REGARDING UNIFORM TRANSIENT OCCUPANCY TAX THE CITY COUNCIL OF THE CITY OF SEAL BEACH OOES HEREBY ORDAIN: I Section 1. The Code of the City of Seal Beach, California, is hereby amended by amending Chapter 22, Article IV, Section 22-24 Definitions, Transient. to read: Transient. Any person who exercises occupancy or is entitled to occupancy by reason of concession, permit, right of access, license or other agreement for a period of thirty consecutive calendar days or less. counting portions of calendar days as full days. Any such person so occupying space in a hotel shall be deemed to be a transient until the period of thirty days has expired unless there is an agreement in writing between the operator and the occupant providing for s longer period of occupancy. In determining whether a person is a transient, uninterrupted periods of time extending both prior and subsequent to the effective dste of this article may be considered. Section 2. The Code of the City of Seal Beach, California is . hereby amended by amending Chapter 22, Article IV. Section 22-25 Imposition; amount; where payable to read: Section 22-25. Imposition; amount; where payable. I For the privilege of occupancy in any hotel, each transient is subject to and shall pay a tax in the amount of seven percent of the rent charged by the operator. Such tax constitutes a debt owed by the transient to the City which is distinguished only by payment to the operator or to the City. The transient shall pay the tax to the operator of the hotel at the time the rent is paid. If the rent is paid in installments, a proportionate share of the tax shall be paid with each installment. The unpaid tax shall be due upon the transient's ceasing to occupy space in the hotel. If, for any reason the tax due is not paid to the operator of the hotel, the tax administrator may require that such tax shall be paid directly to the tax administrator. Section 3. The Code of the City of Seal Beach, California is hereby amended by amending Chapter 22, Article IV, Section 22-25.1 Liability of person subletting room. to read: Section 22-25.1. Liability of person sublettinR room. I In the event that an agreement exists between the hotel and any person for occupancy, as hereinbefore defined, for a period in excess of thirty (30) days and in the event that such person allows occupancy by another person as subtenant, guest, licensee or permittee, the person who has made the agreement with the hotel as aforesaid shall be subject to and shall pay the tax provided for herein. Ordinance Number /1'8.2. Section 4. The Code of the City of Seal Beach. California is hereby amended by deleting Chapter 22. Article IV, Section 22-36 Utilization of Revenue; where tax deposited and renumbering each succeeding section accordingly. Section 5. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law and the same shall take effect as provided by law. I PASSED.
