Mayor Pro Tem Sustarsic led the Pledge of Allegiance. Speaker: Catherine Showalter. Mayor Moore closed oral communications. Fifty-one supplemental items were received after the posting of the agenda that were distributed to City Council and made available to the public. APPROVAL OF AGENDA & WAIVER OF FULL READING OF RESOLUTIONS AND ORDINANCES lkMayor Pro Tem Sustarsic moved, second by Council Member Moore, to approve the agenda. AYES: Kalmick, Landau, Moore, Steele, Sustarsic NOES: None ABSENT: None ABSTAIN: None Motion carried CITY ATTORNEY REPORT City Attorney Ghirelli reported that the Council met in Closed Session regarding the one (1) item posted on the agenda. All five (5) Council Members were present, and no reportable action was taken. CITY MANAGER REPORT City Manager Ingram had no items to report. COUNCIL COMMENTS Council Member Kalmick reported that he met with staff from the City of Long Beach, a Council representative, and Seal Beach Public Works staff, to discuss the trash issue in the San Gabriel River. He noted that great strides were made, and a plan was developed. He indicated that he renewed his Cardiopulmonary Resuscitation (CPR) and Automated External Defibrillator (AED) certification with the Marine Safety Department and thanked staff for the opportunity. He reported that he met with Assemblywoman Diane Dixon and City staff to discuss some of the issues confronting Seal Beach where additional support is needed. Lastly, he reported his attendance at the October 17, 2023, Zoning Code Update Community meeting. Council Member Steele indicated his attendance at numerous Town Hall meetings in Leisure World, in addition to the Town Hall meeting conducted by City staff. He provided a brief update on the discussions that took place at the meetings. Additionally, he reported his attendance at the Zoning Code Update Community meeting, the West Orange County Water Board meeting, the Orange County Mosquito and Vector Control Board meeting.. the Historical Resources Foundation Open House and Ribbon Cutting Ceremony at City Hall, and the Seal Beach Tennis and Pickleball Center Groundbreaking Ceremony. Mayor Pro Tern Sustarsic reported her attendance at the Seal Beach Tennis and Pickleball Center Groundbreaking Ceremony and thanked staff for setting up the event. She reported her attendance at the Los Alamitos Unified School District/City of Seal Beach Working Group meeting and noted there was discussion regarding Joint Use Agreements. Additionally, she attended a meeting with Assemblywoman Diane Dixon, the Historical Resources Foundation Open House and Ribbon Cutting Ceremony at City Hall and thanked staff and the Foundation for setting up the event. Lastly, she reported her attendance at the Citizen-Council Parking Advisory Ad Hoc Committee meeting, the Zoning Code Update Community meeting, and a Rossmoor Community Services District traffic meeting regarding safety and parking. Council Member Landau reported her attendance at the Historical Resources Foundation Open House and Ribbon Cutting Ceremony at City Hall and thanked the Foundation for setting up the event; and, the Taste for Los Al fundraiser for the Los Alamitos Unified School District. Additionally, she attended the Zoning Code Update Community meeting and thanked staff and Lisa Wise Consulting for a great overview. She noted that her takeaway was that elections have consequences. Mayor Moore reported his attendance at the Seal Beach Tennis and Pickleball Center Groundbreaking Ceremony, the Fineberg Financial Management Ribbon Cutting event, and a meeting with Assemblywoman Diane Dixon, noting that the meeting was very positive. Additionally, he attended the Historical Resources Foundation Open House and Ribbon Cutting Ceremony at City Hall and thanked Deb Machen. He reported his attendance at the Citizen-Council Parking Advisory Ad Hoc Committee meeting and noted that the parking survey is available on the City's website and encouraged everyone to take the survey. Mayor Moore indicated that he attended the Taste for Los Al fundraiser, a Rossmoor Community Services District traffic meeting regarding safety and parking. Lastly, he requested clarification about the language contained in the Council Policy regarding the Redevelopment Agency. City Attorney Ghirelli provided information on the Redevelopment Agency. It was the consensus of the Council that the language regarding the Redevelopment Agency be removed from the Council Policy. COUNCIL ITEMS - None CONSENT CALENDAR Council Member Landau moved, second by Mayor Pro Tern Sustarsic, to approve the recommended actions on the consent calendar. A. Approval of the October 9, 2023 City Council Minutes - That the City Council approve the minutes of the Regular City Council meeting held on October 9, 2023. B. Demands on City Treasury (Fiscal Year 2024) October 23, 2023 - Ratification. C. Monthly Investment Report (September 30, 2023) - Receive and file. D. Authorize an Application for Grant Funds for the California Coastal Commission Local Coastal Program Planning Grant and Receipt of Grant Funds if Awarded - That the City Council adopt Resolution 7459: A. Approving the application for grant funds related to the California Coastal Commission Local Coastal Program Planning Grant to complete a Local Coastal Program for the City of Seal Beach; and, B. Directing staff to execute all necessary documents to receive and utilize the grant funding; and, C. Approving Budget Amendment #24-04-03 to increase revenues up to $125,800. E. Approving and Authorizing Amendment No. 1 to the Professional Services Agreement with Dixon Resources Unlimited for Parking Support Services -That the City Council adopt Resolution 7460: 1. Approving Amendment No. 1 to the Professional Services Agreement with Dixon Resources Unlimited dated June 14, 2021, to authorize I Additional Services and to increase the compensation by a one-time increase of$25,650 or $2,850 per month, to the current program management monthly flat-rate fee, for a total monthly cost of $6,600 for the remaining nine (9) months of the contract term and a total not-to-exceed amount of $160,650 for the three-year term; and, 2. Authorizing and directing the City Manager to execute Amendment No. 1 to the Agreement. F. Amendment to Council Policy 100-03 (Council Rules of Procedure) to Place "Approval of Agenda," Including Removal of Consent Calendar Items, After "Oral Communications" on All City Council, Commission, Committee, and Board Agendas - That the City Council adopt Resolution 7461 to amend Council Policy 100-03 (Council Rules of Procedure) by reordering the agenda to place "Approval of Agenda" and removal of consent calendar items after "Oral Communications" on all City Council. commission, committee, and board agendas. The vote below is for all the Consent Calendar Items: AYES: Kalmick, Moore, Sustarsic, Landau, Steele NOES: None ABSENT: None ABSTAIN: None Motion carried ITEMS REMOVED FROM THE CONSENT CALENDAR There were no items removed from the consent calendar. PUBLIC HEARING G. General Plan Amendment 19-1 to Change the Land Use Category of the Property at 328 13th Street from Residential High-Density to General Commercial and Zone Change 19-1 of the Property at 328 13th Street from RHD-20 to GC for the Redevelopment of an Existing Chevron Gas Station, to Change the Zone of 324th 13th Street from RHD-20 to RHD-33 in Accordance With SB 330, and to Consider a Negative Declaration for the Project Pursuant to the California Environmental Quality Act (CEQA) - That the City Council: 1. Conduct a public hearing to receive input and consider the Planning Commission's recommendation to approve General Plan Amendment 19-1 and Zone Change 19-1; and, 2. Approve Resolution 7462 amending the General Plan to change the land use category of 328 13th Street from Residential High Density to General Commercial; and, 3. Introduce, waive full reading, and read by title only Ordinance 1707 an Ordinance changing the zone of 328 13th Street from RHD- 20 to GC and changing the zone of 324th 13th Street from RHD-20 to RHD-33; and, 4. Adopt the Negative Declaration pursuant to CEQA based upon finding that there is no substantial evidence that the general plan amendment and zone change will result in significant adverse environmental impacts. Planning Manager Shaun Temple provided a comprehensive background on the staff report. Each Council Member had an opportunity to ask questions of staff and the applicant. Council Members' questions and concerns were addressed by staff and the applicant. Mayor Moore opened the public hearing. Speakers: Carl Hoy (applicant on behalf of G&M Oil), Jeanette Stockon, Louise DeBose, Ellery Deaton, Mike Buhbe, Beth Barinek, Susan Perrell, Josh Haynie, Matthew Terry, Tory Jones, Joyce Parque, Benny Wrap, Karen Polik, Theresa Miller, and the Applicant provided closing remarks. Mayor Moore asked the Applicant whether he had and further comments and then closed the public hearing. The Council Members continued with the discussion and deliberation. Council Member Landau moved, second by Mayor Moore to deny the General Plan Amendment to change the land use category of 328 13th Street from Residential High Density to General Commercial; and, to deny changing the zone of 328 13th Street from RHD-20 to GC and changing the zone of 324th 13th Street from RHD-20 to RHD-33. Staff was directed to return with a resolution at the next meeting memorializing the Council's decision.
