The City Council met in regular session at 7:00 p.m. in the City Council Chamber. Council
Member Landau led the Pledge of Allegiance.

City Clerk Harper indicated five (5) supplemental communications were received after the
posting of the agenda that were provided to City Council and made available to the public.

CITY ATTORNEY REPORT
City Attorney Ghirelli had no items to report.
CITY MANAGER REPORT
City Manager Ingram expressed her gratitude to the Council for allowing the closure of
City Hall for employees to participate in Staff Development Day. Leadership development
and team building was the focus of the day presented by Delwin Lampkin from the
California Joint Powers Insurance Authority at no additional cost to the City. She thanked
City employees, Deb Machen, Jennifer Robles, Lauren Barich, Dana Engstrom, Kelsey
Yonemura, Megan Coats, and Anthony Nguyen for their support in coordinating this
wonderful event.
City Manager Ingram provided calendar updates that included the upcoming Seal Beach
Tennis and Pickleball Center Ground Breaking event on Wednesday, October 11, 2023
at 4:30pm, the Seal Beach Historical Resources Foundation Open House to showcase
the new City Hall exhibit on Thursday, October 12. 2023 from 4:30pm - 6:30pm, the
Citizen-Council Parking Advisory Ad Hoc Committee meeting scheduled for Thursday,
October 12, 2023 at 5:30pm in the Council Chambers, and the Zoning Code Update
Community Outreach meeting to be held on Tuesday, October 17, 2023, at 6:00 pm, in
the Council Chambers.
COUNCIL COMMENTS
Council Member Steele indicated that he enjoyed the Huntington Beach Airshow; he
apologized to the residents who spoke during public comment regarding the noise from
the airshow that affected the residents and their dogs in the College Park East
neighborhood. He reported his attendance at the Leisure World Town Hall event, noting
it was well attended and thanked staff for their support. Additionally, he reported his
attendance at several Golden Rain Foundation meetings. Lastly, he asked those who
pray to join him in praying for those in the Middle East.
Council Member Kalmick reported that the Army Corp of Engineers has really stepped up
and started talking to the other agencies about the sand replenishment issue in Surfside.
He noted that there has been a request for a shallower donor site which means less
dredging and less money and are now waiting on a revised quote from the sole bidder
that would be in line with the budget for the project. Additionally, he reported his
attendance at the open house for Diversified Technical Systems (DTS), Inc., and gave an
overview of the business venture.
Council Member Landau reported her attendance at the Los Alamitos Unified School
District's State of the District Breakfast, noting how proud she is of the District and their
employees. Additionally, she inquired about the City of Seal Beach involvement with the
Huntington Beach Air Show, and City Manager Ingram responded that the Airshow is a
private event that takes place in Huntington Beach to which the City of Seal Beach has
no jurisdiction. Council Member Landau indicated that she attended the opening
ceremonies for the event and noted that she was overwhelmed with pride. Lastly, she
shared the details of a call received from a local business owner who expressed her
appreciation for the first responders who extinguished a small fire at the location. She
specifically thanked Police Officers Balderama and Garcia for their assistance.
Mayor Pro Tern Sustarsic indicated she wasn't invited to attend the Huntington Beach Air
Show noting she too received a complaint about the intensity of the noise and a possible
change in the flight path. She also reported her attendance at a Regional Military Affairs
Committee meeting, the Los Alamitos Unified School District State of the District
Breakfast, she participated in a West Section Assessment Group comprised of students,
teachers, and community members to discuss topics in hopes of the school earning
accreditations. Additionally, she attended an OC Sans Operations Committee meeting
and had the opportunity to attend A Day at the Doc on the Narissa noting they pride
themselves in being good stewards of the ocean.
Mayor Moore reported his attendance at the Leisure World Town Hall meeting, and
thanked Council Member Steele for moderating and staff for their professionalism.
Additionally, he reported his attendance at the Citizen-Council Parking Advisory Ad Hoc
Committee meeting, a Seal Beach Chamber of Commerce meeting, and the DTS Open
House tour. Lastly, he thanked City Manager Ingram for putting together Staff
Development Day and expressed his support for staff development.
COUNCIL ITEMS
A. Foil Board Presentation - Marine Safety Chief Joe Bailey (Requested by
Council Member Landau)
Marine Safety Chief Bailey provided a comprehensive overview of how Marine Safety
handles beach management and specifically what the Marine Safety Department is
doing to manage foil boards.
Council Members questions were answered. No action was required as this was a
presentation and discussion item only.
B. Discussion and Possible Action to Re-Order the Council Meeting Agenda to
Place "Approval of Agenda" After "Oral Communications" and to Amend Council
Policy 100-03 (Council Rules of Procedure) — Requested by Council Member Landau
- That the City Council discuss the agenda order and potential amendment to Council
Policy 100-03 (Council Rules of Procedure) as requested by Council Member Landau.
City Clerk Harper provided a brief background on the request by Council Member _
Landau regarding the possible re-order of the placement of the "Approval of Agenda"
and turned the item over to Council Member Landau for further discussion.
Council Member Landau explained the importance of why she is requesting the re-order
of the "Approval of Agenda." There was general discussion from Council Members and
questions were addressed by City Attorney Ghirelli.
Council Member Landau moved, second by Mayor Pro Tem Sustarsic to move forward,
with future meetings of the City Council, Commissions, Committees, and Boards, re-order
the agenda to allow oral communications before approval of the agenda or the option to
pull items from the consent calendar and that Council Policy 100-03 Rules of Procedure
be revised and memorialized by resolution.

CONSENT CALENDAR
Mayor Pro Tem Sustarsic moved, second by Council Member Landau, to approve the
recommended actions on the consent calendar.
C. Approval of the September 25, 2023 City Council Minutes - That the City Council
approve the minutes of the Regular City Council meeting held on September 25, 2023.
D. Demands on City Treasury (Fiscal Year 2024) October 9, 2023 - Ratification.
E. Approving and Authorizing Amendment No. 2 to the Professional Services
Agreement with Tetra Tech, Inc. for Bolsa Chica Water Well Improvements, CIP
WT1603 - That the City Council adopt Resolution 7456: 1. Approving Amendment No. 2
to the Professional Services Agreement dated February 24, 2020, as previously amended
by Amendment No. 1 dated May 23, 2022, between the City of Seal Beach and Tetra
Tech, Inc., extending the Agreement term to and including June 30, 2026, on the same
terms and conditions; and, 2. Authorizing and directing the City Manager to execute
Amendment No. 2 on behalf of the City.
F. Homeland Security Grant Program Agreement for Transfer or Purchase of
Equipment and Services or for Reimbursement of Training Costs for Fiscal Year
2022 Urban Area Security Initiative (UASI) - That the City Council adopt Resolution
7457 authorizing the City Manager and/or the Chief of Police to execute an agreement
and any other documents necessary on the City's behalf for the transfer or purchase of
equipment and services or for reimbursement of training costs for Fiscal Year 2022 Urban
Areas Security Initiative (UASI) Homeland Security Grant Program to take any further
actions necessary for the purpose of obtaining federal financial assistance provided by
the Department of Homeland Security and sub-granted through the State of California
and Anaheim and/or Santa Ana Police Departments in its capacity as the Core City for
the Anaheim/Santa Ana Urban Area Security Initiative.

NEW BUSINESS
G. Increase to Beach Lot Parking Rates and Authorization to Submit Coastal
Development Permit Application to California Coastal Commission for Beach Lot
Parking Rate Increases - That City Council adopt Resolution 7458: 1 . Authorizing the
submittal of the Coastal Development Permit application to increase beach parking lot
rates by 50 percent; and, 2. Directing staff to take all necessary actions to obtain approval
from the California Coastal Commission and implement the new rates upon
receiving a Coastal Development Permit.
Captain Nicholas provided a comprehensive background on the staff report and
addressed Council Member questions.
Council Member Landau moved, second by Council Member Kalmick to proceed with the
beach lot rate increase submission to the California Coastal Commission along with the
additional verbiage adding Section 3 to Resolution 7458 with the following "the new
parking rate shall not take effect until the City Council approves the effective date
following the Coastal Commission's approval."
