Home My WebLink AboutCC Ord 1199 1985-11-25 ORDINANCE NUMBER I'I~ AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING CHAPTER 22 OF THE CODE OF THE CITY OF SEAL BEACH CONCERNING REFUNDS OF UTILITY USER TAXES THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Section 22-72 of Chapter 22, Article VIII is hereby amended by the addition of sub-section (d) to read as follows: Notwithstanding other provisions of this section, whenever a service supplier, pursuant to an order of the California Public Utilities Commission or a court of competent juris- diction, makes refund to service users of charges for past utility services, the taxes paid pursuant to this Code on the amount of such refunded charges shall also be refunded to service users, and the service supplier shall be entitled to claim a credit for such refunded taxes against the amount of tax which is due upon the next monthly returns. In'the event this Code is repealed, the amounts of any refundable taxes will be borne by the City. Section 2. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law and the same shall take effect as provided by law.
