Chair Campbell called the Planning Commission meeting to order at 7:00 p.m.
Commissioner Wheeler led the Pledge of Allegiance.

APPROVAL OF AGENDA
By Motion of the Planning Commission this is the time to notify the public of any changes
to the agenda, re- arrange the order of the agenda, and provide an opportunity for any
member of the Planning Commission or staff to request an item be removed from the
Consent Calendar for separate action.
Motion by Commissioner Wheeler, second by Vice Chair Coles to approve the agenda.

PUBLIC COMMUNICATIONS
Chair Campbell opened public communications. Speaker: James Gregson. Chair Campbell
closed public communications.
City Clerk Harper announced that one (1) comment was received after the posting of the
agenda and noted that the comments were distributed to the Commissioners and made
available to the public on the City's website.
CONSENT CALENDAR
A. Approval of the May 1, 2023, Planning Commission Minutes
Motion by Commissioner Wheeler, second by Vice Chair Coles to approve the consent
calendar.

PUBLIC HEARING
B. Minor Use Permit 23-03
12830 Seal Beach Boulevard, Suite B
Applicant: Request: For a Minor Use Permit (MUP 23-03) to allow the operation of a small
scale commercial recreational use/Pilates Studio use in a multi-unit commercial building in
the General Commercial (GC) Zone.
Recommendation: After concluding the Public Hearing and receiving public testimony, staff
recommends that the Planning Commission adopt Resolution No. 23-07, APPROVING
Minor Use Permit 23-03 to permit the operation of a Pilates Studio, in the General
Commercial (GC) zoned area in an exiting shopping center located at 12830 Seal Beach
Boulevard, Suite "B," and find the project exempt from CEQA.
Associate Planner Marco Cuevas, Jr., provided a comprehensive staff report.
Commissioner's questions were addressed.

Motion by Commissioner Wheeler, second by Vice Chair Coles that the Planning
Commission adopt Resolution No. 23-07, APPROVING Minor Use Permit 23-03 to permit
the operation of a Pilates Studio, in the General Commercial (GC) zoned area in an
existing shopping center located at 12830 Seal Beach Boulevard, Suite "B," and find the
project exempt from CEQA.

Senior Assistant City Attorney Greyson noted that there is a 10-day appeal period that
starts May 16, 2023.
C. Conditional Use Permit 19-7, Variance 22-1 , General Plan Amendment 19-1,
Zone Change 19-1
1300 E. Pacific Coast Highway, 328 13th Street, 324 13th Street
Applicant: Travis Companies, Inc.
Request: Request for approval of a Conditional Use Permit (CUP 19-7) to allow the
reconstruction of an Automobile Service Station and addition of a new Convenience
Store in the General Commercial (GC) Zone, including the incorporation of the
southern abutting property into the Project Site, which is in the Residential High
Density (RHD-20) Zone. Request for recommendation that the City Council approve
a General Plan Amendment (GPA-1) to change the land use category of the
property at 328 13th Street from Residential High-Density to General Commercial.
Request for recommendation that the City Council approve a Zone Change (ZC 19-
1) of the property at 328 13th Street from RHD-20 to GC, and to change the zone of
324 13th Street from RHD-20 to RHD-33. Request for approval of a Variance (VAR
22-1) from standards of Section 11.4.05.035.B of the Municipal Code (Standards for
Specific Uses — Automobile Service Station).
Recommendation: After conducting the Public Hearing, staff recommends that the
Planning Commission adopt Resolution No. 23-08, APPROVING Conditional Use Permit
19-7 and Variance 22-1 with Conditions, and RECOMMENDING to the City Council the
adoption of the Negative Declaration and approval of Zone Change 19-1 and
General Plan Amendment 19-1.
Planning Manager Shawn Temple provided a comprehensive staff report. The
Commissioner's questions and concerns were addressed.
Chair Campbell opened the public hearing. Speakers: Karl Huy, Julie Jackson, Jill Dunn,
Charles Richie, Beth Beranek, Dan Watson, Josh Haney, Guy and Robin LaFerrara,
Theresa Miller, Christy Kale, Karen Polik, Al Higginbotham, Matthew Terry, David Michalik,
and David Broomhead. Chair Campbell closed the public hearing.
Motion by Commissioner Wheeler, second by Vice Chair Coles that the Planning
Commission Continue the Request for a Conditional Use Permit 19-7 and Variance 22-1
with Conditions, and the adoption of the Negative Declaration and approval of Zone
Change 19-1 and General Plan Amendment 19-1 for ninety (90 days), and request that
the Applicant provide the Commission and Staff with a Traffic Engineering and Noise and
Air Report.
The Commissioners questions and concerns were answered by the Applicant, Planning
Manager Shawn Temple, and Community Development Director Alexa Smittle.

COMMISSION CONCERNS
Commissioner Massetti commented that there had been a thoughtful and useful discussion
and hope that the discussion has allayed some of the fears.
DIRECTOR'S REPORT
Community Development Director Smittle reported that one of the priorities set by the City
Council is to adopt a Local Coastal Plan. The first half, the Draft Land Use Plan has been
created and sent to Coastal Commission staff for their review and comment. The document
is also available on our website under Community Development . The public is welcome to
review the document and provide staff with suggestions, comments, and feedback. There
should be a header on the main landing page by tomorrow that the public can click through
and provide their comments. There is a no deadline for the Coastal Commission to provide
a review.
ADJOURNMENT
Chair Campbell adjourned the Planning Commission meeting at 9:47 p.m. to Monday, June
5, 2023, at 7:00 p.m.
