No waiver of any breach, any failure of a condition, or any right or remedy under this Agreement shall be (i) effective unless it is in writing and signed by the Party making the waiver, (ii) deemed to be a waiver of, or consent to, any other breach, failure of a condition, or right or remedy, or (iii) deemed to constitute a continuing waiver unless the writing expressly so states. 29.0 Prohibited Interests; Conflict of Interest 29.1. Acceptance of payment shall be any negotiation of City's check or the failure to make a written extra compensation claim within ten calendar days of the receipt of that check. However, approval or payment by City shall not constitute, nor be deemed, a release of the responsibility and liability of Consultant, its employees, subcontractors, agents, and servants for the accuracy and competency of the information provided and/or work performed; nor shall such approval or payment be deemed to be an assumption of such responsibility or liability by City for any defect or error in the work prepared by Consultant, its employees, subcontractors, agents and servants. 31.0 Corrections In addition to the indemnification obligations set forth above, Consultant shall correct, at its expense, all errors in the work which may be disclosed during City's review of Consultant's report or plans. WORK APPROACH On call contracts provide the City an opportunity for our DEA team to work as an extension of the staff and build a relationship as a teaming partner. DEA has contracted with numerous Southern California municipalities for on-call services contracts. We have found the working relationships we build with city staff are beneficial to meeting schedules and agency requirements with a minimum amount of time spent on contracting issues. Because we regularly monitor project requirements and adjust project scheduling weekly, we can maximize availability of our key project staff as needs arise. DEA is committed to the City of Seal Beach in providing our project deliverables that address the City's needs as identified during the initial scope preparation. Our approach for each specific task order proposal would be to first identify the appropriate team members to successfully accomplish the project. Each project is unique and as such we will develop a tailored scope of services / approach to satisfy the requirements. The approach would be to develop the project in close coordination with the City and the involved stakeholders. David Evans and Associates,Inc. We recognize that this process is an extension of the proposal process, not directly billable to the project, and sometimes competitive with other on-call consultants. It is of high importance to both the City and DEA to develop the scope, fee, and schedule for task orders based on a clear understanding of the City's needs and with clear expectations of the process and deliverables. DEA appreciates the opportunity to meet with staff in advance of this to obtain this information and ask for clarifications if needed. In this way, we will be able to propose an effective approach and complete task orders that achieve precisely what the City wants to receive. COST PROPOSAL °D The City's project manager will issue a task order solicitation to DEA's project manager, Steven Anderson, together with schedule expectations and other related project information. Steven will work with the City's project manager to complete the necessary task order documentation as follows: • Project objective • Scope of services • Deliverable products • Schedule of milestones and deliverables • Specific staffing requirements • Labor rates, hours, and budget (not-to-exceed) • Other direct expenses (if applicable) David Evans and Associates,Inc. The kick-off meeting establishes the stakeholders with input at each phase of the project. Communication plans can determine the frequency of meetings, how to correspond and who holds the lines of communication. In addition, this can include document control aspects for sending and receiving information between teams. (' ) LOMMITMENT Or J +Hi During task order development, DEA's management team will commit the specific technical team required to complete the project. Our southern California team uses a forward-looking scheduling process, specifically designed for responding to on-call work, and to assign staff for future work. The system is such that we are able to lock people into projects well in advance, thereby eliminating the potential for over- commitments, and assuring that the City's schedule expectations will be met. NOTICE-TO-PROCEED The task order and cost proposal will be submitted to the City's project manager, who will either initiate further discussion, or give approval to proceed. It is our intent to do a thorough job the first time so the needs for cycles of discussion/negotiation can be minimized. 0 TASK ORDER MANAGEMENT , Upon receipt of a task order notice-to-proceed, Steven will become the City's point-of-contact for project execution and will work directly with the City's project manager throughout the project execution phase. He will manage the activities of DEA's technical staff and be the principal technical expert to guide the project.0y_ MONITOR!"'' "7 7GRESS DEA project managers are required to carefully monitor the progress of their projects to assure that staff resources are available as required and to make sure that the City's overall budget and schedule expectations are being met or exceeded. Each week Steven holds a weekly workload meeting to review upcoming work, deadlines, and progress to date. At least once per week, he reviews budget status reports of each task on his projects based on the most current timesheet postings. Any task nearing 80% of budget is flagged for review with the task lead to make sure the remaining work can be completed within the budget. In this way, issues are identified early and the task can be brought to the earned value to date via various project management tactics such as parallel design for non-critical path elements, work-around, and extending resources from other offices. To provide quality control and consistency, Steven will also oversee monthly progress reporting and invoicing functions. ABILITY TO PERFORM SERVICES DEA understands that the City requires a design team with the technical ability, resources, and knowledge of project delivery processes to be available on an as-needed basis. DEA understands that this contract will require strict adherence to established City and Caltrans standards. Our recent experience and approach to meeting client's expectations has been to meet with the client to discuss the full parameters and expectations of the task orders to be issued. DEA has been providing engineering services throughout the years to many transportation agencies. This service includes the drainage design, civil design, traffic signals, signing and striping, erosion control plans, and many types of reports including alternative evaluations. This experience and understanding of the preparation of these documents will support our reviews while performing plan/report checking functions by providing the insight on the side of the preparer and reviewer. Our project manager, Steven Anderson, is a certified Project Management Professional and has delivered dozens of projects to successful completion for projects, fully understanding the life cycle of project delivery for public works clients. DEA has experience in design services, as evidenced by the resumes and project descriptions highlighted in this proposal. In addition to this experience. DEA has implemented a firm wide program of total quality management for quality deliverables to meet our clients' needs and project goals. Final products receive an in-house peer review that follows a checklist format, considering aspects of the project as well as presentation and graphics. This provides a crosscheck that our standards of quality are applied uniformly to our clients' projects. David Evans and Associates,Inc. We have staff available to assist in this effort. Services for this contract will be performed from our Tustin office, with assistance from our Ontario, Temecula, Victorville and Los Angeles offices. With our experienced project team, and past project experience, and our location, we feel we have the expertise to execute this contract. DEA assembles a qualified project team based on the anticipated needs of each project. DEA staffs assigned to task orders within the contract have the experience and capabilities to provide the City with superior services. Our management structure outlines the appropriate chain of command and reporting responsibilities. This organization and structure has long been very important for our clients, the project goals, and us. DEA has a team management approach, which provides flexibility and innovative thinking, while maintaining strict adherence to the project's goals and schedule. At DEA, organization is of the utmost importance, matching each project with the correct resources for work tasks to be carried out on schedule and within budget. The management plan for each project is adjusted and refined once the project is initiated. The management plan for each project is adjusted and refined once the project is initiated. DEA's basic elements of project management are: • Assignment of personnel hours. • Adjusting project plan and schedule as required with input of other senior managers and team. • Providing a clear understanding of individual roles and responsibilities in meeting the project's goals. • Having a commitment from the entire team in achieving these goals. One of the fundamentals of engineering is redundancy and DEA has inserted this same fundamental in our team. In addition to our qualified project manager, the DEA team has built in redundancy with the many licensed engineers and support staff to complete one or many simultaneous tasks in a timely manner. wi COMMITMENT TO QUALITY CONTROL • DEA's Quality Management Plan is an essential element in our approach to deliver a project Rsthat meets or exceeds City requirements. A Quality Assurance /Quality Control manager is appointed at the beginning of every task order project and has overall responsibility and authority to implement the QA program, including resource and training needs, approving the Quality Management Plan, documentation, and monitoring progress. The terms Quality Assurance and Quality Control are often used interchangeably, but DEA clearly distinguishes these concepts as follows. QUALITY ASSURANCE Quality Assurance (QA) is an overall program that establishes project related policies, procedures, standards, guidelines, and systems aimed at producing an acceptable level of quality in our products. These are things we do continuously before, during, and upon completion of specific project deliverables to make sure we understand what is required of our deliverables and that those requirements are met. But most importantly it's the things we do during the process like setting and communicating standards and verifying City requirements, among others. The goal is to do things right, the first time, by verifying that the project requirements are clearly defined and communicated. David Evans and Associates, Inc. The objective of DEA's QC program is to detect and eliminate major defects in project work products and limit minor defects consistent with commonly accepted standards. This is accomplished through the application of continuous checks and comprehensive reviews prior to each delivery milestone adopting the 30-60-90 percent review. We believe that this procedure will increase quality control, attention to project controls, and target budgets. The QC program is project specific (technical review, accuracy review, interdisciplinary review, constructability review) and is implemented under the authority of the QA/QC manager. I MacArthur Boulevard and University Drive - Pavement Rehabilitation, Newport Beach, California - ' The City of Newport Beach desired to improve the wearing surface of MacArthur Boulevard and _ • ---r- University Drive and identified the project through their Pavement Management Program indications. The - 1111.0 rehabilitation extended on MacArthur Boulevard from Ford Road / Bonita Canyon Drive to the SR-73, and on University Drive from Jamboree Road to the east side of the SR-73 northbound ramps. MacArthur Boulevard is a heavily traveled eight-lane street in this section and University Drive is a four-lane street leading to the University of California, Irvine. The City also desired to reconstruct deteriorated concrete flatwork, upgrade pedestrian facilities to ADA and restripe using the new 6" stripes with a slightly changed cross section. After preparation of the Pavement Investigation Reports, the agreed upon pavement rehabilitation strategy on MacArthur Boulevard was 2" asphalt rubber hot mix (ARHM) over 4" base for a 10-15 year service life for the section from Bison to SR-73 and 2"ARHM over 1.5" base from Ford Road to Bison. On University Drive, the original approach was to include a test pilot program using fiber for a portion of the length, however, that was revised to traditional overlay due to cost. Most of the section will be 2"ARHM over 1.5" base providing a 20-year design life. Portions of this section were completely reconstructed as well. DEA prepared typical cross sections, 50' cross sections, plan and profile and striping. We also prepared traffic handling and staging plans. Signs were also inventoried, and plans were prepared for new signs with greater retroreflectivity. DEA coordinated with Caltrans for an encroachment permit for the stage construction within the SR-73. CORRIDOR and bicyclists. DEA, as part of a multidisciplinary R i _ team, developed policies for landscape/ urban design, • t ; infrastructure, transportation, and parking. Policy Analysis: Prior to preparing development standards that implement the policies, DEA analyzed the implications and potential impacts of the policies. Parking policies, for example, included a maximum, rather than a minimum ratio, and emphasized shared parking in municipal lots and on-street so that the historic long narrow lots could feasibly redevelop without parking and be compliant with zoning. DEA analyzed supply and demand and different shared parking scenarios to test the policies and use the results of the analysis to develop and refine development standards. Complete Streets Solutions: DEA analyzed Complete Street concepts Highway 18 that DEA created as part Apple Valley Village SR-18 Corridor/Complete Street Enhancement Plan. The selected concept needed to implement the policy to remove the existing barrier to pedestrians created by the 200-feet of pavement with protected crossings spaced '/-mile apart and the policy to maximize on-street parking to serve the commercial retail lining both sides of Highway 18 that cannot provide off-street parking. The solution was to install multiple roundabouts within the corridor with enhanced pedestrian facilities. The roundabouts narrowed the required pavement enough to provide a parallel Class I shared-use path on one side, a raised landscape median, and widen the frontage roads to allow angled parking this implementing the policy maximizing on-street parking. ,; Pedestrian Sidewalk Inventory Plan, San Bernardino County, California , , DEA was selected by SBCTA to develop a ` f TP I comprehensive pedestrian sidewalk connectivity plan x ar throughout San Bernardino County. The Plan reduces current duplicative and inefficient efforts by multiple planners at the regional and city level. It takes advantage of economies of scale at the county level by creating a plan that captures consistent, countywide pedestrian infrastructure data and outlines a process for agencies to use for future pedestrian planning. The project contained three major components: existing conditions, sidewalk inventory, and analysis tools. The existing conditions phase includes a review of existing transportation planning documents and available spatial data. The sidewalk inventory was collected primarily from aerial imagery—augmented with field visits—for both sides of approximately 7,000 paved miles of roadway within the county. The hydrology study prepared for the Bastanchury Road concept was extended to include the drainage area, east of Rose Drive and south of Bastanchury Road, draining to the El Cajon Avenue storm drain to verify to feasibility of adding the additional runoff to the existing storm drain. DEA prepared the topographic survey, utility research, a drainage report, and a hydrology study for two concepts, PS&E, and coordination with utility companies and local agencies. 1-405 Drainage Review, Orange County, California OC 405 Partners were in charge of widening the 1-405 from Costa Mesa to the Bolsa Chica area in Orange County. DEA was hired to review the drainage design to evaluate options to reduce construction cost for the proposed drainage system. Hydraulic calculations were prepared to analyze the potential reduction of proposed inlets, in the median of an "M" section, by increasing the median shoulder from 1.5% to 3.0%. The analysis revealed large reduction of required inlet and associated pipes. DEA also provided independent review of the calculations and assumptions used for the sizing of a proposed large drainage system and it connection to the Anaheim-Barber Channel, an existing Orange County Flood Control District facility. Mitchell Avenue Storm Drain Improvements, Tustin, California During the City of Tustin's routine inspection of the existing storm drain system, they found the existing CMP drain had extensive corrosion and portions of the pipe had rusted away. With an imminent potential for the pipe to collapse, block drainage and impact the street and parkway above, the City hired DEA to determine the best course of action and then prepare storm drain improvement plans for that option. The project consisted of rehabilitating the existing CMP arch that has been severely deteriated. The project scope included preparation of a drainage report detailing existing drainage patterns and system capabilities, including hydrology calculations per the Orange County Hydrology Manual to assess the operation of the existing CMP Arch storm drain and the evaluation of proposed improvements, preliminary drainage alternatives and cost estimates. Determined facilities required to meet current drainage system requirements including inlet locations and pipe sizes. DEA analyzed several alternatives to rehabilitate or replace the storm drain.
