CUP Analysis – Proximity to Residences
1.SBMC Section 11 .4.05.035.B.24(a) provides that service station
convenience markets comply with City Council Policy 600-1.
2.Establishments required to be 100 feet away from residential areas OR
CUP may be approved for alcohol related uses where the applicant
establishes that the operation of the business would not interfere with the
quiet enjoyment of property by residents.
•Nearest residential - 50 feet from gated condominium complex.
3.The sale of beer and wine would be incidental to the current operations and
is not expected to produce any impacts.
4.Seal Beach Police Department has no objections.
5.Use serves as a public convenience.
Variance Analysis – Proximity to Parks
1.SBMC 11 .4.05.035.B.24(c) the sale of beer/wine from an automobile
service station shall not take place within 1,000 feet of a park, religious
institution, or school unless variance findings can be made.
2.SBMC 11 .5.20.005.C. authorizes the PC to grant a Variance to adjust
performance standards subject to the following: a) shall not constitute a
grant of special privileges; b) shall not authorize a use or activity not
expressly authorized by the zone.
3.ABC Data indicates 8 out of 12 vendors located within 1000 feet of a park.
4.CG zone authorizes off-site sale of beer/wine through approval of a CUP.
5.Use would serve as a public convenience.
6.Use consistent with the General Plan Service Commercial Land Uses.

Recommended Action
•Staff recommends that the Planning Commission
adopt Resolution No. 23-15 approving CUP 23-4
and adopt Resolution No. 23-16 approving
Variance 23-1.
