Home My WebLink AboutCC Ord 1222 1986-04-14 ORDINANCE NUMBER ~~~ I AN ORDINANCE OF THE CITY OF SEAL BEACH EXTENDING THE MORATORIUM ON THE GRANTING OF CONDITIONAL USE PERMITS FOR ON-SITE AND OFF-SITE LIQUOR ESTABLISHMENTS AND DECLARING THE URGENCY THEREOF III THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. Ordinance Number 1214 of the City-of Seal Beach is hereby readopted and extended for a period of 120 days. Section 2. The City of Seal Beach hereby declares a moratorium on the granting of Conditional Use Permits for on-site and off-site liquor establishments. Such moratorium shall not apply to the renewal of existing Conditional Use Permits for on-site or off-site liquor establishments. Section 3. Notwithstanding any other Ordinance or Code of the City of Seal Beach, no Conditional Use Permit for on-site or off-site liquor establishments shall be granted nor shall any applications thereof be accepted for filing or processing. Section 4, On March 19, 1986 the Planning Commission held a scheduled matter on the issuance of Conditional Use Permits for on-site and off-site liquor establishments. After discussion the Planning Commission then moved to recommend that the City Council extend the moratorium and authorize the Planning Commission and staff to develop appropriate materials and hold public hearings and study sessions. A special study session on this matter has been tentatively scheduled for April 23, 1986. Section 5. The City of Seal Beach is presently considering the adoption of new regulations pertaining to on-site and off-site liquor establishments to better protect the public health, safety, and general welfare. The establishment of such uses that conflict with the new regulations would be highly detrimental to the welfare of the community and would undermine the effectiveness of the new regulations if such regulations are adopted. In the absence of the immediate effectiveness of this Ordinance, new liquor establishments are likely to commence operation in a manner that may conflict with the proposed regulations, Due to the foregoing circumstances, there is a current and immediate threat to the public health, safety and general welfare from the approval of any Conditional Use Permits for new on-site or off-site liquor establishments under the existing Zoning Ordinance, Therefore, it is necessary for the immediate preservation of public peace, health, safety, and welfare that this Ordinance take effect immediately. This Ordinance is an interim Ordinance and shall expire 120 days after the expiration of Ordinance Number 1214. I PASSED, APP.
