Home My WebLink AboutCC Ord 1212 1986-02-10 ORDINANCE NUMBER J';2J'~ I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH APPROVING ZONE CHANGE 1-85, A REQUEST TO CHANGE THE ZONING DESIGNATION OF THE 2.74 ACRE STATE LANDS PARCEL FROM C-l (SERVICE COMMERCIAL) TO S.P.R, (SPECIFIC PLAN REGULATION) ZONE AND TO AMEND THE ZONING MAP ACCORDINGLY WHEREAS, the subject property is the 2,74 acre parcel of land located at the northeast corner of Pacific Coast Highway and First - --, Street, as set forth in Exhibit "AM attached hereto; and the property is legally described as parcel I, 2, and 3 of State owned land, described in Book 9272, page 219 of the Official Records of Orange County; and WHEREAS, the property is presently undeveloped and located in the C-l (Service Commercial) zone; and WHEREAS, I WHEREAS, on August 22, 1983, the City Council adopted Zoning Text Amendment 5-83 by adoption of Ordinance Number 1154, an Ordinance clarifying that a specific plan supercedes base zoning provisions, After action on the Ordinance and the adoption of the State Lands Specific Plan which followed, the Council unanimously directed staff and the Planning Commission to study and develop regulations for specific plans; and WHEREAS, on September 7, 1983, the Planning Commission, pursuant to City Council direction, held a public hearing with staff presenting a survey of the use of specific plans by ten cities, along with a proposed specific plan provision ordinance. After discussion, the members present unanimously moved that the proposed Ordinance be presented to the City Council for their comments and recommendations and that staff notice a public hearing for the first Council meeting in October; and I WHEREAS, on November 19, 1984, the City Council adopted Ordinance Number 1171 establishing a moratorium on certain land use approvals and permits related to the subject property and declaring the urgency thereof; and WHEREAS, on April 3, 1985, the Planning Commission reviewed the proposed revisions, amendments and additions to the City of Seal Beach State Lands Specific Plan prepared by staff pursuant to City Council direction on November 19, 1984; and WHEREAS, on September 23, 1985, the City Council, upon receipt of the Planning Commission's recommendations, adopted Ordinance Number 1193, "AN ORDINANCE OF THE CITY OF SEAL BEACH ESTABLISHING A SPECIFIC PLAN REGULATION ZONE AND SPECIFIC PLAN PROCEDURES;" and WHEREAS, the current request is for the amendment of the Zoning Map of the City of Seal Beach for the subject property from C-l (Service Commercial) Zone to the newly effective Specific Plan Regulation (SPR) Zone; and WHEREAS, the proposed zone change would not adversely affect the General Plan; and Ordinance Number /.2/.2. WHEREAS, the proposed zone change would have no significant impact upon the environment, as outlined in Negative Declaration 11-85; and WHEREAS, on December 4, 1985, the Planning Commission held a public hearing on Zone Change 1-85 and unanimously moved to approve Negative Declaration 11-85 and Zone Change 1-85 and recommended I approval to the City Council (Resolution Number 1399); and WHEREAS, on January 27, 1986, the City Council held a public hearing on Zone Change 1-85, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. The City Clerk is hereby directed to amend the Official Zoning Map of the City of Seal Beach to reflect the changes set forth herein. Secti on 2.
