AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
SEAL BEACH, CALIFORNIA, CALLING AND GIVING NOTICE
OF THE HOLDING OF A PRIMARY MUNICIPAL ELECTION
TO BE HELD IN THE CITY ON TUESDAY, MARCH 29, 1988,
FOR THE ELECTION OF CERTAIN OFFICERS OF THE CITY
AS REQUIRED BY THE PROVISIONS OF THE CHARTER OF
THE CITY OF SEAL BEACH AND FURTHER CALLING AND
GIVING NOTICE OF THE HOLDING OF A SPECIAL MUNICIPAL
ELECTION CONSOLIDATED THEREWITH
WHEREAS,
under the provisions of the Charter of the City of Seal
Beach, California, a Primary Municipal Election shall ,
be held on March 29, 1988, for the election of Municipal
Officers; and
pursuant to authority provided by statute an initiative
petition has been filed with the City Clerk of the
legislative body of said City signed by more than ten
percent of the number of qualified registered voters
of said City; and
WHEREAS,
WHEREAS,
the City Clerk of said City has caused said petition
to be duly examined and from the records of registration
ascertained that the petition is signed by the requisite
number of voters, and has so certifiedl and
WHEREAS ,
the City Council of said City has not voted in favor
of said initiative ordinance; and
WHEREAS ,
the City Council of said City is thereupon authorized
and directed by statute to submit said initiative
ordinance to the qualified voters.
THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, DOES HEREBY
ORDAIN AS FOLLOWS:
Section 1. That pursuant to the requirements of the Charter of the
City of "Seal Beach, California, there is called and
ordered, to be held in the City of Seal Beach, County of
Orange, State of California, on Tuesday, March 29, 1988,
a Primary Municipal Election for the purpose of electing
one (1) member of the City Council from Councilmanic
District Two for the full term of four yearsl one (1)
Member of the City Council from Councilmanic District
Four for the full term of four years; a City Clerk, City-
wide, for the full term of four years.
Section 2. That pursuant to the Charter of the City of Seal Beach and
the requirements of the laws of the State of California
relating to general law cities within said State, there
shall be, and there is hereby called and orderdheld in
the City of Seal Beach, County of Orange, State of
California, on Tuesday, March 29, 1988, a Special Municipal
Election of the qualified electors of said City, consoli~
dated with said' Primary Municipal Election, for the purpose
of submitting the following initiative ordinance, to wit:

Sect~on 3. The Initiative Ordinance submitted to the voters is
attached hereto as Exhibit "A".
Section 4. That the ballots to be used at the election shall be in
form and content as required by law.

Section 5. That the City Clerk of the City is authorized, instructed
and directed to procure and furnish any and all official
ballots, notices, printed matter and all supplies, equip-
ment and paraphernalia that may be necessary in order to
properly and lawfully conduct the election.
Section 6. That the pOlls for the election shall be open at seven
(7:00) o'clock a.m. of the same day of the election and
shall remain open continuously from that time until eight
(8:00) o'clock p.m. of the same day when the pOlls shall I
be closed, except as provided in Section 14301 of the
Elections Code of the State of California.
Section 7. That in all particulars not recited in this Ordinance, the
election shall be held and conducted as provided by law
for holding municipal elections.
Section 8. That notice of the time and place of holding the election
is given and the City Clerk is authorized, instructed and
directed to give such further or additional notice of the
election, in time, form and manner as required by law.
Section 9. That the City Clerk shall certify to the passage and
adoption of this Ordinance, shall cause the same to be
published as required by law, shall make a minute of
passage and adoption thereof in the records of the pro-
ceedings of the City Council of said City in the minutes
of the meeting at which the same is passed and adopted.
Section 10. This ordinance shall take effect immediately upon
adoption.

SEAL BEACH PRESERVATION & OPEN SPACES INITIATIVE ORDINANCE
FOR THE CITY OF SEAL BEACH
ARTICLE I - FINDINGS & PURPOSE
II The People of the City of Seal Beach do ordain as Follows:
SECTION 1:

IA) FINDINGS: We the people of Seal Beach find that our city
government is committed to a policy of rapid, uncontrolled, high
density development to the detriment of our quality of life
through the granting of waivers and exceptions to city ordinances,
entering into planned unit development agreement schemes, and
allowing infringement on public, quasi-public and parklands/open
spaces by developers. To further these objectives, the city
prevents existing property owners from improving their property or
rebuilding in the event of disaster so as to create "blighted ·
areas" for purposes of "redevelopment." To hasten creation of
"blighted areas" indirectly, the city has passed an all-
encompassing "nuisance" ordinance exposing property owners to spot
enforcement where their property stands in the way of
redevelopment.
The Los Alamitos School District has sold to the city part
of the Zoeter School site and the district or city will sell or
use the balance of the site for commercial/residential purposes.
In accomplishing this purpose the City has rezoned portions of the
Zoeter School site from parks and open space to commercial and
residential. The existing tennis courts and school buildings will
be destroyed for commercial and residential development. Unless
the city's zoning for the Zoeter School site is restored to open
space/parkland, this valuable recreation site will be lost
forever. Therefore as provided by Government Code Section
65852.9, we the residents of Seal Beach find the uses for the
Zoeter school site compatible with the uses of property
surrounding the school site to be open space/parklands because:
1. A large portion of the school site is presently
open/space parkland and a'portion is presently
devoted to pre-school activities; and
2. A substantial use adjoining the property is a
church; and
3. Within 1000 feet of the school site on electric
Avenue parkland exists which is heavily used by the
public; and
4. By Seal Beach City Code Section 2l-32(B) 111 the
City has determined 5 acres of open space/parkland
is appropriate for every 1,000 residents and this
has not been met; and

Commercial/residential development adjoining
present parks, pre-school and church is not
compatible with present uses as such would
exacerbate a present critical parking problem for
users of said facilities, be detrimental to pre-
schoolers and our youth exposed to unknown
commercial endeavors and cause friction between
park users and commercial/residential users as to
lights, noise and traffic.

The City admits to a serious parking problem in this same
area but follows a continuing policy of approving commercial
expansion which only exacerbates the problem. The parking problem
is further compounded by the granting of waivers of parking
requirements in the municipal code to commercial developers.
Unless commercial parking requirements are made mandatory by this
ordinance, our city will be destroyed by blind commercialization
from out-of-town developers who care little for the quality of
life in the City.
While allowing the greatest cause of parking congestion
(outside commercial developers) exceptions to parking requirements
through numerous ruses, e.g., in-lieu, "borrowed parking," etc.,
the City has held residents and homeowners to strict compliance
with parking requirements to where private homes and apartments
are in danger of deteriorating to near slum conditions. The
admitted City policy - although never voted on by the residents _
is to prevent increasing the economic life of residential property
to where in some future generation the City will be single family
homes. This is accomplished by declaring homes/apartments as
"non-conforming uses" by bureaucratic fiat. Most City
homes/apartments are "non-conforming" due to property/set-backs,
undersize garages, or use. Even present "conforming"
homes/apartments can become "non-conforming" if the City becomes
displeased with the property. Unless the city's zoning text is
amended by this ordinance, further deterioration of
homes/apartments will occur to the benefit of outside commercial
developers. The anomaly is that a duplex with 2 parking spaces is
to rot away while a major Main Street tavern without parking for
patrons is encouraged.
The City's willingness to lose all or part of Zoeter School
and abandon proposed open spaces for commercial development has
alarmed many citizens to where they want to insure no further
loses without an affirmative vote of the residents. This
ordinance requires such an affirmative vote, if and only if, the
city proposes to change already declared open space, public and
quasi-public land, and parkland to another use, destroy urban
forests, or construct city streets through public or quasi-public
property.
The specific plan for the DWP property requires adopting and
amending to bring it into conformity with this ordinance since it
adjoins residential property and will impact on residential and
beach parking. The 70% open space must be insured to remain
without infringement by buildings. Allowance for 137 beach
parking spaces to a hotel developer where only 120 exist only
compounds existing parking problems for nearby residents and beach
goers.
Several nearby cities have enacted nuisance ordinances to
declare otherwise legitimate homes which offend city bureaucrats
as "nuisances," for such things as peeling paint, weeds, prolonged
remodeling and deteriorated roof. This has led to citations into
court, harassment, and even jail terms and destruction of the
property. Seal Beach has such an ordinance, which was recently
strengthened quietly by the City Council. To prevent abuse and
arbitrary application of a "nuisance" declaration, this ordinance
restricts designations of nuisances to those contained in state
law.
At the last election residents favored a "disaster clause" to I
allow replacement of property in-kind in the event of a
catastrophe such as the storm of 1983 which demolished our pier.
In 4 years the City Council has not enacted such a disaster
clause.
Following rebuilding of the Seal Beach fishing pier,
residents favored restoring the previous coffee shop as well. In
response to the residents wishes, the City built such a structure
at great expense, for lease to an operator. The City has proposed
a deluxe dinner house/night club not in keeping with the wishes of
the residents and mortgaging scarce beach parking to a leasee.
This ordinance limits any conditional use permit for the pier
restaurant to beer and wine only thus discouraging a dinner
house/night club from operating and prevents granting a leasee any
greater right to public parking than any other person receives.

Finally, as found, the City has been willing to ignore their
own ordinances in allowing commercial development without required
parking. This ordinance'allows any resident or property owner to
seek injunctive and declaratory relief and their attorney fees if,
after notice and demand, the City refuses to follow this
ordinance.
B: PURPOSE - The purpose of this ordinance is to provide
controlled, orderly growth of the City of Seal Beach and to
preserve for our children open spaces and parkland, as well as
clean, modern and improved residences for all.
SECTION 2:
This Chapter shall be known as the Seal Beach Preservation and
Open Spaces Ordinance.
ARTICLE 11 - DEFINITIONS
SECTION 1: "Department of Water & Power (DWP) Property" means
that land at the corner of First Street and Marina Drive which
extends in a southerly direction between First Street and the San
Gabriel River from Marina Drive to the City parking lot and
legally described in Resolution No. 3228 adopting the specific
plan for the property, dated November 22, 1982.
SECTION 2: "City" means the City of Seal Beach and/or the
Redevelopment Agency of the City of Seal Beach.
SECTION 3: "City Street" and "Street" means a Street or City
Street as defined in Sections 11004 and 11005 of the Streets and
Highways Code.
SECTION 4: "Intensi fied" means the increased use of real property
and the improvements thereon, if any, to a greater use than
previously used such as vacant land to single family home, retail
store to restaurant, single family home to duplex, duplex to
triplex, residential to commercial, or single use to multiple use
as a hotel to hotel-restaurant, restaurant without liquor license
to restaurant with liquor license, or grocery store to grocery
store and restaurant.
SECTION 5: "Open Space" and or "Parkland" means land use devoted
to open spaces consisting of such improvements as greenswards,
walks, lighting, park benches, planting areas, baseball diamonds,
tennis courts, football, soccer and rugby fields, playgrounds with
swings, slides and jungle gyms, with unrestricted access to the
public.
SECTIONS 6: "Pier Restaurant" means that restaurant building at
the end of the Seal Beach Fishing Pier constructed by the City in
conjunction with the California Coastal Conservancy.
SECTION 7: "Hotel," "Motel," "Inn," "Tourist Home," "Bed &
Breakfast," or "Caravansary," means a commercial establishment
consisting of a building or group of buildings on one site, under
one ownership or management, with 5 or more guest rooms, with or
without kitchens, which are used, or rented or hired out to be
occupied primarily for sleeping purposes by transient guests.

SECTION 10: "Restaurant" means an eating establishment which
offers menu items for consumption on the premises and maintains a
full staff of cooks, waiters, waitresses, and bus boys at all
times during the hours of operation and such food service
constitutes at least 60% of the gross receipts of the
establishment.
SECTION 11: "Retail Store" means a commercial establishment
selling goods or services, other than food and beverages consumed I
on the premises, directly to the public.
SECTION 12: "Tavern" means an establishment selling food and/or
beverages which does not fall within the definition of a
restaurant.
SECTION 13: "Urban Forest" means a group of 10 or more trees over
10 years of age growing in close proximity to one another, and as
further defined in Public Resources Code Section 4799.09.
SECTION 14: "Zoeter School" means that parcel of land at the
corner of Twelfth Street and Pacific Coast Highway, extending
between Pacific Coast Highway and Landing Street.
ARTICLE 111 - PARKLAND/PUBLIC LANDS
SECTION 1: Zoeter School is hereby declared to be parkland in
perpetuity, except that not more than 15% of the square footage of
the property may be improved with permanent structureS for use as
a day nursery, meeting rooms, gymnasium or equipment storage, not
over 35 feet in maximum height.
SECTION 2: The specific plan for development of the DWP property
as contained in Resolution No. 3228 is adopted by incorporation
into this Initiative Ordinance and amended as follows:
(1) Section A(4) (E) is deleted in its entirety.
(2) Section B(2) defining "Open Space" is deleted in its
entirety and replaced with the definition contained in
this ordinance.
(3) Section B(4) (B) is deleted in its entirety and replaced
with: "Permitted uses: all uses contained in the
definition for 'Parkland and/or Open Spaces' contained in this
ordinance."
(4) Section B(7) (A) is amended by replacing the parking
requirements for "Restaurant" to those required by and defined in
this ordinance.
15) Section B(7) (B) is deleted in its entirety and replaced
with: "Subterranean parking is specifically authorized."
SECTION 3: MANDATORY REFERENDUM: Any real property classified as
"Parkland," "Open-Space," or as "Quasi-public" land use under this
ordinance or under the general plan of the City of Seal Beach or
any real property owned by the City which is classified "Public"
land use under the general plan of the City of Seal Beach shall
not be changed to another land use classification nor shall the
City enter into any planned unit development agreements unless
two-thirds "(2/3) of the qualified electors of the City, voting of
the proposed change, approve such change by voting in favor
thereof at a general or special election.
SECTION 4: No tree in an urban forest standi~ on public or
quasi-public land or parkland may be cut and removed without the
City first obtaining the written affirmativ~ re~ommendation of the
chairman of the Department ot Forestry at a recognized California
University that such cutting and removal is necessary for the
health and safety of the urban forest and/or the pUblic. This
section does not apply to routine maintenance and trimming to
preserve the urban forest in a healthy state.

SECTION 5: No City street or portion thereof shall be constructed
on public or quasi-public land or widened, abandoned, or rerouted
unless two-thirds (2/3) of the qualified electors of the City,
voting on the proposed construction, widening, abandoning, or
rerouting, approve such by voting in favor thereof at a general or
special election.
SECTION 6: The maximum building height limitation of 35 feet for
all new construction in District 1 as defined in the City's zoning
Ordinance No. 948, Section 28-300(1) IA) shall be strictly enforced
without exception.
SECTION 7: The provisions of the City's zoning ordinance No.
948, Section 28-900, requiring a minimum of one-third (1/3) park
land in development of residential-commercial-park property shall
be strictly enforced without exception.
ARTICLE IV - PARKING
SECTION 1: Notwithstanding the provisions of any other City
ordinances on-site parking requirements for hereinafter approved
commercial establishments by the City of Seal Beach shall be as
follows; without exception:
IA) Retail stores - one 11) parking space for each 300
square feet of gross floor space of part thereof;
(B) Restaurants Iwithout a liquor license) - one (1) parking
space for each 100 square feet of gross floor space or
part thereof;
(C) Restaurants (with a liquor license) one (1) parking
space for each 50 square feet of gross floor space or
part thereof;
ID) Hotels/motels - one 11) parking space for each room
available for rental;
(1) If the hotel/motel also has restaurant
facilities, additional parking shall be
provided as per (B) or (C) above for the gross
floor space or part thereof devoted to eating,
drinking, dining, dancing, and kitchen/larder;
and
(2) If the hotel/motel also has conference/meeting
rooms, one (1) additional parking space shall
be provided for each 75 sq. ft. of gross floor
space.
(E) Taverns - one (1) parking space for each 25 square feet
of gross floor space or part thereof.
SECTION 2: Existing commercial property in commercial use at the
time of enactment of this ordinance shall be exempt from the
foregoing parking requirements and shall provide such parking as
heretofore provided; however, in the event the property used for
such commercial purpose is intensified, then the parking
requirements of section 1 above shall be met.
SECTION 3: Sections 28-2209 (4) and 28-2500 of the Seal Beach
Municipal Code are hereby repealed.' Section 28-1103 (1) is
amended to read: liThe minimum site which may be considered for a
planned unit development shall be two thousand acres."
SECTION 4: The pier restaurant operated by the City or its
leasee(s) is exempt from the parking requirements of this
ordinance since on-site parking is impossible. However, the City
shall not grant to its leasee(s) any right to use of public
parking greater than that granted any other person. No
conditional use permit shall be granted to the leasee(s) of the
pier restaurant for on-site consumption of alcoholic beverages
other than for beer and wine.

SECTION 5: Notwithstanding any City ordinance to the contrary,
including designations of non-conforming buildings and uses,
nothing shall prevent a property owner from improving his existing
property to the greatest extent possible, in conformity with the
Uniform Building Code, and height limitations, without regard to
parking requirements provided the use of the property is not
intensified, nor existing parking reduced.
ARTICLE V - DISASTER CLAUSE
I
SECTION 1: In the event of fire, flood, earthquake, or other
disaster beyond the property owner's control which destroys, in
whole or in part, any improvements on real property located in the
City, the owner thereof may rebuild and/or replace the
improvements on his property to the same use, size, and number of
rooms or units as previously existed and as previously approved by
the City or county notwithstanding any other City ordinance then
in effect to the contrary.
ARTICLE VI - ENFORCEMENT AND ABATEMENT
SECTION 1: Notwithstanding any City ordinance to the contrary,
the abatement of any nuisance within the City shall be limited to
that provided by Section 3479 of the California Civil Code.
SECTION 2: Any resident of the City of Seal Beach or Seal Beach
property owner may bring action in the Superior Court of Orange
County to enforce this ordinance, through injunctive and
declaratory relief if, after written demand, the City fails or
refuses to do so. Written demand shall specify the violation and
be personally served on the City on the City Clerk or mailed
certified mail, return receipt requested, to the City Clerk. The
City Council shall decide at its next regular meeting after
receipt of the demand whether to enforce this ordinance or reject I
the demand. Failure of the City Council to so act shall be deemed
a rejection. In the event the city council decides to enforce
this ordinance as provided herein but fails to so act within ten
(10) days, such failure to act shall be deemed a rejection.
IA) If, after the City Council rejects the demand or fails
to enforce this ordinance, and the resident or property owner
brings suit and prevails, the City shall pay the resident's or
property owner's reasonable attorney fees and costs as determined
by the court.
ARTICLE VII - SAVINGS CLAUSE
SECTION 1: In the event that any provision of this ordinance is
or shall at any time be found invalid or unlawful by any court of
competent jurisdiction, such provisions shall be deemed a
separate, distinct and independent provision, and the invalidity
of such provision shall not affect the validity of the remaining
provisions hereof.
SECTION 2: To the extent this ordinance conflicts with existing
City ordinances, this ordinance shall prevail.
