ACCEPTANCE OF ZOETER SCHOOL DEMOLmON AND
ZOETER PARK IMPROVEMENTS, PROJECTS NO. 50223
AND 50224
SUMMARY OF REQUEST:
The proposed City Council Action will adopt Resolution No. _ to formally accept the
completion of the Zoeter School Demolition, Project No. 50223 and Resolution No. _ to
formally accept the completion of the Zoeter Park Improvements, Project No. 50224.
e BACKGROUND:
The City recently purchased land and improvements located at 343 and 357 12th Street, between
Pacific Coast Highway and Landing Avenue. The site, formerly a portion of the Old Zoeter
School facilities, was predominantly vacant. Sun N Fun, a cooperative preschool program,
leases one classroom, a restroom and an outdoor play area. The remaining eleven classrooms,
bathroom, hallways, and outdoor areas were vacant.
The site was in very poor condition and rapidly declining. At the November 13, 2006 City
Council Meeting, the City Council adopted a resolution declaring the site a public nuisance and
authorized the City Manager to execute contracts to abate said nuisance.
Staff immediately proceeded with the following actions to abate the nuisance:

1. Relocate the Sun N Fun Cooperative Preschool: Staff relocated the Sun N Fun
Cooperative Preschool to the Girl Scouts House located at the comer of 7th Street and
Electric Avenue.
Environmental Abatement: Remove hazardous materials from the building and site.
Obtain environmental clearance for the site.
Site Demolition: Demolish the site and disconnect utilities.
Construct Imorovements to Rem";";",!: Structure: The remaining structure was
improved for future use.
Return Sun N Fun Preschool: Assist the return of Sun N Fun Preschool.

Staff was able to successfully negotiate a deal with the Girl Scouts Council of Orange County to
temporarily relocate the Sun N Fun preschool to the 7th Street location. The deal was struck
quickly and the preschool was relocated in December.
Resource Environmental, Inc. was the low bidder and most qualified contractor for this project.
This :firm specializes in the abatement and demolition of many hazardous materials, including
asbestos and lead based paint present at the Old Zoeter School. Additionally, a hazardous
materials inspector and testing agency, Pacific Environmental was retained to perform all
necessary environmental tests in accordance with state law.
Resource Environmental Inc. started the demolition and abatement in December of 2006, and
finished the bulk of that work by early April. In May the existing Zoeter Building was
remodeled. The remodel included various structural, utility, and aesthetic work items necessary
to re-open the facility. Once the abatement and demolition were complete Bennett Landscaping
was contracted to construct landscaping improvements to the site for beautification and
permanent erosion control.
The City recently held a ribbon-cutting ceremony on June 11th to commemorate the re-opening
of the Sun N Fun preschool and to dedicate the remaining site as Zoeter Park. In accordance
with the plans and specifications, the contractor has completed the aforementioned project for a
final contract amount of $596,224.
FISCAL IMPACT:
Funds are available within the 5-year Capital Improvement Program for design construction, and
construction management, adopted by the Council. $800,000 has been programmed under
Project No. 50223 from Redevelopment Agency (RDA) Funds. The net cost for Project No.
50223 is $730,375. $69,625 will be returned to RDA funds. $200,000 has been programmed
under Project No. 50224 from Quimby park and recreational fees. The net cost for Project No.
50224 is $79,941. $120,059 will be returned to Quimby park and recreational fees.
RECOMMENDATION:
It is recommended that the City Council:
1. By resolution, determine the work for Zoeter School Abatement and Demolition
Project No. 50223 has been completed in accordance with the contract documents and
declare the work to be accepted and the total amount of the contract is in the sum of
$596,224.
2. By resolution, determine the work for Zoeter Park Improvements Project No. 50224
has been completed in accordance with the contract documents and declare the work
to be accepted and the total amount of the contract is in the sum of$76,941.
~. Direct the City Clerk, within ten (10) days from the date of acceptance, file a ''Notice
of Completion" with the Orange County Recorder for Zoeter School Abatement and
Demolition Project No. 50223 and Zoeter Park Improvements Project No. 50224.

4. Direct City staff, upon expiration of the thirty-five (35) days from the filing of the
"Notice of Completion," to make the retention payment to Resource Environmental,
Inc. in the amount of $57,370.

"Notice of Completion," to make the retention payment to Bennet Landscaping, Inc.
in the amount of $6,271.
