Council Member Steele led the Pledge of Allegiance. ROLL CALL Present: Mayor Moore Council Members: Kalmick, Landau, Steele, Sustarsic Absent: None City Staff: Nicholas Ghirelli, City Attorney Jill R. Ingram, City Manager Patrick Gallegos, Assistant City Manager Michael Henderson, Police Chief Joe Bailey, Marine Safety Chief, Marine Safety Department Alexa Smittle, Director of Community Development Barbara Arenado, Director of Finance/City Treasurer Iris Lee, Public Works Director Gloria D. Harper, City Clerk Division 1 Chief Craig Covey, Orange County Fire Authority Mike Ezroj, Police Captain Alayna Hoang, Finance Manager David Spitz, Associate Engineer Tim Kelsey, Recreation Manager APPROVAL OF AGENDA & WAIVER OF FULL READING OF RESOLUTIONS AND ORDINANCES Four (4) supplemental items were received after the posting of the agenda and were distributed to the City Council and made available to the public. Council Member Kalmick moved, second by Council Member Steele, to approve the agenda. AYES: Kalmick, Landau, Moore, Steele, Sustarsic NOES: None ABSENT: None ABSTAIN: None Motion carried PRESENTATIONS / RECOGNITIONS • Seal Beach Pickleball Association Report • Annual Comprehensive Financial Report Presentation PUBLIC COMMUNICATIONS Mayor Moore opened oral communications. Speaker: Joyce Ross-Parque. Mayor Moore closed oral communications. CITY ATTORNEY REPORT City Attorney Ghirelli indicated that the City Council met in Closed Session to discuss the one item posted on the Closed Session agenda. All Council Members were present with the exception of Council Member Landau. No reportable action was taken. CITY MANAGER REPORT City Manager Ingram had no items to report; however, she provided a clarification for the record to the comment made during the Public Communications portion of tonight's meeting. She stated that there was a public comment period allotted for public comments prior to the start of the Special Closed Session meeting held on Friday, March 17, 2023, referenced during the Public Communications period and that all members of the public are asked to leave after the comment period as the Closed Session discussions are not open to the public. She noted that those interested in the public comment period process should contact the City Clerk's Office for more information. COUNCIL COMMENTS Council Member Landau reported her attendance at the Celebration of Life for Robin Fort- Lincke. She thanked the Seal Beach Chamber of Commerce, the City, and the Police Department for another wonderful Classic Car Show. She also reported that she attended two (2) Budget Workshops and as part of her ongoing education, she has been touring each department and experiencing what staff does firsthand. Council Member Landau thanked Marine Safety Chief Bailey for the Beach and Lifeguard Headquarters tour and indicated that she looks forward to the Public Works tour next week. Council Member Landau congratulated the Seal Beach Yacht Club on their 63rd Opening Day Ceremony. Lastly, she asked everyone to mark their calendars for the upcoming Neighbor 4 Neighbor Block Captain meeting, scheduled for Tuesday, May 30 2023, at 6:00 p.m. at the Seal Beach Police Department. Mayor Pro Tem Sustarsic reported her attendance at the Orange County Sanitation District (OCSD) meeting, an OCSD Operations Committee meeting, and the Los Cerritos Wetlands Renovation Committee meeting via Zoom, where there was a discussion on the redevelopment of the southern section north of Gum Grove. Mayor Pro Tern Sustarsic reported her attendance at the Seal Beach Classic Car Show and the Memorial Service for Robin Fort-Lincke. She also reported that she attended two (2) Budget Workshops and the Planning Commission meeting. Council Member Steele was invited to visit the West-Comm Dispatch Center and noted what an amazing, eye-opening experience of their operation. He attended a West Orange County Water District meeting with Public Works Director Lee and also the Audit Committee meeting with City staff. Additionally, he attended the Seal Beach Classic Car Show, the 100th Anniversary of the Ramona Bowl in Hemet, the Budget Workshops, and had a tour of the Lifeguard Headquarters, the beach, and the boat with Marine Safety Chief Bailey. Lastly, he reported that attended the Southern California Association of Governments conference, which he noted as highly informative. Council Member Kalmick reported that he attended the Southern California Association of Governments conference noting his networking connection with a Coca Cola representative and the removal of plastics from the ocean. He noted that he also attended the Classic Car Show, and an Orange County Fire Authority Human Resources Committee meeting. Mayor Moore reported that he attended the Seal Beach Classic Car Show and congratulated the Chamber of Commerce on a wonderful job. Additionally, he attended the Seal Beach Yacht Club Opening Day Ceremony and was honored to present them with a plaque along with Council Member Landau. Lastly, he reported that he attended the two (2) Budget Workshops. Mayor Moore requested one additional Budget Workshop prior to adopting the budget to further discuss the 5-Year Forecast and pre-allocated accounts for projects such as the pool and the pier. COUNCIL ITEMS There were no council items. CONSENT CALENDAR Council Member Steele moved, second by Council Member Sustarsic, to approve the recommended actions on the consent calendar. A. Approval of the April 24, 2023 City Council Minutes -That the City Council approve the minutes of the Closed Session meeting held April 24, 2023 and minutes of the Regular City Council meeting held on April 24, 2023. B. Demands on City Treasury (Fiscal Year 2023) May 8, 2023 - Ratification. C. Report of City Manager and Department Heads Authorized Contracts - That the City Council receive and file the report. D. Approving and Authorizing Amendment No. to Professional Services Agreement with Ardurra Group, Inc. for the Sewer Pump Station #35 Improvements (CIP SS1903) Project Management Services - That the City Council adopt Resolution 7401 : 1. Approving Amendment No. 1 to the Professional Services Agreement with Ardurra Group, Inc., (a) to extend the Agreement term to December 31, 2025, (b) to modify the Scope of Services during the extension by eliminating the 6th Street Alley and Water Replacement (CIP SS1902) and limiting the Scope of Services to the Sewer Pump Station #35 Improvements (CIP SS1903) only, and (c) to update the labor rates during the extension; and, 2. Authorizing the City Manager to execute Amendment No. 1. E. City of Seal Beach Annual Audit Reports for Fiscal Year Ended June 30, 2022 - _ That the City Council receive and file the following documents for fiscal year ending June 30, 2022: A. Audit Communication Letter B. Report on Internal Control C. Annual Comprehensive Financial Report (ACFR) D. Appropriations Limit Final Report. PUBLIC HEARING There were no public hearing items. UNFINISHED/CONTINUED BUSINESS There were no unfinished/continued business items. NEW BUSINESS F. Consideration of Ordinance 1704 to Add Chapter 7.65 to the Seal Beach Municipal Code to Regulate the Operation of E-Bikes and Other Regulated Mobility Devices on Public Areas - That City Council introduce Ordinance 1704 to add Chapter 7.65 to the Seal Beach Municipal Code, addressing the operation of regulated Mobility Devices, including e-bikes, waive full reading and read by title only. This will provide the City with an ordinance that addresses the safety issues with e-bike operations within the city limits. Police Captain Ezroj provided a comprehensive background on the staff report and addressed questions from Council Members. Council Member Landau moved, second by Mayor Pro Tern Sustarsic to introduce Ordinance 1704 to add Chapter 7.65 to the Seal Beach Municipal Code, addressing the operation of regulated Mobility Devices, including e-bikes, waive full reading and read by title only. This will provide the City with an ordinance that addresses the safety issues with e-bike operations within the city limits.
