Home My WebLink AboutCC Ord 1232 1986-12-24 ORDINANCE NUMBER /..23~ AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AMENDING CHAPTER 15, ENTITLED "OFFENSES - MISCELLANEOUS," OF THE SEAL BEACH MUNICIPAL CODE I THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 15-1 of Chapter 15 of the Code of the City of Seal Beach is hereby amended in its entirety to read as follows: "Sec. 15-1. Alcoholic Beverages - Possession or Consumption in Public. It is hereby declared to be unlawful for any person to possess an open alcoholic beverage container or to consume any alcoholic beverage, as the same is defined by the Alcoholic Beverage Control Act of the state, in or upon any public place within the City open or dedicated to public use, including without limitation the public beach, pier, parks or parking facilities adjacent thereto. The provisions of this section shall not prohibit the possession or consumption of alcoholic beverages (a) at premises licensed by the State Board of Equalization under the Alcoholic Beverage Control Act of the state for the sale and consumption on such premises of alcoholic beverages, or (b) at any E~ecial event conducted in or upon any public place pursuant to a permit duly issued by the City Manager and for which a temporary license or permit has been duly issued by the Department of Alcoholic Beverage Control." I Section 2. A new Section 15-1.1 is hereby added to the Code of the City of Seal Beach to read in its entirety as follows: "Sec. 15-1.1. Glass Beverage Containers Prohibited in Certain Areas. It is hereby declared to be unlawful for any person to consume any beverage from, or to possess, or to use, any beverage container made of glass, including without limitation a bottle, cup, tumbler, jar, vial, flask, decanter, carafe, pitcher, cruet, jug or similar vessel or receptacle, in or upon the public beach, pie~ parks or parking facilities adjacent thereto." Section 3. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law and the same shall take effect as provided by law.
