HomeMy WebLinkAboutPC Min_2023-04-03City of Seal Beach — Regular Meeting of the Planning Commission April 3, 2023 Chair Campbell called the Planning Commission meeting to order at 7:00 p.m. Commissioner Massetti led the Pledge of Allegiance. ROLL CALL Present: Commissioners: Mingione, Massetti, Wheeler, Coles, Campbell Absent: None Staff Present: Amy Greyson, Senior Assistant City Attorney Alexa Smittle, Community Development Director Shaun Temple, Planning Manager Marco Cuevas, Jr., Associate Planner Gloria D. Harper, City Clerk APPROVAL OF AGENDA By Motion of the Planning Commission this is the time to notify the public of any changes to the agenda, re- arrange the order of the agenda, and provide an opportunity for any member of the Planning Commission or staff to request an item be removed from the Consent Calendar for separate action. Motion by Commissioner Wheeler, second by Vice Chair Coles to approve the agenda. AYES: Campbell, Coles, Mingione, Massetti, Wheeler NOES: None ABSENT: None ABSTAIN: None Motion Carried. PUBLIC COMMUNICATIONS Chair Campbell opened public communications. Speaker(s): There were no speakers. Chair Campbell closed public communications. City Clerk Harper announced that two (2) comments were received after the posting of the agenda. She noted that the comments were distributed to the Commissioners and made available to the public on the City's website. CONSENT CALENDAR A. Approval of the March 20, 2023, Planning Commission Minutes Motion by Commissioner Wheeler, second by Vice Chair Coles to approve the agenda. AYES: Campbell, Coles, Mingione, Massetti, Wheeler Y NOES: None ABSENT: None ABSTAIN: None Motion Carried. CONTINUED ITEMS - None SCHEDULED MATTERS - None NEW BUSINESS - None PUBLIC HEARING B. Conditional Use Permit 22-6 12101 Seal Beach Boulevard Applicant: Terry Womack c/o Chick-Fil-A, Inc. Request: A Conditional Use Permit (CUP 22-06) to allow the expansion of the drive through from one to two lanes and the construction of two drive-through canopy structures at an existing fast food restaurant located at 12101 Seal Beach Boulevard in the General Commercial (GC) zoning area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 23-05, APPROVING Conditional Use Permit 22-6 with Conditions and find the project exempt from CEQA. Associate Planner Marco Cuevas, Jr., provided a comprehensive staff report. Commissioner's questions were addressed. Chair Campbell opened the public hearing. Speakers: None. Motion by Commissioner Massetti, second by Vice Chair Coles that the Planning Commission adopt Resolution No. 23-0, APPROVING Conditional Use Permit 22-6 with conditions and find the project exempt from CEQA. AYES: Massetti, Mingione, Wheeler, Coles, Campbell NOES: None ABSENT: None ABSTAIN: None Motion Carried Senior Assistant City Attorney Greyson noted that there is a 10 -day appeal period that starts April 4, 2023. C. Minor Use Permit 23-2 101 Main Street, Suite N Applicant: Joseph Kirolos/Marina Cafe Request: A Minor Use Permit (MUP 23-2) to allow an outdoor dining and seating area by allowing sidewalk seating in front of the coffee house/desert shop premises at an existing coffee house/desert shop located at 101 Main Street, Suite N, within the Main Street Specific Plan (MSSP) area. Recommendation: After conducting the Public Hearing, staff recommends that the Planning Commission adopt Resolution No. 23-06, APPROVING Minor Use Permit 23-02 with Conditions and find the project exempt from CEQA. Associate Planner Marco Cuevas, Jr., provided a comprehensive staff report. Commissioner's questions were addressed. Chair Campbell opened the public hearing. Speakers: Marc Loopesko, Rob McComb, Deb Machen, Pascal Chheng and Anita Parker. Chair Campbell closed the public hearing. After Commission deliberation and public comments. This item was continued for 30 days. Motion by Commissioner Wheeler, second by Vice Chair Coles that the Planning Commission Continue the Public Hearing to adopt Resolution No. 23-03, APPROVING Minor Use Permit 23-1 with Conditions and find the project exempt from CEQA, for 30 days, until May 1, 2023. AYES: Massetti, Mingione, Wheeler, Coles, Campbell NOES: None ABSENT: None ABSTAIN: None Motion Carried COMMISSION CONCERNS There were no Commission Concerns.
