Section 28-2613 of the Code of the City of Seal Beach, California is hereby amended to read: Section 28-2613. Modifications to be referred to the Planning Commission. If the City Council proposes any substantial modifications to the recommen- dations of the Planning Commission, which modifications were not previously considered by the Planning Commission during its hearings, such modifica- tions shall first be referred to the Planning Commission for its recommendation, The failure of the Planning Commission to report within 45 calendar days after the reference, or within the time set by the legislative body, shall be deemed a recommendation for approval. Section 2. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law and the same shall take effect as provided by law.
