SUMMARY OF REQUEST:

Conduct public hearing. After closing of the public hearing, adopt Resolution No. .
A Resolution of the City Council of the City of Seal Beach Establishing Fees and
Charges for Goods, Services and Facilities Provided by the City of Seal Beach and
Superseding Inconsistent Provisions of Resolution 5477.
BACKGROUND:
On June 26, 2006 the City Council adopted Resolution No. 5477, establisbing fees and
charges for goods, services and facilities provided by the City of Seal Beach, and
superseding inconsistent provisions of various resolutions. As part of the comprehensive
Code revision process that has been completed by the City Council, certain revisions to
the fees and charges established by Resolution No. 5477 are proposed for adoption by the
City Council.
The Council will consider adopting the following amendments to the current fees:
o New and Revised Fee, Section 3, Planning Fees, Sub-section A, Filing Fees, new
item 18, Special Events, increase current fee from $100.00 to $125.00 and adopt
the following fees for multiple event applications:

CI Basis for Requested Fee Increase: To offset increased staff processing
and mailing costs for special event pennit requests, including establishing new
fees to process applications for multiple events within a single application.
CI Annual Adjustment, Section, Planning Fees, Sub-sections C and D,
Transportation Facilities & Programs Development Fees and Transportation
Facilities & Programs Development Application Fees, proposed to be
increased by 3.3% in accordance with the provisions of City Council Resolution
No. 4405, adopted August 14,1995.
CI Basis for Requested Fee Increase: To reflect increased construction
costs in accordance with the provisions of City Council Resolution No. 4405,
adopted August 14, 1995.
CI Revised Fee, Section 4, Police Fees, Sub-sections A.I, Direct Alarm System
Application Fee, and 4.A.2, Indirect Alarm System Application Fee, proposed
to be increased from $14.00 and $10.00 to $30.00 and $25.00, respectively.
CI Basis for Requested Fee Increase: To offset increased staff processing
costs for reviewing and issuing permits. Fee has not been increased since
1996. Adjacent co=unity fees: Cypress - $25.00; Huntington Beach -
$36.00; Los Alamitos - $30.00.

CI Revised Fee, Section 4, Police Fees, Sub-section B.1.a, Animal License, Dog,
proposed to be increased from $27.00 to $36.00 for an unaltered dog.
CI Basis for Requested Fee Increase: To encourage more animals to be
altered. City of Long Beach fee is $60.00 for an unaltered dog.
CI New Fee, Section 4, Police Fees, Sub-section B.7, Nondomestic Animal Permit,
proposed to be established at $45.00.
CI Basis for Requested Fee Increase: To establish a fee for nondomestic
animals in accordance with the reco=endation of the Police Department
based on their discussions with Long Beach Animal Control, the City's
contract service provider.
CI Revised Fee, Section 4, Police Fees, Sub-sections 4.J.l, Vehicle Storage, Copy
of Signed Vehicle Storage Release Form, and 4.J.2, Copy of Signed Vehicle
Impound Release and Administrative Overhead associated with a 30 day
impound, proposed to be increased from $20.00 and $127.00 to $50.00 and
$150.00 respectively.
o Basis for Requested Fee Increase: To offset increased staff processing

current fee of $127.00 in Seal Beach to $354.00 in Fountain Valley for a
Copy of Signed Vehicle Impound Release and Administrative Overhead
associated with a 30 day impound.
o New Fee, Section 4, Police Fees, Sub-section M, Audio Files, proposed to be
established at $25.00 for preparation of audio police records requests.
o Basis for Requested Fee Increase: To offset Police Department staff
costs for preparation of "Audio Files" based on increased public requests for
this information.
o Revised Fee, Section 5, Public Works Fees, Sub-section C.l, Final Subdivision
Map Filing and C.2, Final Map Plan Check, proposed to be increased from
$150.00 and $500.00 to $175.00 and $600.00, respectively.
o Basis for Requested Fee Increase: To offset increased staff and
consultant processing costs for Final Map Filing and Final Map Checking.

o Revised Fee, Section 5, Public Works Fees, Sub-section C., Lot Line
Adjustment, sub-sections 5.C.4.a, For each Lot Line Adjustment, and sub-
section 5.C.4.b, For each Certificate of Compliance, proposed to be increased
from $100.00 to $150.00.
o Basis for Requested Fee Increase: To offset increased staff and
consultant processing costs for processing and approving a Lot Line
Adjustment and a Certificate of Compliance.
o Revised Fee, Section 5, Public Works Fees, Sub-section D., Plan Check and
Review, sub-section 8, Traffic Plan Review, proposed to be increased from
$130.00 to $150.00.
o Basis for Requested Fee Increase: To offset increased staff and
consultant processing costs for processing and approving a Traffic Plan.
o Revised Fee, Section 5, Public Works Fees, Sub-section E., General
Construction Permits, sub-section 4, Class A Public WorkslEncroachment
Permit Costs and Plan Check, proposed to be increased from $110.00 minimum
deposit per application plus time and materials to $120.00 minimum deposit per

costs based on time and a half costs of a Police Officer, including benefits
allowed by the Office of Traffic Safety .
Please note that the City Council approved an increase on April 23, 2007 to Section 11,
Business License Tax and Pennits, to increase the "Base Tax" by 3.5%, and all other
business license fees adjusted accordingly, in accordance with the provisions of Seal
Beach Municipal Code, Article 5, Business Licenses and Regulations, Section 5.10.030,
Annual Adjustment. Those previously approved revised fees are reflected in the
proposed Comprehensive Fee Resolution.
All other fees will remain the same for fiscal year 2007/08 as established by City Council

schedule of fees is provided as Attachment 1. Resolution 5477 is provided as Attachment
2.
All other fees will remain the same for fiscal year 2007/08 as established by City Council
Resolution 5477. The proposed fees have been incorporated into the proposed resolution
that is provided as Attachment 1.
FISCAL IMPACT:
Minimal. The proposed fee revisions are established to capture actual costs incurred for
the provision of city goods, services, and facility use.
RECOMMENDATION:
Conduct public hearing. After closing of the public hearing, adopt Resolution No. ,

RESOLUTION NUMBER
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SEAL BEACH ESTABLISHING
FEES AND CHARGES FOR GOODS,
SERVICES AND FACILITIES PROVIDED BY
THE CITY OF SEAL BEACH AND
SUPERSEDING RESOLUTION 5477
WHEREAS, the City Council is empowered to impose reasonable fees, rates, and charges
for municipal services; and
WHEREAS, the City Council has determined that the fees, rates, and charges should
cover the costs reasonably borne or a substantial porti.on of the actual costs of the goods
and services provided by the City; and

WHEREAS, the City Council has determined that fees, rates, and charges for municipal
services do not cover the actual costs under the current fee schedules;
NOW, TIIEREFORE, BE IT RESOLVED, the City Council of the City of Seal Beach
hereby establishes the amount of certain fees, rates and charges, and restates that amount
of other fees, rates, charges and taxes as follows:
SECTION 1. ADMINISTRATIVE FEES
A. Documents
The following fees are established to reimburse the City for costs relative to
filling public requests for copies of non-confidential records; codes, brochures,
booklets and patent materials not marked for general distribution.

special identification license plates issued under California Vehicle Code
Section 5007 or a distinguishing placard issued under California Vehicle
Code Section 22511.55 or 22511.59 shall be allowed to park in the First,
Eighth and Tenth Street ocean-front Municipal Parking Lots without being
required to pay parking fees. The disabled parking exemption is only for
vehicles under 25 feet in length and does not cover trailers, campers and or
fifth wheelers attached to the vehicle. If more than one parking space is
used the regular daily beach use charge must be paid for the second space
used.

D. Recreation Program Fees
The Recreation and Community Services Director shall establish fees for the
various recreation programs. These fees shall be based on type of program,
number of participants and instructors, officials, etc., required in the program and
shall be based on full cost recovery where feasible, including cost of
administrative services.

SECTION 9. UNSPECIFIED FEES
Whenever fees are charged for services provided by the City and no method for the
calculation is specified through this Resolution, other City Council resolutions, the Code
of the City of Seal Beach, or other state or federal rulings, the fees shall be the actual
cost, including the proportionate part of the salaries, wages or other compensation of any
deputy or employee, material and equipment costs and the cost of overhead at 32.40%
percent of the total.
SECTION 10. FINGERPRINT FEES

The charge for taking fingerprints is $76.00. This fee covers the cost of what the
Department of Justice charges for processing the fingerprints.

SECfION 13. STATEMENT OF RESOLUTIONS
Each and every provision of Resolution Number 5477 of the City Council of the City of
Seal Beach that establishes a rate or amount for a fee or charge that differs from the rate
or amount for that fee or charge as stated in this Resolution is hereby superseded. The
restatement of this Resolution of existing rates and amounts for previously imposed
taxes, fees and charges is for the purpose of l1dministrative convenience and is not
intended, and shall not be construed, as the imposition, extension, or increase of any such
tax, fee or charge.
SECTION 14. EFFECTIVE DATE
This Resolution shall be effective upon adoption except for any agreements, contracts,
plans and specifications submitted to the City prior to the date of adoption.

The following per space in-lieu parking fee is hereby established for uses on
commercially zoned parcels located within the Main Street Specific Plan Zone:
1. A $3,500.00 fee per deficient space for all such uses established on or
after September I, 1996. Such fee shall be calculated by multiplying the
number of parking spaces required, for the use that is not provided either
on-site or within three hundred feet (300') of the parcel on which the use
is situated, by $3,500.00.
2. An annual fee of $100.00 per deficient space for all such uses established
prior to September I, 1996 which are currently operating under an existing
land-use entitlement wherein as a condition of approval the applicant
agreed to participate in the City's in lieu parking program, except for those
uses governed by Section 3 hereinafter. Such annual fee shall be
calculated by multiplying the number of parking spaces required. for the
use that is not provided either on-site or within 300' of the parcel on which
the use is situated. by $100.00.
3. For all such uses established prior to September I, 1996 pursuant to a

SECTION 9. UNSPECIFIED FEES

Whenever fees are charged for services provided by the City and no method for the
calculation is specified through this Resolution, other City Council resolutions, the Code
of the CiD' of Seal Beach, or other state or federal rulings, the fees shall be the actual
cost, including the proportionate part of the salaries, wages or other compensation of any
deputy or employee, material and equipment costs and the cost of overhead at 32.40%
percent of the total.
SECTION 10. FINGERPRINT FEES
The charge for taking fingerprints is $76. This fee covers the cost of what the
Department of Justice charges for processing the fingerprints.

Per the City Municipal Code section 11-32 the business' license tax

Dear Councilmen:
As you know, I have been a strong advocate for parking control on the residential streets of OLD
TOWN. 1 have a strong feeling that the City council and its staff have very little interest in our
OLD TOWN residential parking problems and would like never to come to grips with them.
However, these problems are here and get worse every year. More and more cars are stored on
OLD TOWN streets as more and more 25' wide lots are developed with homes large enough to
contain large families and/or multiple families. Street parking for a home on a 25 'wide lot would
allow only one car on the street per household. Nearly every street in OLD TOWN is currently
completely full of legally parked cars every night. In addition there are countless illegally parked
cars across driveways and sidewalks and in alleys throughout our towo nightly.
A small gesture by the Council to give their staff and the residents of OLD TOWN some indication
that the Council is interested in the parking problems would be to set up increased parking permit
fees for fiscal year 2008/2009. The current permit fees are a joke: $10 to store a motor vehicle on a
city street in a one hour parking spot for one vear. That's for a proven resident; a stranger gets the
same privilege for $14 per year. You can park 24/7 in a beach parking lot for $100 dollars a year.
It is estimated that there are approximately 2500 residential units in OLD TOWN; during FY
200512006 the approximate permit numbers were as follows: 2250 - $10, 2600 -$14, 225 -$100,
and 150 nonresident beach parking permits @ $150. Total revenue was approximately $104,000.
These rates probably date back to the '70's. Would raising the rates encourage garage use? Could
they generate a source of income to provide curb and sidewalk maintenance? Could they pay for
increased parking law enforcement? Raising rates to possibly generate revenues approaching
$400,000 might be done as follows: $10 to $50, $14 to $75, $100 to $250, and $150 to $400
I ask the Council to consider this annroach to bew to tackle the narkin!! nroblem as they
make nlans for the bud!!et for the 2008-2009 fiscal vear. It will be necessary to set new rates
durin!! FY 200712008 since nermits are issued to be effective JuIv 1.2008.

Hi Lee,
My wife and I strongly support staff's proposal to increase the license fee for unaltered
dogs from $27 to $36.
However, if the stated purpose of this increase is to discourage breeding, an increase
of $9.00 would appear to be less than a "token" amount when divided by the typical
size of litter of puppies.
Staff's report states that the unaltered license fee is $60 in Long Beach. While still
inadequate to significantly increase the cost to breeders, an increase in our fee to this
level could be justified in that it at least provides equivalency with Long Beach.
Additionally, any increased revenue from this fee increase could help offset what the
City currently spends ($101,000) for animal control services from the City of Long
Beach.
