Ybaben moved, second by Antos, to approve the order of the agenda as emended. AYES: NOES: Antos, Larson, Levitt, Shanks, Ybaben None Motion carried PRESENTATIONs/PROCLAMATIONS There were no presentations. e ORAL COMMUNICATION Mayor Lerson declared Oral Communications to be open. Mr. Ray Roberis, Huntington Beach, Introduced himself as the democrat candidate for the 67th Assembly District and gave e brief statement regarding his qualifications and goals. Ms. Schelly SUslarslc, College Park East, InvRed everyone to the Concert in the Perk on September 17th. 4:00 - 6:00 p.m. at Heather Park. Dr. Robert Goldberg, Seal Beach, spoke about Item 'f'" and questioned the enforceability of the new section 7.20.085 - prohibiting sleeping In vehicles ovemight. Ms. Joyce parque, Seal Beach, slated thet she did not think the Planning Commission should be rushing to recommend an ordinance change that would limit the height to 25 feet because the voters will be voting on a proposition that would require the city to compensate any resident If a zone change would lower their property value - also slated she believes that members of the Council and Planning Commission are meeting In private end made comments regarding the flyer Page - 2 City Council 09-11-08 e distributed by Councilman Antos. Councilman Antos denied eny allegations. There being no other speakers. Mayor LalSOn declared Orel Communications closed, CITY ATTORNEY REPORT No report was given. CITY MANAGER REPORT The City Manager announced on September 16th there will be the 22nd Annual Clean the Beach Day and that s1aff Is preparing for the storm season and will be sending outlnformallon to the residents reminding them to also prepare for the storms. COUNCIL COMMENTS Councilman Shanks commented that the Council needs to review the priority list that they discussed at their June 26th meeting. The number one priority should be the Locel Coastal Plan. COUNCIL ITEM No items at this time. AYES: NOES: Antos, Larson, Levitt, Shanks, Ybaben None Motion carried ITEMS REMOVED FROM THE CONSENT CALENDAR ITEM "K"' ON-CALL LANDSCAPE ARCHITECTURE SERVICES' DAVID VOLZ DESIGN The DIrector of Public Works/City Engineer addrassed Councilman Shanks' concerns that the final approval for the plans and speclllcations to Bluebell Park would come before the Council. The Director also provided the Council with a price sheet for the architect design service. Shanks moved, second by Antos to adopt Resolution Number 5498 entitled 'A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING THE PROFESSIONAL SERVICES AGREEMENT BETWEEN CITY OF SEAL BEACH AND DAVID VOLZ DESIGN FOR ON-CALL LANDSCAPE ARCHITECTURE SERVICES." By unanimous consent, full reeding of Resolution Number 5498 was waived. e AYES: NOES: Antos, LalSOn, Levlll, Shanks, Ybaben None Motion carried Page - 4 City Council 09-11-06 e PUBLIC HEARING ITEM 'N' / 2006-2007 SUPPLEMENTAL LAW ENFORCEMENT SERVICES FUND (SLESFI GRANT Mayor Larson declered the public hearing open to consider acceptence of the State COPS funds and the allocation thereof. The City Clerk certified that notice of the public hearing had been edvertlsed In the Sun newspaper on August 31, 2008, as required by law, and reported no communications were received for or against. The City Manager stated that the public hearing Is a requirement for receiving the 200612007 Supplemental Law Enforcemant Services Fund (SLESF) grant of approximately $100,000 to enhance law enforcement such as communRy policing efforis and training. Meyor Larson invited members of the audience wishing to speak at this time to come to the microphone and identify themselves for the record. There being no apeakers, Meyor Lerson declared the public hearing closed. Antos moved, second by Shanks, to accept the 2008/2007 Supplemental Law enforcement (State COPS) funding of approximately $100,000; that the established SLESF be authorized 10 accept such funds; and authorize the Chief of Police to expend the funds for police personnel to enhance frontiine community policing and problem solving; related technology equipment, end training exclusively dedicated to community policing efforis. AYES: NOES: Antos, Larson, Levitt, Shanks, Ybaben None Motion carried e NEW BUSINESS ITEM '0"/ COLLEGE PARK EAST EMERGENCY ACCESS The Director of Public Works reported that College Park West neighborhood submllled e petition requesting an emergency access be made available to their neighborhood should the bridge leading to and from their residences fail. The staff found three alternative emergency access points that could be used: the San Gabriel River Trail - this can only accommodete one-way traffic and two emergency access points are In Callrans Right of Way behind the old basketball couris at College Park Drive and Loyola Pleza - they all lead onto the 22-freeway on-ramp with IImRed sight clearance and high vehicle speeds. The Director said that staff will work with the City of Long Beech, County of Los Angeles, Police Department, as well as the Fire Authority to develop infonnation for distribution to College Park West residents regarding emergency access. Antos moved, second by Ybaben, to direct staff to work wRh Caltrans for the emergency access permlis. AYES: NOES: Antos, Larson, Levill, Shanks, Ybe6en None Motion carried. e ITEM "P" / ORDINANCE NUMBER 1551 / SEAL BEACH MUNICIPAL CODE / AMEND TITLE 7 "PUBLIC PEACE. MORALS. AND WELFARE" The Director of Development Services stated that an update to the City's Municipal Code would include regulating the number of animals at a residence, prohlbillng ovemlght sleeping In vehicles, restricting noise from heating, ventilation and elr condRloning (HVAC) equlpments, and regulating uses and operations of the tennis center. It was clarified that the section regarding sleeping In vehicles would not affect Leisure Worid. Councilman Shanks asked that recreational vehicles (RV's) be added to the list In section 7.20.085, Shanks moved, second by Antos, to Introduce the first reading of Ordinance Number 1551 entitied "AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING THE SEAL BEACH MUNICIPAL CODE BY REGULATING THE NUMBER OF ANIMALS AT A RESIDENCE, PROHIBITING OVERNIGHT Page - 5 City Council 09.11-06 e SLEEPING IN VEHICLES, RESTRICTING NOISE FROM HEATING, VENTILATION AND AIR CONDITIONING (HVAC) EQUIPMENT, AND REGULATING USES AND OPERATIONS OF THE TENNIS CENTER,. and add recreational vehicle to the list In section 7.20.085. The City AlIorney read the tllle of the Ordinance for the record end sleled that the second reading and adoption of Ordinance Number 1551 will be on the City Council consent agenda at a later meeting. By unanimous consent, full reading of Ordinance Number 1551 was waived. AYES: NOES: Antos, Larson, Levitt, Shanks, Ybaben None Motion carried Mayor Larson recessed the City Council meating et 7:35 p.m. to the Redevelopment Agency and reconvened the meeting at 7:36 p.m. ADJOURNMENT Mayor Larson requested that the audience stand for a moment of silence in observance of September 11th. It was the order of the Chair, with consent of the Council, to adjourn the Council meeting et7:37 p.m. to Mondey, September 25th, 2006 at 8:30 p.m. to meet in Closed Session, If deemed necessary.
