ACCESS ON A PORTION OF HELLMAN PROPERTIES,
LLC PROPERTY ADJACENT TO SOUTHERLY SIDE
OF CITY CORPORATION YARD
SUMMARY OF REOUEST:

The proposed City Council Action will rescind prior City Council Resolution No. 5450
and adopt the attached Resolution accepting an easement deed for public utilities and City
access on a portion of the Hellman Properties, LLC property adjacent to the southerly side
of the City corporation yard.
BACKGROUND:
Prior City Council Resolution No. 5450 included an incorrect statement in the fourth
"WHEREAS" paragraph which Hellman Properties, LLC requested be changed.
Following is the original fourth "WHEREAS" paragraph from Resolution No 5450:
WHEREAS, the Easement Deed additionally includes a grant of access easement
to the Orange County Flood Control Pistrict over a portion of the easement being
granted to the City which will allow the County access on a portion of Hellman
Properties, LLC property for access to a proposed County flood control pump
station to be constructed by the County along the southerly side of the Los
Alamitos Retarding Basin located westerly of the City Corporation Yard; and

Following is the corrected "WHEREAS" paragraph being the sixth "WHEREAS"
paragraph of the resolution under consideration for adoption.
WHEREAS, the Easement Deed additionally includes a grant of access easement
to the Orange County Flood Control District over a portion of the easement being
granted to the City which will allow the County access to the storm drain outlet
pipe that connects the Heron Pointe retention basin to the Los Alamitos Retention
Basin (OCFCLARB); and
Additionally the resolution under consideration for adoption will accept an easement from
Hellman Properties, LLC which is explained as follows.

As part of the Hellman Subdivision Tract No. 15402 development requirements certain
public utilities were required to cross a portion of the Hellman Properties, LLC property
in order to connect to existing public utilities in Adolfo Lopez Drive.
The proposed easement will allow the required public utilities to be installed within the
easement area and will allow the City access for maintenance of the public utilities
Hellman Properties, LLC has executed the attached Easement Deed and has forwarded it
to the City for acceptance.
Note that the Easement Deed additionally includes a grant of access easement to the
Orange County Flood Control District over a portion of the easement being granted to the
City which will allow the County access .on a portion of Hellman Properties, LLC
property for access to a proposed County flood control pump station to be constructed by
the County along the southerly side of the Los Alamitos Retarding Basin located westerly
of the City Corporation Yard.

These easements will adjoin a separate access easement to be deeded by the City both to
the Hellman Properties, LLC and the Orange County Flood Control District which
crosses a westerly portion of the City Corporation Yard in order to allow access to Adolfo
Lopez Drive which was part of the Hellman Subdivision Tract No. 15402 development
agreement conditions. The Orange County Flood Control District will accept the
easement deed grant by separate Board action.

FISCAL IMPACT:
By accepting this easement there are no additional fiscal impact to the city over and above
those already agreed to for maintenance of public utilities as part of the Hellman
Subdivision Tract No. 15402 agreement previously approved by the City Council.
RECOMMENDATION:
Upon motion of the consent calendar, it is recommended that the City Council adopt the
attached resolution rescinding prior City Council Resolution No 5450 and accepting the
above noted Easement Deed.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL
BEACH RESCINDING PRIOR RESOLUTION NO. 5450 AND
ACCEPTING AN EASEMENT DEED FROM HELLMAN PROPERTIES,
LLC FOR PUBLIC UTILITY AND CITY ACCESS ON A PORTION OF
HELLMAN PROPERTIES, LLC PROPERTY ADJACENT TO THE
SOUTHERLY SIDE OF THE CITY OF SEAL BEACH CORPORATION
YARD
THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE:
WHEREAS, prior Resolution 5450 included an incorrect statement in the fourth "WHEARAS"
paragraph which Hellman Properties, LLC requested be changed and which the City Council
desires to correct by rescinding prior Resolution No. 5450 and adopting this resolution; and
WHEREAS, as part of the Hellman Subdivision Tract No. 15402 development requirements
certain public utilities were required to cross a portion of the Hellman Properties, LLC property
in order to connect to existing public utilities in Adolfo Lopez Drive; and
WHEREAS, the proposed easement will allow the required public utilities to be installed within
the easement area and will allow the City access for maintenance of the public utilities; and
WHEREAS, Hellman Properties, LLC has executed the attached Easement Deed and has

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Seal Beach that
City Council Resolution No. 5054 is hereby rescinded; and
BE IT FURTHER RESOLVED by the City Council of the City of Seal Beach that the
aforementioned Easement Deed is hereby accepted; and

BE IT FURTHER RESOLVED by the City Council of the City of Seal Beach that upon
acceptance by the Orange County Flood Control District of their portion of the aforesaid
Easement Deed the City Clerk of the City of Seal Beach shall have the aforementioned Easement
Deed duly and properly recorded in the official records of the office of the Recorder of the
County of Orange.
