Home My WebLink AboutCC Ord 1181 1985-04-08 ORDINANCE NUMBER "I'~/ AN ORDINANCE OF THE CITY OF SEAL BEACH ESTABLISHING A MORATORIUM ON THE ERECTION OF NEW OR THE MODIFICATION OF EXISTING SATELLITE DISH ANTENNAE IN THE CITY AND DECLARING THE URGENCY THEREOF THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN: I Section 1. The City of Seal Beach hereby declares a moratorium on the granting or issuance of conditional use permits, variances. building permits, or any other permits or entitlements for use for the erection, placement, or establishment of new satellite dish antenna or the expansion, alteration, or modifications of existing satellite dish antenna in the City of Seal Beach. For the purpose of this Ordinance, the term "Satellite Dish Antenna" shall mean any dish-shaped antenna designed to receive satellite signals for the purpose of television or radio reception or any other similar type of communication. Section 2. Notwithstanding any other ordinance or code of the City of Seal Beach, no conditional use permit. variance, building permit or other permit or entitlement for use for the erection, placement or establishment of a new satellite dish antenna or the expansion. alteration or modification of an existing satellite dish antenna shall be granted or issued nor shall any applications therefore be accepted for filing or processed. I Section 3. The moratorium or limitation provided for in Section 2 hereof shall not be applicable to any of the following: a. Reconstruction of a lawfully existing satellite dish antenna which has been damaged or destroyed by fire or other calamity provided that such reconstruction fully complies with all existing requirements of the City of Seal Beach. California. b. The modification of an existing satellite dish used for industrial purposes located in the light manufacturing (M-1) Zone. Section 4. The City is presently considering the adoption of satellite dish antenna regulations to improve the aesthetic quality of the community and to better protect the public health. safety and general welfare. The erection of new satellite dish antennas or modification of existing satellite dish antennas that conflict with the new regulations would be highly detrimental to the welfare of the community and would undermine the effectiveness of the new regulations. In the absence of the immediate effectiveness of this Ordinance, new satellite dish antennas are likely to be erected and existing satellite dish antennas are likely to be modified in a manner that would conflict with the proposed satellite dish antenna regulations. Due to the foregoing circumstances, there is a threat to the public health, safety and general welfare from the approval of any condtiiona1 use permits. variances. building permits, or other applicable entitlements for use for new satellite dish antennas I Ordi nance tlumher //81' I or the modification of existing satellite dish antennas under the existing Municipal Code. Therefore, it is necessary for the immediate preservation of public peace. health, safety, and welfare that this Ordinance take effect immediately. This Ordinance is an interim Ordinance and shall expire forty-five (45) days after adoption thereof unless further extended by the City Council of the City of Seal Beach. Section 5. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law and the same shall take effect as provided by law.
