AN ORDINANCE OF TF~ C1~Y OF SEAL BEACH REGULATING SA~ELLITE DISH ANTENNAE AND AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN: Section 1: Article 23 of Chapter 28 of the Code of the City of Seal Beach is hereby amended by amending Paragraph A of Section 28-2350 to read: "(A) Definition: The term "satellite dish antenna" shall mean any dish-shaped antenna designed to receive satellite signals from any earth orbiting satellite of any type. For purposes of this Section, "satellite dish antenna" shall not include dish-shaped antennae which have a diameter measuring less than one (1) meter." Section 2: Article 23 of Chapter 28 of the Code of the City of Seal Beach is hereby amended by amending Paragraph C of Section 28-2350 to read: "(C) ADDroval and Permits Recruired. It shall be unlawful to install or maintain a satellite dish antenna without first obtaining the following: (1) Approval to install a satellite dish antenna by the Department of Development Services pursuant to the criteria set forth in this Section 28-2350 and the provisions of the Zoning Ordinance. (2) A building permit." Section 3: Article 23 of Chapter 28 of the Code of the city of Seal Beach is hereby amended by amending Subsection l(a) of Paragraph D of Section 28-2350 thereof to read: "(i) Residential Zones. A satellite dish antenna may be installed only at ground level within the following Planning Districts: District II - that area commonly known as "College Park West." ". Districts V and VII. In the event that reasonable satellite signals cannot be received if th~ satellite antenna is ground mounted, such satellite antenna may be roof mounted if approval is granted by the Planning .Commission, pursuant to consent calendar review, upon a showing by the applicant that usable satellite signals are not receivable if such antenna is ground mounted." Section 4. Article 23 of Chapter 28 of the Code of the city of Seal Beach is hereby amended by amending Paragraph E of Section 28-2350 thereof to read: "(E) Performance Standards and Criteria. The following regulations shall apply to the installation and maintenance of all satellite dish antennae: (1) All satellite dish antennae shall be .. substantially screened from view from streets and adjacent properties by use of fences, walls, parapets, hedges, or other architectural or landscape elements. (3) All electrical wirinq associated with satellite dish antennae shall be buried underqround or otherwise screened. (4) Heiqht Limitations - Ground mounted satellite dish antennae shall not exceed 15 feet in heiqht as . measured from ground level to the hiqhest point of said antenna. Roof mounted antennae shall not exceed the maximum building heiqht limit permitted in the zone. (5) Antenna Color Compatibility - Satellite dish antennae shall be compatible in color with the dominant backqround of their surroundings. (6) Satellite dish antennae shall be installed and maintained in compliance with the requirements of the Uniform Buildinq Code. (7) Satellite dish antennae shall be supported on a stable base approved by the Department of Develop- ment Services. If deemed necessary by said department, a wind velocity test shall be required. (8) Setbacks: A. Ground-mounted Satellite Antennae in Residential zones - No such antenna or its supportinq structure shall be located within three (3) feet of any structure or within three (3) feet of any rear or side property line. No such antenna shall be located in the area between the front property line and the dwellinq. B. Ground-mounted Satellite Antennae in Non-Residential Zones - No such antenna or its support structure shall project into any required yard. C. Roof-mounted Satellite Antennae - No such antenna or its support structure shall project into any required yard." Section 5: Article 23 of Chapter 28 of the Code of the City of Seal Beach is hereby amended by amending Paragraph F of Section 28-2350 thereof to read: "(F) Amortization Period. Satellite dish antennae which do not conform to this section but which lawfully existed and were maintained on June 10, 1985, shall be removed or placed in conformance with this section within seven (7) years after said date or upon sale of the subject property by the installer of such antenna, whichever is sooner. During the interim period, said nonconforminq satellite dish antennae shall be maintained in qood repair and visual appearance and no structural alteration be made thereto, unless to preserve the safety of said antennae." Section 6. Article 23 of Chapter 28 of the Code of the City of Seal Beach is hereby amended by addinq a new paragraph H to Section 28-2350 to read: "(H) Excections. If reasonable satellite signals cannot be obtained from an antenna installed subject to the limitations imposed by this Section, the Department of Develop- ment Services may qrant an exception to such requirements upon a showinq by the applicant that an exception is necessary for reasonable reception of signals. The provisions of this Section 28-2350 shall not be applied in such a manner as to preclude reasonable siqnal reception."
