Home My WebLink AboutCC Ord 1272 1988-04-18 ORDINANCE NO. /;l1~ AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING CHAPTER 16B OF THE CODE OF THE CITY OF SEAL BEACH RELATING TO PIPELINE FRANCHISES THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN II AS FOLLOWS: Section 1. Subparagraph 2 of paragraph B of section 16B-30 of Article II, Chapter 16B of the Code of the City of Seal Beach, California is hereby amended as follows: "2. A base annual fee shall be paid within one hundred five (105) days after the end of each calendar year and during the life of the franchise for each and every year, including the year of granting the franchise, according to the "franchise payment period" as defined in this ordinance, in whichever of the following amounts is greater: I (a) Four percent (4%) of the gross annual receipts of the franchisee arising from the use, operation or possession of the franchise: or (b) Where the franchise demonstrates, to the satisfaction of the City Engineer, that (i) the franchise involves only gather- ing lines; (ii) no revenues or proceeds are derived from the use, operation or possession of such gathering lines: and I (iii) the gathering lines are used in extracting oil, gas or other minerals I I I Ordinance Number /,:2702- . from state-owned tidelands or submerged lands pursuant to a lease approved by the California state Lands Commission: four percent (4%) of the annual royalty paid by the lessee-franchisee to the state of California pursuant to such lease. As used herein, "gathering lines" shall mean pipelines which are internal to extraction operations and which transport oil, gas or other sub- stances from an offshore drillsite to a separation or transportation facility, or to a transmission line or main; or" Section 2. Subsection (b) of subparagraph 2 of para- graph B of Section 16B-30 of Article II, Chapter 16B of the Code of the City of Seal Beach, California is hereby redesignated as subsection "(c)". Section 3. The City Clerk shall certify to the passage of this ordinance and cause the same to be pUblished as required by law and the same shall take effect as provided by law.
