HomeMy WebLinkAboutCC Ord 1259 Not Adopted I I I ORDINANCE NO. ~ illJt'~/t: ~ AN ORDINANCE OF THE CITY OF SEAL BEACH IMPOSING A MORATORIUM ON CERTAIN LAND USE APPROVALS AND PERMITS AND DECLARING THE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. The City of Seal Beach hereby declares a moratorium on the issuance of building, grading or other permits and in the processing or approval of any land use approvals or entitlements, including but not limited to General Plan amend- ments, zone changes, tentative tract maps or conditional use per- mits, with respect to that certain area of the City lying north- erly of the San Diego Freeway and easterly of Seal Beach Boulevard to the City limits as shown on the map attached hereto as Exhibit A (the .subject property.). Section 2. Nothwithstanding any other ordinance or code of the City of Seal Beach, no building, grading or other permit for new construction shall be issued and no General Plan amend- ment, zone change, tentative tract map, or conditional use per- mit, or application therefor, shall be accepted for filing, pro- cessed or approved with respect to the subject property. Section 3. The moratorium or limitation provided for in Section 2 hereof shall not be applicable to the following: (a) The maintenance, repair or renovation of any lawfully existing uses. (b) The reconstruction of an existing building or structure which has been damaged or destroyed by fire or other casualty in accordance with all applicable laws. (c) The establishment and maintenance of any uses permitted in the Recreational Golf (R-G) Zone by Section 28-1900 of the Code of the City of Seal Beach, California. Section 4. The real property subject to this ordinance consists of over 200 acres of land located in a sensitive area of the City. A substantial portion of the subject property consists of a golf course which provides open space amenities, recreation- al opportunities and drainage for adjacent properties. The development of the subject property is likely to have substantial environmental, social and economic impacts on the City. The potential traffic and other infrastructure impacts from future development are of particular concern. The best means to secure the well-planned and most beneficial use of such property is to adopt a specific plan. Such plan cannot be prepared, however, until preliminary planning studies are completed. If this or- dinance does not take effect immediately, land uses and develop- ment may be prematurely undertaken in a manner that will conflict with the specific plan and other land use regulations for the subject property that will be studied. Therefore, it is neces- sary for the immediate preservation of the pUblic peace, health, safety and welfare that this ordinance take effect immediately. This ordinance is an interim ordinance and shall expire forty- five (45) days after the adoption thereof unless extended by the City Council.
