A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH
APPROVING A PROFESSIONAL SERVICES AGREEMENT WITH HF&H
CONSULTANTS, LLC TO PROVIDE CONSULTING SERVICES FOR THE
IMPLEMENTATION OF SENATE BILL 1383 (ORGANIC WASTE) AND
RELATED CONTRACTING ASSISTANCE WITH THE CITY'S WASTE HAULER
WHEREAS, the City Council of the City of Seal Beach deems it desirable
and necessary to fulfill the requirements of Senate Bill ("SB") 1383, a state
unfunded mandate that calls for CalRecycle to develop regulations to
reduce organics in landfills as a source of methane; and,
WHEREAS, these regulations, adopted in 2020 ("SB 1383 Regulations"), place
requirements on multiple entities including the City; single-family residential
households; commercial businesses, including multifamily property owners with
five or more dwelling units; commercial edible food generators; haulers, including
self-haulers; food recovery organizations; and food recovery services to support
achievement of statewide organic waste disposal reductions targets; and,
WHEREAS, the City Council of the City of Seal Beach deems it desirable and
necessary to negotiate services with Republic Services to implement SB 1383 and
update the solid waste and recycling franchise agreement; and,
WHEREAS, HF&H Consultants, LLC, possesses the specialized ability, has the
pertinent experience, and has familiarity with the City's solid waste goals and
obligations that will assist the City in achieving implementation of an organic waste
recycling program which will meet the directives outlined under SB 1383; and,
WHEREAS, HF&H will evaluate the City's waste hauler's (Republic Services)
proposed program to comply with SB 1383, negotiate rates and terms of a
compliant program, prepare an SB 1383 amendment, and monitor information
related to organic waste to support the City's implementation of SB 1383.
NOW, THEREFORE, the Seal Beach City Council does resolve, declare,
determine, and order as follows:
SECTION 1. The City Council hereby awards a Professional Services Agreement
(Agreement) to HF&H Consultants, LLC, in the not-to-exceed amount of$115,000
to provide professional services for SB 1383 Contracting Assistance.
SECTION 2. The City Council hereby authorizes and directs the City Manager to
execute the Agreement on behalf of the City pursuant to the HF&H Proposal dated
April 23, 2024.

regular meeting held on the 10th day of June 2024 by the following vote:
