Home My WebLink AboutCC Ord 1269 1988-02-16 I I I , ORDINANCE NUMBER /Z. ~g AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING CHAPTER 22, ARTICLE VIII OF THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA, RElATING 'l'O THE UTILITY USERS TAX THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. section 22-60 of Article VIII, Chapter 22 of the Code of the City of Seal Beach is hereby amended by addinq thereto the following subparaqraphs: ' n(d) "Service supplier" means any person required to collect and remit a tax imposed by this article." "(e) "Coqeneration technoloqyn means the use for the qeneration of electricity of exhaust steam, waste steam, heat, or resultant energy from an industrial, commercial or manufacturinq plant or process, or the use of exhaust steam, waste steam, or heat from a thermal powerplant for an industrial, commercial, or manufacturinq plant or process." Section 2. Subparaqraph (c) of Section 22-62 of Article VIII, Chapter 22 of the Code of the City of Seal Beach is hereby amended in its entirety to read as follows: "(c) The tax imposed by this section shall be collected from the service user by the person providinq the intrastate telephone communication services. The amount of tax collected in one month shall be remitted to the Director of Finance and shall be due on or before the twentieth day of the followinq month. If remitted by mail, such remittance shall be postmarked on or before the twentieth day of the followinq month; provided, however, that if the twentieth day falls on a weekend or leqal holiday, and the remittance is made by mail, the remittance shall be postmarked as of the first business day followinq such weekend or leqal hOliday." Section 3. Subparaqraph (b) of Section 22-63 of Article VIII, Chapter 22 of the Code of the City of S~al Beach is hereby amended by addinq thereto, at the end thereof, the followinq sentence: "The term "usinq electrical enerqy" shall be construed as including a person usinq or purchasing power produced by coqeneration technoloqy or by other than a conventional power source for the qeneration of electricity." section 4. Article VIII, Chapter hereby amended in its Subparagraph (c) of Section 22-63 of 22 of the Code of the City of Seal Beach is entirety to read as follows: "(c) The tax imposed by this section shall be collected from the service user by the person supplying such energy. The amount of tax collected in one month shall be remitted to the Director of Finance and shall be due on or before the twentieth day of the following month. If remitted by mail, such remittance shall be postmarked on or before the twentieth day of the following month; provided, however, that if the twentieth day falls on a weekend or legal holiday, and the remittance is made by mail, the remittance shall be postmarked as of the first business day following such weekend or legal holiday." Section 5. Subparagraph (c) of section 22-64 of Article VIII, Chapter 22 of the Code of the City of Seal Beach is hereby amended in its entirety to read as follows: "(c) The tax imposed by this section shall be collected from the service user by the person selling the gas. The amount of tax collected in one month shall be remitted to the Director of Finance and shall be due on or before the twentieth day of the following month. If remitted by mail, such remittance shall be postmarked on or before the twentieth day of the following month; provided, however, that if the twentieth day falls on a weekend or legal holiday, and the remittance is made by mail, the remittance shall be postmarked as of the first business day following such weekend or legal holiday." section 6. The city Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law and the same shall take effect as provided by law.
