SUMMARY OF REQUEST:
Determine to Schedule Joint Study Sessions with the Planning Commission as
recommended, or as may be revised based on Councilmember availability.

BACKGROUND:
The City Council gave direction to staff on June 26, 2006 to proceed with the revision
and update process of the Local Coastal Plan (LCP) and Zoning Code as the top two
priorities to be accomplished by the Department of Development Services.
As directed by the City Council, Staffhas completed a "Preliminary Draft" of an updated
Zoning Code and aJ;I upda~d "Subdivision Code" and. is proposing that the City Council
schedule "Joint Study Sessions" with the Planning Commission to review the subject ,
documents.
The suggested joint study session format will allow staff to present the "Preliminary
Draft" versions of the Zoning Code and the Subdivision Code to the City Council,
Planning CommisSion, and interested citizep.s in a less formal atmosphere than can be
accomplished during a public hearing process. The study session format will allow for
discussion among the Council, Commission, City Attorney, public and staffregarding the
proposed Zoning and Subdivision codes, prior to the documents being finalized for the
required public hearings before both the Planning Commission and City Council.
Staff is suggesting the following schedule for the Joint Study Sessions:

"Preliminary Draft Zoning Code": .
CJ Part II - Base District Regulations - Chapter 2.05 - Residential Districts.
If additional Joint Study Sessions are det~ed .to be necessary to fully review and
discuss the proposed documents, the City Council .will be able to adjourn to additional
Joint Stl/-dy Sessions as determined appropriate.

Staff intends to provide the complete "Pre1iminaty Draft Zoning Code" and "Preliminary
praft Subdivision Code" to the City Council and Planning Commission, no later than
Monday, February 5, to allow sufficient time to review the documents and to be prepared
to discuss and raise questions, issues and concerns during the Joint Study Sessions. Both
documents will also be available no later than Monday, February 5, for public review at
Gity Hall, each library (Mary WilSon, Leisure World, and Rossmo!lr-Los Alamitos), and
be made available on the' City's web page. .PIQvided as Attachments 1 and 2 for the
information of the City Council is. the Table of Contents for the "Preliminary Draft
Zoning Code" and the "Preliminary Draft Subdivision Code" to provide some idea as to
the format and areas to be addressed in the new Zoning and Subdivision codes.
Upon completion of the joint study sessions, staff and the City Attorney will then finalize
the documents to be able to'initiat~ the formiI.I. public hearing process leading up to City
Council adoption. As part of that process a "Negative Declaration:" will be prepared and
circulated for a 30-day public comment period regarding the evaluation of potential
environmental impacts of the. adoption of the new. Zoning and Subdivision codes. Upon
completion of the public comment period on the Negative Declaration, the public hearing
process would then be initiated, probably in mid- to late-May at the Planning
Commission level and late-June to early-July at the City Council level.

joint study session review process, prepare the "Final Draft" documents for public e

hearings by the Planning Commission and City Council, complete the environmental
review process, and complete the public hearing and adoption process.
Adoption of these Codes by the City Council will complete the update process of the
entire Municipal Code that began in 2004. I
FISCAL IMPACT:
No direct impacts.. Existing staff resources have and will be utilized to conduct the study
sessions and proceed with necessary public hearing and adoption process.
RECOMMENDATION:
Determine to Schedule Joint Study Sessions with the Planning Commission as
recommended, or as may be revised based on Councilmember availability.

1 Staff has worked with oW' LCP Consultant (Culbertson, Adams & Associates) on additional revisions in
response to comments and concerns from Coastal Commission staff, on the LCP and those revisions are
being completed by the consultant. Staff will then schedule additional meetings with Coastal Commission
staff to hopefully reach a consensus on the contents of the LCP. Upon reaching a general consensus with
Coastal Commission staff, the LCP would then be presented to the General PlanJLCP Advisory Committee
for review and comments before scheduling for public hearings before the Planning Commission and City
Co~ci1. The "Preliminary Draft Zoning Code" reserves certain sections to address the LCP
implementation issues, upon adoption and certification of the LCP and the additional adoption of the
necessary "Implementing Actions Ordinance" by both the City and the Coastal Commission.
