AYES: Kalmick, Landau, Moore, Steele, Sustarsic NOES: None ABSENT: None ABSTAIN: None Motion carried PRESENTATIONS / RECOGNITIONS • Leisure World Centenarian Presentation — Recognizing and Honoring World War II Veteran Alfred Arrieta • Introduction of New Full-Time Employees and Recognition of Former Intern James Sonderegger • National Public Works Week — May 21 — May 27. 2023 • Parking Management Plan Update Mayor Moore asked for Council to consider delaying the town hall meetings for a year, however, there was no Council consensus to delay the town hall meetings. • Statement of Investment Policy — City's Financial Advisor (PFM) PUBLIC COMMUNICATIONS Mayor Moore opened oral communications. Speaker: Stephanie Wade, Kane Derm, and Kory DeLeon. Mayor Moore closed oral communications. CITY ATTORNEY REPORT City Attorney Ghirelli indicated he had no items to report. CITY MANAGER REPORT City Manager Ingram reported she attended the Be More Healthy Expo emphasizing how awesome it was that free health screenings were made available to the entire community and thanked Diana Bean and the Chamber of Commerce for a wonderful event. Additionally, she reported that the Executive Team along with Council Members Landau and Steele attended an infrastructure tour that included a tour of the West End Pump Station, McGaugh Pool, Lampson Well, Beverly Manor Pump Station, and Pump Station #35 in Old Town. City Manager Ingram thanked Director of Public Works Iris Lee for conducting a walk- through tour of the Traffic Management Center with all five Council members. Lastly, she reported that the entire City participated in the County-wide Tsunami tabletop emergency exercise held on May 17, 2023. She acknowledged Emergency Services Coordinator, Sergeant Brian Gray for the incredible amount of work he does on behalf of the Seal Beach community to ensure that we are properly prepared for an emergency. COUNCIL COMMENTS Council Member Landau reported her attendance at the Seal Beach Chamber Breakfast, the infrastructure tour, the Traffic Management Center walk-through, Lions Club Rubber Duck Drop, and a Marine Safety horseshoe tournament with proceeds to benefit the Lifeguard Department. She invited the community to join her at the Submarine Memorial Site on Seal Beach Boulevard at 11am on Memorial Day to honor the brave men and women who have served our country. Additionally, she noted there will also be a Memorial Day tribute at Eisenhower Park at 1 pm. Mayor Pro Tem Sustarsic reported her attendance at the Tsunami Table-Top Exercise "Next Wave," thanking the Police Department for coordinating the exercise and the Traffic Management Center tour thanking Director Iris Lee for conducting the tour. Additionally, she attended the Airport Land Use Committee meeting and the Be More Healthy Expo. She wished the Public Works department a wonderful Public Works Week noting how much she appreciates them and also wished the City Clerk's office a happy Municipal City Clerks Week the week prior, noting she wished she was able to attend one of the daily events taking place at the City Clerk's office. Lastly, she thanked the Finance department for all their hard work in preparing the Budget that is before the Council for adoption tonight. Council Member Kalmick reported that he attended an Elected Officials Summit coordinated by California Joint Powers Insurance Authority, and he and Council Member Steele were invited to attend a three (3) day water tour to the Colorado River to learn about where the City's water comes from beginning at the Hoover Dam. Council Member Steele further discussed the water tour he attended with Council Member Kalmick, noting he really enjoyed it. Additionally, he attended the Orange County Vector Control District meeting where they approved the adoption of their Budget, a Leisure World Women's Auxiliary (VFW) meeting — an organization that raises money for Veteran causes, a Golden Rain Foundation Board meeting, the beginning of the Tsunami Table-Top Exercise, the Traffic Management Center tour, the City infrastructure tour, and the City Selection Committee meeting where he indicated he was selected to be a member of the Senior Citizen Advisory Commission. Lastly, he helped staff distribute iPads to Leisure World that were awarded to the City through a grant from the County of Orange. Mayor Moore reported that he attended the Lions Club Rubber Duck Drop event where over 800 ducks were released to support the Lifeguards, attended the Traffic Management Center tour, and also the Be More Healthy Expo. Lastly, he helped staff with the distribution of iPads to Leisure World that were awarded to the City from the County through a grant. COUNCIL ITEMS There were no Council items. CONSENT CALENDAR Council Member Kalmick moved, second by Council Member Steele, to approve the recommended actions on the consent calendar. A. Approval of the City Council Minutes - That the City Council approve the minutes of the Special Budget Workshops for the General Fund held on May 1, 2023, the Capital Improvement Projects held on May 2, 2023, and the minutes of the Closed Session and Regular City Council meetings held on May 8, 2023. B. Demands on City Treasury (Fiscal Year 2023) May 22, 2023 - Ratification. C. Monthly Investment Report — April 30, 2023 - Receive and file. D. Second Reading and Adoption of Ordinance 1704 - That the City Council waive full reading, read by title only, and adopt Ordinance 1704 titled "An Ordinance of the City of Seal Beach adding Chapter 7.65 (Operation of Regulated Mobility Devices) to the Seal Beach Municipal Code to regulate the use of mobility devices in the City and finding the Ordinance to be exempt from review under the California Environmental Quality Act." E. Adopting a Resolution Listing the Projects Funded by Senate Bill 1: Road Repair and Accountability Act and Authorizing Submittal of the Project List and Application for Road Maintenance Rehabilitation Account Funds to the California Transportation Commission - That the City Council adopt Resolution 7402: 1. Approving the project list for improvements that are to be funded by Senate Bill 1; and, 2. Authorizing the City Manager, or designee, to submit the project list and application for Road Maintenance and Rehabilitation Account funds to the California Transportation Commission. F. Awarding and Authorizing Execution of a Professional Services Agreement with Interwest Consulting Group, Inc. for On-Call Reimbursable Permit Review and Plan Check Services - That the City Council adopt Resolution 7403: 1. Awarding a three-year Professional Services Agreement to Interwest Consulting Group, Inc. for Reimbursable Permit Review and Plan Check Services in a not-to-exceed amount of $80,000 per year and a total not-to exceed amount of $240,000 for the original term; and, 2. Authorizing and directing the City Manager to execute the Agreement; and, 3. Authorizing the City Manager the option to extend the Agreement up to two (2) additional one-year terms after its original term for a not-to-exceed amount of $80,000 per additional term. G. Renewal of Agreement for Prosecution Services with Orange County District Attorney (OCDA) - That the City Council adopt Resolution 7404 approving the renewal of an existing Agreement with Orange County District Attorney (OCDA) for prosecution of Seal Beach Municipal Code violations. This Agreement shall continue in full force and effect for a five-year period commencing July 1, 2023, terminating on June 30. 2028. H. Approve the Fiscal Year 2022-23 Year-End Budget Amendment 23-11-01 - That the City Council adopt Resolution 7405 to approve Fiscal Year 2022-23 Budget Amendment BA 23-11-01 for various Special Fund amendments. I. Fiscal Year 2023-24 Statement of Investment Policy and Delegation of Authority That the City Council adopt Resolution 7406 approving the Fiscal Year 2023-24 Statement of Investment Policy and Delegation of Authority to the Director of Finance/Treasurer. J. Training Partnership with Rancho Santiago Community College District(RSCCD) - That the City Council adopt Resolution 7407 approving a contract for a partnership in training Beach Lifeguards between the City of Seal Beach and Rancho Santiago Community College District (RSCCD). Annual Military Equipment Report and First Reading of Ordinance 1705 Renewing Ordinance 1694 and Approving Seal Beach Police Department's Updated Policy 706 - That the City Council take the following actions: 1. Receive and file the Seal Beach Police Department's 2022 Annual Military Equipment Report; and, 2. Introduce, waive full reading and read by title only, Ordinance 1705, to renew Ordinance 1694 and to approve the updated Seal Beach Police Department's Military Equipment Use Policy — Policy 706. Police Lieutenant Julia Clasby provided a comprehensive background on the staff report and addressed questions from Council Members. Mayor Moore opened the public hearing. Speakers: None. Receive and file the Seal Beach Police Department's 2022 Annual Military Equipment Report; and, 2. Introduce, waive full reading and read by title only, Ordinance 1705, to renew Ordinance 1694 and to approve the updated Seal Beach Police Department's Military Equipment Use Policy — Policy 706. Street Lighting Assessment District No. 1 - That the City Council adopt Resolution 7408 confirming the diagram, assessment, and levying assessments for the Seal Beach Street Lighting Assessment District No.1 (District) for Fiscal Year 2023-2024. Council Member Landau moved, second by Mayor Pro Tem Sustarsic to adopt Resolution 7408 confirming the diagram, assessment, and levying assessments for the Seal Beach Street Lighting Assessment District No.1 (District) for Fiscal Year 2023-2024. AYES: Kalmick, Landau, Moore, Steele, Sustarsic NOES: None ABSENT: None ABSTAIN: None Motion carried M. Adopt the Fiscal Year 2023-24 Operating and Capital Improvement Budget, Set the Appropriations Limit for Fiscal Year 2023-24, and Authorize the Use of the Cost Recovery Schedule for Use in Fiscal Year 2023-24 -That the City Council hold a public hearing and then adopt Resolution 7409: 1. Adopting the Fiscal Year 2023-24 Operating and Capital Improvement Budget and authorizing actions in furtherance thereof; and, 2. Setting the Appropriations Limit for Fiscal Year 2023-24; and, 3. Authorizing the use of the Cost Recovery Schedule in Fiscal Year 2023-24. Director of Finance Barbara Arenado provided a comprehensive background on the staff report and addressed questions from Council Members. Mayor Moore opened the public hearing. Speakers: None. Council Member Kalmick moved, second by Council Member Steele to adopt Resolution 7409: 1 . Adopting the Fiscal Year 2023-24 Operating and Capital Improvement Budget and authorizing actions in furtherance thereof; and, 2. Setting the Appropriations Limit for Fiscal Year 2023-24; and, 3. Authorizing the use of the Cost Recovery Schedule in Fiscal Year 2023-24. Reducing a Level 2 Water Supply Shortage to a Level 0 Water Supply Shortage. Management Analyst Sean Sabo provided a comprehensive background on the staff report and addressed questions from Council Members. Council Member Steele moved, second by Mayor Pro Tern Sustarsic to adopt Resolution 7410: 1. Rescinding Resolution 7139 declaring a Level 2 Water Supply Shortage; and, 2. Reducing a Level 2 Water Supply Shortage to a Level 0 Water Supply Shortage.
