THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Article I. Chapter 5, Section 5-1 of the Code of Seal Beach 1S amended to read: Section 5-1 Codes Adopted by Reference. The codes 11sted below are adopted by reference as the Building and Safety Code of the City of Seal Beach: (A) ( B) ( C) (D) (E) ( F) (G) (H) ( I ) (J) (K) (L) (M) Uniform Building Code, 1985 Edition, including Appendix. Uniform Mechanical Code, 1985 Edition. Uniform Plumbing Code, 1985 Edition. Uniform Swimming Pool Code, 1985 Edition. Uniform Housing Code, 1985 Edition. Uniform Code for Abatement of Dangerous Buildings, 1985 Edition. Uniform Sign Code, 1985 Edition. National Electrical Code, 1987 Edition. Uniform Building Code Standards, 1985 Edition. Uniform Fire Code, 1985 Edition, including Appendices 1-A through VI-A and 1986 Accumulative Supplements. Uniform Fire Code Standards, 1985 Edition. Uniform Solar Energy Code, 1985 Edition. Uniform Building Security Code, 1985 Edition. One copy of each of the above Codes shall be deposited in the Office of the City Clerk and shall be at all times maintained by said Clerk for use and examination by the public. All amendments to Codes adopted herein by reference shall be considered as part of the Code. Section 5-3a. Constitutionality or Invalidity. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance and such section, subsection, sentence, clause, I I I I I Ordinance Number ~.2~ 1 I ~ 9 -.v"'. phrase, or portion hereof, irrespective of the fact any one or more sections, subsections, clauses, phrases, or portions be declared invalid or unconstitutional. SECTION 2. Article II. Chapter 5, Section 5-6 of the Code of Seal Beach is amended to read: Section 15-6. Permits. It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy, or maintain any building or structure or cause or permit the same to occur unless a separate valid permit for each building or structure has first been obtained from the building official. Refer to Section 5-6A for work exempt from the requirement to first obtain a permit. SECTION 3. Article II. Chapter 5, Section 5-14 - Issuance. Subsectlon (B) of the Code of Seal Beach is amended to read: Exception: A building permit may be issued to an owner of any single family building, or dwelling, not exceeding three (3) stories including appurtenances thereto who contracts for such a project with a licensed and insured contractor or contractors. Electrical, sewer, mechanical and plumbing permits shall be issued to licensed contractors only. (1) Any permit required by this Code may be issued to any owner to do any work regulated by this Code in a structure, building or a dwelling, including the usual accessory buildings and quarters in connection with such buildings, provided: (a) That the owner shall personally purchase all material and shall personally, or through his own employees, perform all labor in connection therewith; and (b) That such structure, building or dwelling with or without accessory buildings and quarters or appurtenances thereto is not intended or offered for sale; and (c) That the owner shall file a certificate of consent to self-insure, or a certificate of Worker's Compensation Insurance, or a certificate of exemption for Worker's Compensation Insurance. (d) The owner shall complete and return prior to permit issuance an owner-verification form as required in Section 19831 of the Health and Safety Code, and as prepared or amended by the Building Official. SECTION 4. Article II. Chapter 5, Section 5-15. Retention of Plans. Is amended to read: ; Section 5-15. Retention of Plans. One (1) set of BUlldlng OfflClal approved plans, specifications and computations shall be retained by the Building Official as required by State law, and one (1) set of approved pI ans and specifications shall be returned to the applicant, which set shall be kept on the site of such Ordinance Number ~7 , building or work at all times during which the work authorized thereby is in progress. This set of approved plans (plus future plans or changes that the Building Official has stamped approved) shall be the only plans used for inspections required by Sections 5-19 through 5-28. Plans submitted for checking, for which no permit is issued, and on which no action is taken by the appl icant for one hundred and eighty days (180) may be I returned to the last known address of the applicant, or destroyed by the Building Official. The Building Official may extend the time for action by the appl icant for a period of one hundred and' eighty days (180) days upon request by the applicant showing that circumstances beyond the control of the appl icant have prevented action from being taken. No appl ication sha 11 be extended more than once. In order to renew action of the plans, a payment of a new plan check fee shall be required. SECTION 5. Article II. Chapter 5, Section 5-23. Inspect10ns, 1S amended to read: Excessive Section 5-23. Excessive Inspections. If in the op1n 10n of the bU1 Id1ng Off1C1 a I, the work is not being coord inated or executed by the permittee, which then requires an inordinate number of reinspections, or cor r e c t ion s call e d for are not mad e, 0 r the wo r k deviates from the approved set of plans, or the Building Code, the Building Official shall require a reinspect ion fee in accordance with the current resolution adopted by the City Council for building fee purposes. SECTION 6. Article II. Chapter 5, Section 5-25. Fee, 1 s hereby amended to read: Reinspection I Section 5-25. Reinspection Fee. When any reinspection is required due to the negligence of the permit holder, his agent, or other responsible persons, or due to the failure of said parties to comply with previous correction instructions, a fee may be charged by the Building Official as set forth in Sections 5-16 through 5-18 prior to each reinspection. S EC TI 0 N 7. Art i c 1 e I I. C hap t e r 5, -S e c t ion 5 - 2 7 . S pee i a 1 Inspect10n - Generally, is hereby amended to read: Section 5-27. S ecial Ins ection - Generall. In a 1 10n 0 e 1nspec 10ns 0 e ma e as spec1 ic in Sections 5-19 through 5-26, the owner or his agent shall employ a special inspector who shall be present at all times during construction of the types of work noted in Section 306 of the Uniform Building Code, 1985 Edition. ' SECTION 8. Article V. Chapter 5, Amendments to Codes, is hereby amended to read as follows: Section 5-29. Amendments to Codes - Generall{" The codes set forth 1n Section 5-1 of th1s Chap er are amended as set forth herein. I Section 5-30. Amend ed . Uniform Bui lding Code, 1985 Edition, Ordinance Number ;I~j1 .- The following amendments are made to the Uniform Building Code, 1985 Edition adopted by this chapter: (1 ) Section 205 is amended to read as follows: (2) Section 205. It shall be unlawful for any person, firm, or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert, or demolish, equip, use, occupy, or maintain any bu.i1ding or structure in the City, or cause the same to be done, contrary to, or in violation of any of the provisions of this Code. Any person, firm, or corporation violating pny of the provisions of this Code shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than five hundred dollars ($500) or by imprisonment of not more than six (6) months, or by both such fine and imprisonment. Each separate day or any portion thereof during which a violation of this Code occurs or continues shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as herein provided. Section 301~ is amended to read as follows: (b) Ex~mf~edsWo~k. Only the work noted in Section 5-6A 0 e ea Beach Municipal Code shall be considered exempt from obtaining a building permit. A final inspection shall be obtained from the Building Official when the re-roofing is complete. (5) Section 306l!l is amended to add Item 13 as follows: I 13. Structural Steel: A special inspector is required to be present during the entire period of erection of the structural steel framework. Building of a minor nature shall be sufficiently inspected to satisfy the inspector that steel members and their assembly comply with all regulations. (6) Section 508. Where one-hour fire-resistive constructlon tnroughout is required by this Code, an approved automatic sprinkler system, as specified in Chapter 38, may be substituted, provided such system, is not otherwise required throughout the building. Corridors [Sections 3305(g) and (h)]. I f. Stair enclosures [Section 3309]. g. Exit passageways. [Section 3312(a)]. h. Type of construction separation [.Section 1701]. i. Atriums constructed in accordance with Section 1715. (7) Section 1206(~ is amended to read as follows: (b) Yards. Every yard shall be not less than three (3') feet in width for one-story, two-story, three- story or four-story buildings with heights of thirty- five (35') feet or less. For buildings more than thirty-five (35') feet in height, a minimum width of the yard shall be increased at the rate of one (1) foot for each additional story greater than two (2). For bui ldings exceeding fourteen (14) stories in height, the required width of yard shall be computed on the basis of fourteen (14) stories. (8) Section 1704 is amended to read as follows: Section 1704. Roofs. Notwithstanding any other provislon of thlS BUllding Code and Appendix to the I contrary, the roof covering of any building hereinafter, constructed regardless of type or occupancy classification, including any re-roofing of any existing building as specified in Chapter 32 of the Appendix hereto, involving fifty percent (50~) or more of such roof in any twelve (12) month period of time, shall be of fire-retardant construction as defined in Section 3202(b) of this Code. , (9) Section 3303 is amended to read as follows: Section 3303(a) - Number of Exits. Occupants on floor above the second story and in basements shall have access to not less than two (2) separate exits from the floor or basement. Exceptions: 4. Occupied roofs on Group R, Division 3. Occupled roof areas which have five hundred (500) square feet or less which is an open and unenclosed sun deck may have one (1) exit if located no higher than immedi~tely above the second story, if a two-story structure, or immediately above the third story, if a three-story structure. Excel1tions: 5. Group R, Division 3 Occupancies may supply one (1) required exit, subject to the following requ irements: I (a) A fi xed emergency exit ladder from the top habitable floor to natural grade. Other ladder Ordinance Number ~~~.i1 , (10 ) - systems approved by UL and ICBO may be used if approved by the Building Official; and (b) The dwelling shall contain a 13-D fire sprinkler system, as approved by the Orange County Fire Department and the Building Official. ~ection 3306(ft is amended to read as follows: (f) Spiral Stairways. In Group R, Division 3 Occupancies and in private stairways within individual units of Group R, Division 1 Occupancies, spiral stairways may be installed. Such stairways may be used as required exits, provided the area served is no more than five hundred (500) square feet of habitable area or one half of habitable area of floor served, which ever is less. I The tread must provide a clear walking area measuring at least twenty-six (26") inches from the outer edge of the supporting column to the inner edge of the handrail. A run of at least seven and one-half (7.5") inches is to be provided at a point twelve (12") inches from where the tread is the narrowest. The rise must be sufficient to provide six foot six inch (6'6") headroom. The rise shall not exceed nine and one- half (9.5") inches. (11) Section 3802. Where Required. (a) An automatic fire-extinguishing system shall be installed in the occupancies and locations as set forth in this section. I For special provisions on hazardous chemicals and magnesium,and calcium carbide, see the Fire Code. (b) All Occu ancies Exce t Grou R Division 3 and Group . Excep or Group R, Dlvlslon 3 an Group M occupancies, an automatic sprinkler system shall be ins tall ed . (5) In all new buildings or structures when the gross square footage thereof exceeds 6,000 square feet or more than two (2) stories in height regardless of area separation walls. I (6) Throughout all new R-1 occupancies, including enclosed garages, or any project with 15 units or greater. (12) Section 3804. Subject to the approval of the Bui 1dlng OfflCla1 and with the concurrence of the Chief of the Fire Department, sprinklers may be omitted in rooms or areas as follows: (a) When sprinklers are considered undesirable because of the nature of the contents or in rooms or areas which are of noncombustible construction with wholly non-combustible contents and which are not exposed by other areas. Sprinklers shall not be omitted from any room merely because it is damp or of fire-resistive construction. (b) Sprinklers shall not be installed when the application of water or flame and water to the contents may constitute a serious life or fire hazard. Other approved automatic fire-extinguishing systems shall be installed in these areas when the area is required to be protected by other sections of this code. Ordinance Number ~~j1 (13) Section 4409 is amended to add the following: (a) General. For the purpose of this section a projection beyond the property line that must be supported by structures. (1) Handl inQ Of Mate..ial s. All materials shall be handled wlthln the building area or within an area bounded by a barricade approved by the Building Official. (2) Structural Members. No structural member in any story shall be demolished or removed until the story next above is completely removed. (3) Storage of Materials. No material shall be stored on any floor ln excess of the allowable live load for that floor. I (4) Prevention of Dust. sufficantly set at the prevent dust from rising. (14) Section 4508 is added to read as follows: All debris shall be time of handl ing to Section 4508. Structures and appendages projected beyond and supported from public property: (a) General. For the purpose of this section, a proJectlon beyond the property line that must be supported by structures placed on publ ic property shall be allowed only after plans and speci fications have been approved by the City Councilor such commission, committee, I agency, department, group or individual as the Council may appoint by resolution to approve such plans. (b) PrOjection and Clearance: The horizontal clearance between the structure and the curb line shall be not 1 ess than two (2') feet. A structure projecting into the public right-Of-way shall be not less than eight (8') feet above the ground or pavement below. (c) Uses: The space adjoining a structure projecting into the public right-of-way shall not be used for any occupancy defined in the Uniform Building Code, 1982 Edition. (15) AP~endix Section 5301 ill is hereby amended to rea as follows: Note: Refer to California Energy Resources rDnServation and Development Commission's Regulations establishing energy conservation standards for new non-residential buildings and the erection, construction, enlargement, conversion, alteration and repair of all I residential buildings, including hotels, motels, apartment houses and dwellings. These regulations are in Sections T-20-1400 through T-20-1464 and Parts 2-5301 through 2-5365 of Title 24 of the California Administrative Code. Ordi nance Number /.2t" 7 w .. I (16) Fees Not Adopted. Any and all fees established in Chapter 3 and Chapter 70 of the Uniform Building Code, 1985 Edition, adopted by thlS Chapter, are hereby deleted. Fees shall be established by separate action of the City Council. (17) Chapter 55 is added to read as follows: "CHAPTER 55 - FENCES" Section 5501. Fences. A. All fences shall comply with the provisions of this chapter. B. Masonry fences shall comply with the provisions of Chapter 24. C. Wood fences shall comply with the provisions of Chapter 25. D. Concrete fences shall comply with the provisions of Chapter 26. E. Street fences shall comply with the provisions of Chapter 27. I F. Aluminum fences shall comply with the provisions of Chapter 28. G. Fences constructed of a combination of materials shall conform to the cognizant chapter and/or the manufacturers of cognizant material institute requirements. H. The fence footings and foundations as well as those fences that are in whole or part of a retaining wall shall conform to Chapter 29. I. Fences shall structurally conform to Chapter 23. Section 5502. City Standards. The fence design shall comply wlth the Clty of Seal Beach standards, copies of which are available at the Building Department. I Com I iance With Other Provisions. Plans for such fences must be approved by the Fire Marshal, Traffic Engineer, Planning Director in addition to the Building Official. Section 5504. Pool Fences. Pools to be completely fenced, gates to have latches. Every swimming pool, pond or other body of water eighteen (18") inches or Ordinance Number /~? more in depth at any point shall be surrounded by a fence or wall not 1 ess than six (6') feet in height measured on the exterior side. No such fence or wall shall be constructed and maintained with openings or projections such that a toddler or small child may gain a foothold and climb ever. Openings between vertical members shall not exceed four (4") inches, and the distance between horizontal members, accessible from the exterior, shall not be less than four feet, six inches (4'6"). Fences or walls shall be located a I sufficient distance from any structure, shrubbery or tree, or hillside grade which could be used to assist a child to scale the fence or wall. Gates. and doors opening through such enclosures shall be self-closing and self-latching with release located on the pool side as to prevent rel ease from the exterior. A sel f- latching tumbler lock may be installed so that the gate can be opened from the exterior with a key. Exception: when approved by the Building Official, publlC swimming pools under continuous supervision may be operated with gates or door unlocked. Except for single family residences,the fence and walls shall be so locked as to allow access to all living units without entering the pool enclosure. The fence or walls shall serve to isolate the pool from other activities and the structures and shall be located within fifty (50') feet of the pool. Gates in such enclosures shall be located in view of the pool. A building wall without doors may be used as part of such pool enclosures when within fifty (50') feet of the pool. 'For single family residences, access to the main front door shall not be through the swimming pool enclosure. The swimming pool I enclosure for single family residences may incl ude dwelling walls with windows and doors. (18) Chapter 56 is added to read as follows: "CHAPTER 56 - SECURITY" Section 5601. to set forth resistance to Purpose. The purpose of this chapter is mlnlmum standards of construction for unlawful entry. Section 5602. Scope. The provisions of this chapter sha 11 apply to enclosed Group RI I and J Occupancies regulated by this Code. Groups A, B. C, D, E, F and G should comply with the intent of this chapter. However, other laws, insurance requirements. owner operations and other considerations may provide other security arrangements. Exception: The requirements shall not apply to enClosed Group J Occupancies having no openings to an attached building or which are completely detached. Section 5603. Limitations. No provisions of this I chapter shall requlre deVlces on exit doors contrary to the requirements specified in Chapter 33. Section 5604. Alternate Security Provisions. The provlslons of thlS chapter are not intended to prevent the use of any device or method of construction not specifically prescribed by this Code when such Ordinance Number ~.2~J - " " alternate provides equivalent security approved by the Building Official upon the recommendation of the City Police Official. I Section 5605. Definitions. For the purpose of this chapter, certa1n terms are defined as follows: A. Cylinder guard is an exposed free-turning collar, cast or machined from solid bar, surrounding the exposed portion of the lock cyl inder and is so fastened to completely encase the cylinder. The cylinder guard shall have a minimum taper of fifteen (15) degrees. The cylinder guard shall form the exterior trim of the lock to protect the lock cylinder against wrenching, prying, cutting, or pulling by attack tools. B. 0 e ad 1 0 c kin ~ 1 at chi s a 1 at c h wit ham i n i m um project10n latc bolt of one-half inch (1/2") and is positively held in the projected position by a guard bolt, plunger or auxiliary mechanism. I C. Dead bolt is a bolt with a free-turning, case- hardened steel insert having a minimum projection .of one inch (1" ) which has no automatic spring action and is operated by a key from outside and by a key cylinder, thumbturn, or lever from the inside and is positively held fast in the projected position. D. Wrought box strike is a steel box installed under the str1ke recessed to receive the dead bolt when projected. E. Latch is a device for automatically retaining the door in a closed position upon its closing. F. Li9hdt is a window, or a pane, or compartment of a W1n ow (Chapter 54). Section 5606. Door - General. A door forming a part of the enclosure of a dwell ing unit or of an area occ upi ed by one (1) tenant of a bui ld ing sha 11 be constructed, installed, and secured as set forth in Sections 5606, 5607, 5608, and 5609, when such door is directly reachable or capable of being reached from a street, highway, yard, court, passageway, corridor, balcony, patio, breezeway, private garage portion of the building which is available for use by the public or tenants, or similar area. A door enclosing a private garage with an interior opening leading directly to a dwelling unit shall also comply with said Sections 5606, 5607, 5608 and 5609. I Section 5607. Doors - Swinging Door. A. Swinging wooden doors, able to be opened from the inside without the use of a key and which are either/or hollow core construction or less than 1-3/8 inches in thickness, shall be covered on the inside faces with 16 gauge sheet metal attached with screws at six (6") inch maximum centers around the perimeter or equivalent. Ordi nance Number ~7 , Lights in Joors shall be as set forth in Section 5611 and 5612. B. A single swinging door, the active leaf of a pair of doors, and the bottom leaf of Dutch doors shall be equipped with a key-operated dead bolt lock and a key- operated lock with a dead-locking latch. The dead bolts shall contain a free-turning, case-hardened steel I insert, or equivalent, to repel cutting tool attack. Cyl inder guards shall be installed on all dead locks (mortise or rim type cylinder locks) whenever the cyl ind er proj ects beyond the face of the' door or is otherwise accessible to gripping tools. C. The inactive leaf of a pair of doors and the upper leaf of Dutch doors shall be equipped with a dead bolt as set forth in Subsection B. The dead bolt need not be key operated but shall not be otherwise activated from the exterior side of the door. Exceptions: 1. The bolt or bolts need not be key operated but shall be otherwise activated, from the exterior side of the door. 2. The bolt or bolts may be engaged or disengaged automatically with the dead bolt or by another device on the active leaf or lower leaf. 3. Man ua 11 y operated hardened bolts at the top and bottom of the leaf and which are embedded a minimum of one half (1/2") inch into the device I receiving the projected bolt may be used when not prohibited by Chapter 33 or other laws and regulations. D. Door stops on wooden jambs for in-swinging doors shall be of one piece construction with the jamb or joined by a rabbet. E. Non-removable pins shall be used in pin type hinges which are accessible from the outside when the door is closed. F. Cylinder guards shall be installed on all mortise or rim type cylinder locks installed indoors whenever the cyl inder projected beyond the face of the door or is otherwise accessible to gripping tools. Section 5608. Doors - Sliding Glass Doors. Sliding glass doors shall be equlpped with lOCking devices. Movable panels shall not be rendered easy to open or removable from the frame. Cylinder guards shall be installed on all mortise cylinder projects beyond the fact of the door or is otherwise accessible to gripping tools. I Section 5609. Door - Overhead and Sl iding Doors. Metal or wooden overhead and sl id ing doors shall be secured with a cylinder lock, padlock with a hardened steel shackle metal slide bar, bolt or equivalent when not otherwise locked by electric power operation. Cylinder guards shall be installed on all mortise or rim type cylinder locks installed in hollow metal doors Ordinance Number 1~'7 , \ I whenever the cyl inder projects beyond the face of the door or is otherwise accessible to gripping tools. Section 5610. Doors - Metal Accordion Gate or Grille IYpe Doors. Metal accordion gate or grl11e type doors snall be equipped with metal guides at top and bottom, and a cylinder lock or padlock and hardened steel shackle shall be provided. Cylinder guards shall be installed on all mortise or rill type cylinder locks installed in hollow metal doors whenever the cylinder projects beyond the face of the door or is otherwise accessible to gripping tools. Section 5611. Lights - In General. A window, skylight, or other light forming a part of the enclosure of a dwelling unit or of an area occupied by one tenant of a building shall be constructed, installed and secured as set forth in Sections 5611 and 5612, when the bottom of such window, skylight or light is not, more than sixteen (16') feet above the grade of a street, highway, yard, court, passageway, corridor, balcony, patio, breezeway, private garage, portion of the building which is available for use by the public or other tenants, or similar areas. A window enclosing a private garage with an inter ior open i ng leading directly to a dwelling unit shall also comply with said Sections 5614 and 5615. Section 5612. Lights - Material. Lights within forty (40"} lnches ot a requHed lOCking device on a door when in the closed and locked position and able to be open from the inside without the use of a key and lights with a least a dimension greater than six (6") inches but less than forty-eight (48") inches in F and G Occupancies, shall be fully tempered glass, approved burglary resistant material or guarded by metal bars, screens, or grills in an approved manner. I Section 5613. Lights - Locking Devices. A. Sliding glass windows shall be provided with locking devices. Movable panels shall not be rendered easy to open or removable from the frame. B. Other opening windows shall be provided with substantial locking devices which render the building as secure as the devices required by this section. In Group F and G Occupancies, such devices shall be a glide bar, bolt, cross bar, and/or padlock with hardened steel shackle. I C. Special. Louvered windows, except those above the first story in Group H and I Occupancies which cannot be reached without a ladder, shall be of material or guarded as specified in Section 5611 and individual panes shall be securely fastened by mechanical fasteners requiring a tool for removal and not accessible from the outside when the window is in the closed position. Section 5614. Other Openings - In General. Openings, other than doors or 1 ights, which form a part of the enclosure, or portion thereof, housing a single opening and the bottom of which is not more than sixteen (16') feet above the grade of a street, highway, yard, court, passageway, corridor, balcony, patio, breezeway, or Ordinance Number IolJ, '7 ; similar area", or from a private garage or from a portion of the building which is occupied, used or available for use by the public or other tenants, or an opening enclosing a private garage attached to a dwelling unit which openings therein shall be constructed, installed and secured as set forth in Section 5614. Section 5615. Openings. Hatchways, Scuttlees and Similar A. Wooden hatchways less than 1-3/4 inch thick solid wood shall be covered on the inside with 16 gauge sheet metal with screws at six (6") inch maximum around perimeter. B. The hatchway shall be secured from the inside with a slide bar, slide bolts and/or padlock with a hardened steel shackle. C. Outside pin-type hinges shall be provided with non- removable pins. D. Other openings exceeding ninety-six (96) square inches with the least dimension exceeding eight (8") inches shall be secured by metal bars, screens, or grill, in an approved manner. Section 5-31. Uniform Mechanical Code. 1985 Edition, Amended. 1. Section 304(a) General is amended to read: Fee schedule shall be adopted by resolution of the City Council of the City of Seal Beach. 2. Section 504(g} is added to read: (g) Location of Equipment. Equipment regulated by this Code shall not be located in any required front or side yard as established by the Building Code or zoning ordinances. Section 5-32. Uniform Plumbing Code, 1985 Edition. Amended. The following amendments are made to the Uniform Plumbing Code, 1985 Edition adopted by this Chapter: 1. Section 20.1 - Administrative Authority is hereby amended to read: Whenever the term . Administrative Authority' is used in this Code, it shall be construed to mean the Building Official or his authorized representative. 2. Section 20.3 - Violation and Penalties. Paragraph one is hereby amended to read: Any person, firm or corporation violating any provision of this Code shall be deemed guilty of a misdemeanor and upon conviction thereof, shall be punishable by a fine of not more than five hundred dollars ($500), or by imprisonment for not more than I I I Ordinance Number ~~~ I six (6) months, or both fine and imprisonment. Each separate day or any portion thereof during which a violation of this Code occurs or continues shall be deemed to constitute a separate offense and, upon conviction thereof, shall be punishable as herein provided. The issuance or granting of a permit or approval of plans and specifications shall not be deemed or construed to be a permit for, or an approval of, any violation of any of the provisions of this Code. No permit presuming to give authority to violate or cancel the provisions of this Code shal.l be valid, except insofar as the work or use which it authorized is lawful. 3. Section 20.6 - Application for Permit. The fOllowlng paragraphs are added: I Every permit shall expi re and become null and void for anyone or more of the following reasons: (A) Whenever the plumbing work authorized by said permit is not commenced within one hundred eighty (180) days from the date of issuance of such permit. (B) Whenever the plumbing work authorized by said permit has been suspended, abandoned or discontinued for a continuous period of one hundred eighty (180) days. (C) Whenever the plumbing work done during any continuous period of one hundred eighty (180) days amounts to less than ten percent (IDS) of the total of the work authorized by such permit. Before commencing, proceeding with or doing any plumbing work authorized by, but not done before expiration of, any such permit, a new permit shall be obtained therefor, and the fee for such permit shall be one-half (1/2) the fee required for a new permit; provided that such permit is obtained within one hundred eighty (180) days of expiration of the prior permit . 4. Section 20.7 - Cost of Permit. 'Paragraph two is amended to read: Such appl icant shall pay for each permit, at the time of issuance, as per the latest resolution of the City Council relating to the establishment of a Revised Fee Schedule. I 5. Section 310(b) is added to read: (b) No water, soil, or waste pipe shall be installed or permitted outside of a building or on an exterior wall. The only exception will be the normal installation of hose bib connection and/or clean-out connection. Ordinance Number ;I~j1 , (6) Section 314l!U. is added to read: (d) In existing buildings, no waste, soil, or water pipe shall be installed or permitted on the outside of a building or an exterior wall. Section 5-33. Uniform Swimming Pool Code, 1985 Edition, Amended. The following amendments are made to the Uniform Swimming Pool Code, 1985 Edition adopted by this Chapter. I (1) Section 1.5 - Administrative Authority is hereby amended to read: Whenever the term 'Administrative Authority' is used in this Code, it shall be construed to mean the Building Official or his authorized representative. (2) Section 1.7 - Violations and Penalties. The first sentence 1S amended as follows: Any person, firm or corporation violating any provision of this Code shall be deemed guilty of a mi sdemeanor and upon conviction thereof sha 11 be punishable by a fine of not more than five hundred doll ars ($500) or by imprisonment for not more than six (6) months, or both fine and imprisonment. Each separate day or any portion thereof during which a violation of this Code occurs or continues shall be deemed to constitute a separate offense and, upon 1 conviction thereof, shall be punishable as herein provided. (3) Section 1.11 - Cost of Permit. Paragraph three is amended as follows: Schedule of Fees, as shown, is deleted and will be applicable as per the latest resolution of the City Council relating to the establ ishment of a Revised Fee Schedule to be used with the latest edition of the Uniform Swimming Pool Code. (4) Section 310 - Waste Water Disposal. An additional sentence 1S added to the end of paragraph one to read as follows: The fi lter waste disposal shall discharge into the sanitary sewer only. (5) Chapter 6 - DeSign Requirements is added to read: " DESIGN REQUIREMENTS - CHAPTER 6" Section 601. Each swimming pool shall be designed I by a Civil Engineer licensed to practice in the State of California and each pool shall withstand expansive soil movement, see Section 2904, U.B.C., 1985 Edition. Section 602. Continuous inspection by a special licensed inspector shall be required on all pools Ordinance Number /0261 I constructed of reinforced gunite. Said special inspector sha~l take test samples during the placing of concrete or gunite and such samples shall be tested by an approved testing laboratory to attain a minimum strength of 3000 p.s.1. at twenty-eight (28) days. Should such test show the concrete or gunite to fail or to be questionable in quality or strength, the special inspector may require core tests to be taken upon approval of the Building Official. Special inspectors shall submit to the Building and Safety Department a written report showing the dates of inspection, and the result of the laboratory tests. Section 603. Sand Under Pool Decking. A sand or crushed rock (m1n1mum depth four (4") 1nches) shall be required under all pool decking and under concrete slabs adjacent to swimming pools. Section 604. Deck Drainage. Decking placed around any sW1mm1ng pool shall be constructed so that overflow or splash water will drain to an approved deck drainage system and/or to the nearest practicable drainage way or street as approved by the Building Official as a safe place to deposit such waters. Provision shall be made so that no such drainage will run off on adjoining property. The deck shall slope away from a building structure, dwelling and/or auxiliary building. Section 605. All electrical work shall be required as set forth in the National Electrical Code. I Section 5-34. AmenOeO. Uniform Housing Code, 1985 Edition. I The following amendments are made to the Uniform Housing Code, 1985 Edition, adopted by this Chapter: (1) Chapter 2 is hereby amended by adding thereto the following sections: Section 201(a). Authority. The Building Official and the Heartn Off1cer are hereby authorized and directed to administer and enforce all of the provisions of this Code. For such purposes, they shall have the powers of a law enforcement officer. He is empowered to adopt and enforce rules and regulations to cl arify and expand the provisions of thi s Code in conformity with the spirit and intent of its stated purpose. Section 201 b . ma e an 1nspec of this Code, or whenever the Building Official, the Health Officer, or their authorized representatives have reasonable cause to believe that there exists in any building or upon any premises any condition which makes such building or premises sub-standard, as defined in Section H-202 of this Code, the Bui ld ing Official, the Health Officer, or their authorized representatives may enter such building or premises at all reasonable times to inspect the same or to perform any duty imposed upon the Building Official or the Health Officer by this Code; provided that, if such building or premises be occupied, they shall first present proper credentials and request entry; and if such building or premi ses be unoccupied, they shall first make a reasonable effort to locate the owner or Ordinance Number /.2b7 . other persons having charge or control of the building or premises and request entry. If such entry is refused, the Building Official, the Health Officer or their authorized representatives shall have recourse to every remedy provided by law to secure entry. No owner or occupant or any other person having charge, care or control of any building or premises shall fail to neglect, after proper request is made as herein provided, to promptly permit entry ther"ein by the Building Official, the Health Officer or their authorized representatives for the purpose of inspection and examination pursuant to this Code. Any person violating this sub-division shall be guilty of a misdemeanor. I Section 5-35. Uniform Fire Code, 1985 Edition, Amended. The following amendments are added to the Uniform Fire Code, 1985 Edition, adopted by this Chapter: (1) Section 3.101 is hereby amended by adding thereto the fOllowlng: Any person, fi rm or corporation violating any of the provisions of this Code, except as noted, shall be deemed guilty of a misdemeanor and each such person shall be deemed gu ilty of a separate offense for each and every day or portion thereof during which any I violation of any of the provisions of this Code is committed, continued or permitted; and upon conviction of any such violation, such person shall be punished by fine of not more than five hundred dollars ($500) or by imprisonment for not more than six (6) months, or by both such fine and imprisonment. (2) Article 9, Section 9.105(c:l of said Fire Code is amended to lnclude the following: (A) Whenever the term' corporation counsel' is used in the Uniform Fire Code, it shall mean the City Attorney of the City of Seal Beach. (B) Whenever the words 'Chief of the Bureau of Fire Prevention' are used in the Uniform Fire Code, it shall mean the Fire Marshal. (C) Clear Passageways. In all occupancies where checkout stands or other similar undersize openings are used, there sha 11 be" prov ided adj acent thereto: a clear passageway or opening to such exit or exits as determined by the occupant load exiting requirements of I the Uniform Building Code of the City of Seal Beach. At no time shall such exit or passageway be obstructed in any manner. Ordinance Number 1:261 . I (3) Section 9.115(.!!!.l is. amended to include the followlng: Whenever the wording 'municipality' is used in the Uniform Fire Code, it shall mean the City of Seal Beach. (4) Section 10.206 of said Fire Code is hereby amended to read as follows: Section 10.206. No person shall place or keep any post, fence, vehicle, growth, trash, storage or other material or thing near any fire hydrant, fire department connection, or fire protection system control valve that would prevent such equipment or hydrant from being immediately discernible or in any other manner deter or hinder the Fire Department from gaining immediate access to said equipment or hydrant. A minimum three (3) foot clear space shall be maintained around the circumference of the fire hydrant except as otherwise required or approved by the Chief. Any person violating this section shall be guilty of an infraction. I (5) Section 10.207 of said Fire Code is hereby amended by addlng Sectlons 207(m) and (n): (m) Fire Lanes, Accessways, and Roadways. Parking Prohibited. No person shall park any vehicle or place any object in any fire lane, clearly designated as such NO PARKING signs and/or other appropriate notice, or park or place any object, obstruction or vehicle in, on or across an established or designated exit, driveway, alleyway or access road, whether public or private, in such manner as to hamper the movement of any emergency vehicles and equipment in the event of fire or other emergency. This prohibition applies to, but is not 1 imited to, areas in and about any church, hospital, assembly hall, lodge hall, school, hotel, motel, condominium, apartment building, theater, industrial complex, motion picture theater, stadium, shopping center, restaurant, tent, or other place of public assembly, whether open or closed. Any vehicle parked or any object placed in a fire lane or any of the aforementioned areas shall be subject to an in fractional citation and/or immediate removal and storage pursuant to law. (n) The provisions of this section may be enforced by the local law enforcement agency and/or Fire Department. I (6) Section 10.208 of said Fire Code is hereby amended as follows: Street numbers shall be placed on both the front and rear of those buildings determined by the Fire Chief to require such. Numbers are to be maintained in such a manner as to be plainly visible, easily read, and not hidden from view by trees, shrubs, bushes and other . Ordinance Number ;I~1 / , . obstructions on the property, with a contrasting color from the background. The location of the numbers is subject to the approval of the Fire Chief. (7) Section 10.306 of the Uniform Fire Code is hereby amended by adding subsections (f). (g), (h), (i) and (j) to read as follows: (f) Fire Warning Systems (1) Every existing dwelling unit with1n an an apartment house and every existing guest room in a hotel or lodging house used for sleeping purposes shall be provided with State Fire Marshal approved smoke detectors. In dwelling units, detectors sha 11 be mounted on the ceil ing or wall at a point centrally located in the corridor or area giving aCcess to rooms used for sleeping purposes. In an efficiency dwelling unit, hotel sleeping rooms, and in hotel suites, the detector shall be centrally located on the ceiling of the main room or hotel sleeping room. Where sleeping rooms are on an upper level, the detector shall be placed at the center of the ceiling directly above the interior stairway. All detectors shall be located in accordance with approved manufacturer's instructions. When actuated, the detector shall provide an alarm in the dwelling unit or guest room. I (2) Smoke detectors may be battery oper'ated when I installed in existing buildings, or in buildings without commercial power. (g) Installation and Maintenance It shall be the responsibility of the owner to supply, install and maintain all required smoke detectors. The owner shall be responsible for annually testing all required smoke detectors and maintaining a written record of such tests. The owner shall be responsible for providing each tenant with written information regarding detector testing and maintenance, and such information shall be posted in common areas frequently visited by tenants such as laundry room areas or bulletin board, if one is maintained. It shall be the responsibility of the tenant to immediately notify the owner or representative when indication of a need for maintenance of detector( s) exist. (h) Inspections An inspection for compliance may be done I concurrent with other fire prevention inspections at apartment houses, efficiency units and hotels. Inspection for compliance may be done in accordance with a sampling plan approved by the Fire Chief. (i) When there is a change in ownership in existing Group R, Division 3 Occupancies, the ) Ordianance Number /c2h1 . \ \. - . entire building shall be provided with smoke detectors located as required for new Group R, Division 3 Occupancies as required in the Uniform Buildir.g Code, 1982 Edition. - (i) In all existing Group Occupancies, the entir~ building with smoke detectors located as Group R, Division 1 Occupancies. R, Oivision 1 shall be provided required for new I (8) Section 10.308l!l of said Fire Code is amended by add 1ng: (A) Approved automatic fire extinguishing systems shall be installed and maintained in operable condition as specified in this section in (the following) locations. (B) All Occupancies Except Group R, Division 3 and Group M. Except for Group R, Division 3 and Group M Occupancies an automatic sprinkler system shall be installed: (5) In all new buildings or structures when the gross square footage thereof exceeds 6 , 000 s qua ref e e tor m 0 r e t h ant wo (2) stories in height regardless of area separation walls. (6) Throughout all drinking or dining establishments having an occupant load in excess of 150. I (7) Throughout all A-I through A-4 occupancies having a stage or enclosed platform. (8) Throughout all structures having A-I through A-4 occupancy with an occupant load of more than fifty (50) above the first story. (9) Throughout all new R-1 occupancies, including enclosed garages. on any project with 15 units or greater. (10) In all cases set forth above, the respective increases for area and height specified in Sections 506 and 507 of the Uniform Building Code shall be permitted. (9) Section 10.310, Subsection 2 of said Fire Code is hereby amended to read as follows: I Section 10.310 2. Sprinklers shall not be installed when the app11cation of water or flame and water to the contents may constitute a serious life or fire hazard. The high-rise requirements set forth in the Uniform Building Code, Secticn 1807, and Title 24, Section 2-1807, shall apply to all buildings having floors used for human occupancy located more than fifty-five (55') feet above the lowest floor level I having building access. (11) Section 61.106lli of said Fire Code is amended to read as follows: Section 61.106(c) - Where Permitted. The use of listed portable unvented 011 burning heating appliances sha 11 be 1 imited to supplemental heating in Groups B and M Occupancies. Except ion: Upon approval of the Chief, portable unvented oil burning heating appl iances may be permitted in any occupancy during the construction process when such use is necessary for the construction and the use does not represent a hazard to life or property. (12) Section 79.910l!!lZ. of said Fire Code is amended to include natural gas. 7. L iquified petrol eum gas and 1 iquified or compressed natural gas cy1 inders shall not be I 'filled or discharged at any petroleum marine service station without first obtaining written permission from the Chief. Approved storage facilities for gas cylinders shall be provided. (13) Section 79.1206U!.l. of said Fire Code is added to read as follows: Section 79.1206(d). Any vehicle parked in violation of Sectlons 79.1~06(a) or (b) shall be subject to an infraction citation. Section 5-36. Uniform Solar Energy Code, 1985 Edition, Amended. Section 5-37. National Electrical Code, 1987 Edition, Amended. (2) Section 90-4 is hereby amended to add the followlng paragraphs: The Build ing Official of the City of Seal Beach is hereby designated as the enforcing authority and vested with the authority to enforce all of the provisions of this Code and shall have the right to enter upon any premises at all reasonable hours for the purpose of inspecting the installation and working of all apparatus coming within the terms of this Article. No person shall interfere with the Building Official in making the inspection, or refuse to permit the Building Official or his deputies to enter the premises for such purposes; provided that if such building or premises is occupied, the Building Official shall first present proper credential sand dem'and entry ; and if such building or premises is unoccupied, the Building Official shall first make a reasonable effort to locate Ordinance Number /:u, 1 . I the owner or other persons having charge or control for the bui ld ing or premi ses and demand entry. If such entry is refused, the Building Official or his authorized representative shall have recourse to every remedy provided by law to secure entry. At least one (1) wall switch controlled 11ght1ng outlet shall be installed in every habitable room and in ha 11 ways, sta irways, garages, carports and at outdoor entrances. At 1 east one (1) lighting outlet shall be installed in attic, under floor space, utility area and basement where used for storage or containing equipment requiring servicing. in S ecial ccupanc1es w1th one thousand (1000) square feet of floor area or less, containing not more than two (2) bedrooms having no natural gas fired appliances, having no fixed window security guards, and provided with a private security system for the community. In addition,this section I shall apply only to planned adult communities, constructed prior to 1966 in which each individual dwelling unit is equipped with an approved smoke "detector device: 1. Patio Covers. Patio covers may be constructed that are open on one (1) side only. Said side may be provided with decorative pierced concrete block which is approximately fifty percent (50:1:) open and unobstructed. (Section 4901, amends Uniform Building Code, 1985 Edition). 2. Exit Facilities. Every sleeping room need not be provided w1th w1ndowed or exterior door approved for emergency exit or rescue, provided a permanently mounted approved smoke detection device be installed with the dwelling unit. (Amends Uniform Building Code, 1985 Edition, Section 1204). 3. " Light and Ventilation. In 1 feu of natural 1 ight and ventilation a mechanical ventilation system may be substituted that shall be capable of providing two (2) air changes per hour in all habitable rooms, and in rooms used for sleeping. One fifth (1/5) of the air I supply sha 11 be ta ken from outside of the dwell ing. (Amends Uniform Building Code, 1985 Edition, Section 1205(a)). 4.
