A RESOLUTION OF THE SEAL BEACH CITY COUNCIL APPROVING
RECORDATION OF A COVENANT ON CERTAIN CITY-OWNED REAL
PROPERTIES PURSUANT TO GOVERNMENT CODE SECTION
54220, ET SEQ., AND FINDING THAT SUCH DECLARATION IS
EXEMPT FROM ENVIRONMENTAL REVIEW UNDER THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT, AND TAKING
RELATED ACTIONS
WHEREAS, the City of Seal Beach is the owner in fee simple of that certain real property
located at 4197 Ironwood Avenue, Seal Beach, CA (Assessor Parcel Number 217-191-
09) ("Property"); and
WHEREAS, the Surplus Land Act, Government Code Section 54220, et seq., defines
specific actions be taken to dispose of publicly owned property; and,
WHEREAS, the City previously determined that the Property is not suitable for the City's
use, declared the Property surplus, and initiated disposition proceedings; and,
WHEREAS, the Surplus Land Act requires a covenant be recorded governing housing
affordability for future residential use of the Property if ten or more housing units are
developed.
NOW, THEREFORE, THE SEAL BEACH CITY COUNCIL DOES HEREBY RESOLVE:
Section 1. The City Council of the City of Seal Beach hereby approves the Surplus
Land Act Covenant for the Property and authorizes the City Manager to
execute said covenant.
Section 2. This Resolution is exempt from the California Environmental Quality Act
(Public Resources Code Section 21000 et seq.) ("CEQA") as designation of
this Property as surplus does not have the potential for creating a significant
effect on the environment and is therefore exempt from further review under
CEQA pursuant to State CEQA Guidelines Section 15060(c)(3) because it
is not a project as defined by the CEQA Guidelines Section 15378. Adoption
of the Resolution does not have the potential for resulting in either a direct
physical change in the environment or a reasonably foreseeable indirect
physical change in the environment.
Section 3. The Council hereby directs the City Manager or authorized designee to do
all things necessary to effectuate the purposes of this Resolution, including
preparation of all materials required by State law related to disposition of
the Property.
PASSED, APPROVED and ADOPTED by the Seal Beach City Council at a regular
meeting held on the 11th day of September, 2023 by the following vote:
