HomeMy WebLinkAboutCC Res 7470 2023-12-11 RESOLUTION 7470 A RESOLUTION OF THE SEAL BEACH CITY COUNCIL AWARDING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A PUBLIC WORKS AGREEMENT WITH SEQUEL CONTRACTORS, INC. FOR THE LAMPSON AVENUE BIKE LANE GAP CLOSURE PROJECT, CIP ST1811; AND APPROVING BUDGET AMENDMENT BA #24-06-01 TO ALLOCATE $740,000 WHEREAS, the City was awarded an Active Transportation Program grant for the Lampson Avenue Bike Lane Gap Closure Project ("Project"), to install a bike lane along the eastbound and westbound directions of Lampson Avenue to eliminate the gap between Seal Beach Boulevard and Basswood Street; and, WHEREAS, the City has budgeted the Lampson Avenue Bike Lane Gap Closure Project, ST1811, ("Project") in the Capital Improvement Program; and, WHEREAS, on August 10, 2023, the City solicited bids for the Project, and on September 7, 2023, the City Clerk's office received two (2) bids, but because the apparent low bid and second low bid did not meet stipulated federal Disadvantaged Business Enterprise ("DBE") requirements the City Council rejected all bids and directed staff to re-advertise the Project to solicit responsive and responsible bids; and, WHEREAS, on September 28, 2023, the City issued a new solicitation for bids for the Project; and, WHEREAS, the Notice Inviting Bids requested pricing for the "Total Base Bid" and pricing for optional additive bid items for work the City may request after bid opening, and provided that the bid will be awarded based on the lowest responsible Total Base Bid, and without consideration of the prices on the additive items; and, WHEREAS, on October 26, 2023, the City Clerk's office received seven (7) bids in response to the solicitation for bids, and Sequel Contractors, Inc. ("Sequel") submitted the apparent lowest responsible bid in the amount of $2,280,420; and, WHEREAS, the City elects to include Additive Bid Items#59 and #60 in the amount of $52,000, for a Total Bid Amount of $2,332,420; and, WHEREAS, upon reviewing the Notice Inviting Bids and Instructions to Bidders, the bids submitted for the work to be performed pursuant to the Agreement and the plans and specifications, the City Council finds that Sequel is a qualified firm to perform the Project. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY RESOLVE: SECTION 1. The City Council hereby approves the plans, specifications, and contract documents for the Project. SECTION 2. Based on the recitals set forth above, the City Council hereby awards a public works agreement to Sequel Contractors, Inc. for the Project in a total not-to-exceed amount of $2,332,420, including the Total Base Bid of $2,280,420 and Additive Bid Items #59 and 60; and rejects all other bids. SECTION 3. The City Council hereby authorizes and directs the City Manager to execute the public works agreement with Sequel Contractors, Inc. on behalf of the City. SECTION 4. The City Council hereby authorizes the City Manager to approve payments for additional work requests in connection with the Project in the cumulative not-to-exceed amount of $200,000. SECTION 5. The City Council hereby authorizes the City Manager to approve payments for inspection and testing in connection with the Project in the cumulative not-to-exceed amount of $100,000. SECTION 6.
