The City Council met in regular session at 7:02 p.m. in the City Council Chamber. Council
Member Kalmick led the Pledge of Allegiance.

Council Member Kalmick moved, second by Mayor Pro Tern Sustarsic to approve the
absence of Council Member Steele.

PUBLIC COMMUNICATIONS
Mayor Moore opened oral communications. Speaker: Jo8n. Mayor Moore closed oral
communications.
Four (4) supplemental items were received after the posting of the agenda that were
distributed to the City Council and made available to the public.
APPROVAL OF AGENDA & WAIVER OF FULL READING OF RESOLUTIONS AND
ORDINANCES
Council Member Kalmick moved, second by Mayor Pro Tern Sustarsic to approve the
agenda.

CITY ATTORNEY REPORT
City Attorney Ghirelli reported that the Council met in Closed Session regarding the three
(3) items posted on the agenda. Four (4) Council Members were present, and no
reportable action was taken.
CITY MANAGER REPORT
City Manager Ingram provided a few calendar updates including the final Parking Town
Hall meeting on November 14, 2023, at 5:30 pm and indicated that the meeting will be a
hybrid meeting. She reminded the community to take the parking survey prior to the
deadline, November 17, 2023, at 9:00 pm. City Manager Ingram announced that the next
Citizen-Council Parking Advisory Ad Hoc Committee meeting will be held on
November 29, 2023, at 5:30pm and encouraged the community to attend this public
meeting.
City Manager Ingram noted that it is imperative to be deliberate and diligent in the timely
and ongoing updates to the City's water and sewer utility rates. She noted that the City
Council has tentatively scheduled a public hearing to consider rate adjustments for the
first meeting in February 2024. City Manager Ingram provided additional details and
important outreach dates that are necessary, prior to the public hearing.
City Manager Ingram provided additional calendar updates on the Tree Lighting
Ceremony to be held on Saturday, November 18, 2023, from 4-7pm at Eisenhower Park,
the Christmas Parade to be held on Friday, December 1, 2023, at 7pm on Main Street,
and Breakfast with Santa scheduled for Saturday, December 9, 2023, from 9-11 am at the
Marina Community Center.
In closing, she wished the City Council, staff, and community a happy and safe
Thanksgiving Holiday.
COUNCIL COMMENTS
Council Member Landau thanked the Seal Beach Police Department for hosting the first
post COVID-19 Neighbor-4-Neightbor meeting and noted that it was well attended by
residents. She also thanked Vicky Davio for spearheading the event and the Lions Club
for providing hot dogs, chips, and drinks.
Council Member Landau congratulated the Public Works Department on winning the
Trunk of Treat contest and noted that she was impressed with all the themed trunks at
the event. Lastly, she reported her attendance at the Los Alamitos High School Jazz
Band fundraiser at the Gaslamp and invited the community to the Thanksgiving Dinner at
St. Anne's Church at 11am on Thanksgiving Day.
Council Member Kalmick reported that he attended a Regional Council meeting for
Southern California Association of Governments, a Los Cerritos Wetland Authority
meeting, noting that funding was received for the planning, permitting, and 54% of the
restoration costs. He reported his attendance at an Orange County Fire Authority (OCFA)
Human Resources Sub-Committee meeting noting OCFA is doing a tremendous job in
controlling workers' compensation cases. Lastly, he reported his attendance at the
Veterans' Day Ceremony at McGaugh Elementary School and Eisenhower Park, and a
Ribbon Cutting Ceremony at a new dance studio on Main Street - Dance Around the
Clock.
Mayor Pro Tern Sustarsic reported her attendance at a Regional Military Affairs
Committee meeting, a Governors Military Council quarterly meeting in the city of Cypress,
an Orange County Sanitation District Board meeting, an Orange County Sanitation
District Operations Committee meeting, and an Orange County Sanitation District State
of the District meeting. Additionally, she attended two Parking Town Hall meetings, a City
Selection Committee meeting on behalf of the Mayor, a College Park East Neighborhood
Association annual meeting, the McGaugh Elementary School Veterans' Day Flag
Ceremony, a California Federation of Women's Club District Council meeting, and the
Veterans' Day Ceremony at Eisenhower Park. Lastly, she indicated she attended the
City's Trunk or Treat event and congratulated the Public Works Department on winning
the annual department contest.
Mayor Moore reported his attendance at the Veterans' Day Ceremony, the Driftwood, the
Dance Around the Clock and Let's Go Paint ribbon cutting ceremonies. He reported that
he attended two (2) Parking Town Hall meetings and encouraged community participation
at the next Citizen-Council Parking Advisory Ad Hoc Committee meeting and to take the
Parking Survey. Additionally, he reported his attendance at the Trunk or Treat event on
Main Street and congratulated the Public Works Department on winning the annual
department contest. Lastly, he wished the City Council, City staff, and the community a
wonderful Thanksgiving.

CONSENT CALENDAR
Council Member Landau moved, second by Mayor Pro Tern Sustarsic, to approve the
recommended actions on the consent calendar.
A. Approval of the October 23, 2023 City Council Minutes - That the City Council
approve the minutes of the Closed Session and Regular City Council
meetings held on October 23, 2023.
B. Demands on City Treasury (Fiscal Year 2024) November 13, 2023 - Ratification.
C. Report of City Manager and Department Heads Authorized Contracts
- That the City Council receive and file the report.
D. Homeland Security Grant Program Agreement for Transfer or Purchase of
Equipment and Services or for Reimbursement of Operation Costs for Fiscal Year
2022 Operation Stonegarden - That the City Council adopt Resolution 7463: 1.
Authorizing the City Manager to execute an agreement on the City's behalf for transfer or
purchase equipment and services for reimbursement of operating costs for Fiscal Year
2022; and, 2. Authorizing any further actions necessary for the purpose of obtaining
federal financial assistance provided by the Department of Homeland Security - Federal
Emergency Management Agency (FEMA) and sub-granted through the Riverside
Sheriffs Department in connection with the Operation Stonegarden
(OPSG) Homeland Security Grant Program
E. Resolution to Deny General Plan Amendment (GPA) 19-1 That Would Have
Changed the Land Use Category of the Property at 328 13th Street from Residential
High-Density to General Commercial and to Deny Zone Change (ZC) 19-1 That
Would Have Changed the Zone of the Property Located at 328 13th Street from
RHD-20 to GC and the Zone of the Property Located at 324 13th Street from RHD-
20 to RHD-33 - That the City Council adopt Resolution 7464 to Deny GPA 19-1 That
Would Have Changed the Land Use Category of the Property at 328 13th Street from
Residential High-Density to General Commercial, and to Deny ZC 19-1 That Would Have
Changed the Zone of the Property Located at 328 13th Street from RHD-20 to GC and
the Zone of the Property Located at 324 13th Street from RHD-20 to RHD-33.
F. Ratifying the Declaration of Emergency, Approval of Emergency Seal Beach
Boulevard Waterline Repair and Dispensing with Public Bidding Requirements, and
Notice of Completion, and Authorization to Approve Payment for the Seal Beach
Boulevard Waterline Repair, and Approving and Authorizing Amendment No. 1 to
Professional Maintenance Agreement with Valverde Construction, Inc. for On-Call
Emergency and Unexpected Task Utility Maintenance and Repair Services - That
the City Council adopt Resolution 7465 1. Declaring the Seal Beach Boulevard Waterline
Repair, CIP EM2402, was necessary for the immediate preservation of life, health, and
property of the City, and therefore ratifying the declaration by the Public Works Director
that the Seal Beach Boulevard. Waterline Repair, CIP EM2402, was of urgent necessity
for the immediate preservation of life, health and property; and, 2. That the City Council
adopt Resolution 7465: 1. Declaring that the Seal Beach Boulevard Waterline Repair, CIP
EM2402, was necessary for the immediate preservation of life, health and property of the
City, and therefore ratifying the declaration by the Public Works Director that the Seal
Beach Boulevard Waterline Repair, CIP EM2402, was of urgent necessity for the
immediate preservation of life, health and property; and, 2. Authorizing the City Manager
to execute a purchase order with Valverde Construction, Inc. for the emergency Seal
Beach Boulevard Waterline Repair, CIP EM2402, in the amount of$256,456.15 under an
existing on-call agreement with Valverde Construction, Inc. without advertising for bids;
and, 3. Accepting the emergency work to the City's public water system, CIP EM2402, by
Valverde Construction, Inc. in the amount of$256,456.15; and, 4. Directing the City Clerk
to file a "Notice of Completion" with the Orange County Clerk-Recorder within 15 days of
the date of approval of the resolution and to release retention 35 days after the recordation
of the Notice of Completion contingent upon no claims being filed on the Project; and, 5.
Approving Budget Amendment BA #24-05-02 in the amount of $260,000.00; and, 6.
Approving Amendment No. 1 to the Professional Maintenance Agreement with Valverde
Construction, Inc. to increase their compensation by $450,000 for additional on-call
emergency and unexpected task utility maintenance and repair services for a revised not-
to-exceed total contract amount of $750,000 for the original three-year term; and, 7.
Authorizing the City Manager to execute Amendment No. 1.

City Attorney Ghirelli clarified for the benefit of the public that the Council's decision
Lregarding Item E is now final and there will be no appeal process.

Mayor Moore adjourned the City Council meeting at 8:31 p.m. to Monday, December 11,
2023, at 5:30 p.m. to meet in Closed Session if deemed necessary. He noted that the
November 27, 2023, City Council meeting has been can- :Iled.
