Bahorski, City Manager FROM: Jeff Kirkpatrick, Chief of Police SUBJECT: Allocation of State COPS Funds - 2006/07 (Supplemental Law Enforcement Services Fund Grant) SUMMARY OF REQUEST: It is requested that a Public Hearing be held to consider the acceptance of funds provided under State Assembly Bill AB 3229, Chapter 134 and that at the conclusion of that hearing, approval be granted for the proposed expenditure of these funds. BACKGROUND: 1111996, State Assembly Bill AB 3229, Chapter 134, established the Citizens' Options for Public Safety Program to provide funds to eligible local jurisdictions. Pursuant to the current provision of this bill, monies allocated from the Supplemental Law Enforcement Services Fund (SLEFSF) to recipient entities must be expended exclusively to provide front line law enforcement services. These funds must also be used to supplement existing services and by statute cannot be used to supplant any existing funding for law enforcement services provided by that entity. Legislation related to these funds requires that all reporting mandates are met and that these funds be expended in the prescribed fiscal year to avoid forfeiture of the funds. The City has received notification that the 2006/07 State budget will appropriate funds to Orange County and based on population; Seal Beach is expected to receive approximately $100,000.00. As previously stated, these funds must be spent for "front line municipal police services. in accordance with written requests submitted by the Chief of Police of that city or the Chief Administrator of the law enforcement agency that provides po/ice services to that city. These written requests shall be acted upon by the City Council." Government Code Section 30061 [c][2]. It is recommended that these funds be accepted and supplement our existing front line services in the following manner: Agenda item N' Provide Funds for Community Policinl!: Overtime . It is proposed that funding will cover the salary and benefits for Officers through assigned overtime for continuation of community policing efforts; and/or, Partiallv fund one Civilian SUDtlort Services Manal!:er It is proposed that funding will partially cover the salary of a civilian support services manager, freeing and returning sworn personnel carrying collateral duties to their frontline positions; and/or, Additional eauinment. software. and traininl!: It is proposed that funding will help acquire additional community policing equipment, software, and training, as well as additional frontline equipment. FISCAL IMPACT: These funds were initially proposed to be part of a five (5) year funding cycle and the 2006/07 grant is year six. The legislature has chosen to continue the funding for an indeterminate number of succeeding years. RECOMMENDATION: . It is recommended that a public hearing be held and that Council approval be given to the acceptance of the 2006/07 Supplernental Law Enforcement (State COPS) funding; that the established SLESF be authorized to accept such funds; and that approval be given to the Chief of Police to expend these funds as detailed in this report.
