parcel Map No. 2006-160 for Condominium Purposes will fonna1ly create the
subject one (1) lot condominium parcel, and will allow the condominium units to be sold in
accordance with State law and the terms and conditions of Tentative Parcel Map No. 2006-
l60.for CondOmi:n:ium Purposes and will allow the building of the condominium residential
units on the newly created lot in accordance with City and State Building Codes and
regulations. In accordance with the Subdivision Map Act, the subdivision conditions as

approved by the City of Seal Beach Planning Commission have been agreed to by the
owner/developer. Occupancy of the residential units will not be granted until all of the
conditions of Tentative Parcel Map No. 2006-160 approval have been fulfilled which will
guarantee that all the required conditions and improvements will be in place prior to
occupancy of the units, therefore a formal subdivision agreement is not needed to guarantee
that the required conditions and improvements for this subdivision will be completed.
Parcel Map No. 2006-160 for Condominium Purposes has been examined by the Orange
County Surveyor who has found that all mapping provisions of the Subdivision Map Act
have been completed and is satisfied that the map is technically correct. The City of Seal
Beach City Engineer has also examined Parcel Map No. 2006-160 for Condominium
Purposes and has found it to be substantially in conformance with the tentative map as
approved by the City of Seal Beach Planning Commission and that all provisions of the
Subdivision Map Act and City of Seal Beach subdivision regulations have been complied
with. Additionally, the Director of Development Services has reviewed Parcel Map No.
2006-160 for Condominium Purposes for compIiance with required Subdivision Map Act
requirements and compliance with all conditions of approval of Tentative Parcel Map No.
2006-160. Therefore it is appropriate for the City Council to approve Parcel Map No. 2006-
160 for Condominium Purposes as presented.
FISCAL IMPACT:

No fiscal impact. All costs will be paid or be reimbursed by the owner/developer.
Appropriate plan check and building permit fees will be charged as costs are incurred.
RECOMMENDATION:
It is recommended that the City Council approve the attached Resolution which:
· Finds that Parcel Map No. 2006-160 for Condominium Purposes is in substantial
compliance with the previously approved Tentative Parcel Map No. 2006-160.
. Accepts and approves Parcel Map No. 2006-160 for Condominium Purposes as
presented.
· Instructs the City Clerk to execute Parcel Map No. 2006-160 for Condominium
Purposes as required.
· Instructs the City Clerk to forward executed Parcel Map No. 2006-160 for
Condominium Purposes to the County of Orange for further processing and
recording as required.

SEAL BEACH ACCEPTING AND APPROVING PARCEL MAP
NO. 2006-160 FOR CONDOMINIUM PURPOSES ALSO KNOW AS
132 13TH STREET
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY
RESOLVE:

WHEREAS, Parcel Map No. 2006-160 for Condominium Purposes which establishes a
residential condominium development for the subdivision of two (2) existing 25 foot by
117.5 deep residential lots into one (1) 50 foot wide by 117.5 foot wide residential
condominium lot located at 132 1311i Street, between Electric Ave. and Ocean Ave., has been
reviewed by the County of Orange County Surveyor for compliance with all required
Subdivision Map Act requirements, and has been reviewed by the City of Seal Beach City
Engineer, and the City of Seal Beach Director of Development Services for compliance
with all conditions of approval of Tentative Parcel Map No. 2006-160; and
WHEREAS, the owners of the lots being subdivided, 132 131h Street, LLC, a California
Corporation, Co- Trustee Scott Levitt, has agreed with the conditions of approval and has
requested the acceptance and approval of Parcel Map No. 2006-160 for Condominium
Purposes; and
WHEREAS, the City Manager is recommending acceptance and approval of Parcel Map
No. 2006-160 for Condominium Purposes.
NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Seal
Beach does hereby find that Parcel Map No. 2006-160 for Condominium Purposes is in
substantial compliance with the previously approved Tentative Parcel Map No. 2006-160,
and
BE IT FURTHER RESOLVED that the City Council of the City ofSea1 Beach does
hereby accept and approve Parcel Map No. 2006-160 for Condominium Purposes as
presented, and
BE IT FURTHER RESOLVED that the City Clerk is instructed to execute Parcel Map
No. 2006-160 for Condominium Purposes as required, and
BE IT FURTHER RESOLVED that the City Clerk is instructed to forward executed
Parcel Map No. 2006-160 for Condominium Purposes to the County of Orange for
further processing and recording as required.
