ARTICLE 23 OF THE SEAL BEACH MUNICIPAL CODE RELATING TO BUILDING HEIGHT LIMITS THE CITY COUNCIL OF THE CITY, OF SEAL BEACH DOES HEREBY ORDAIN: Section 1. Chapter 28, Article 23, General Provisions. Conditions and Exceptions, Yards. Height, Area. Open Space and Bulk is hereby amended to read as follows: Section 28-2317. Building Height Limits (2) Measurement: The height of a structure shall be measured vertically from the average level of the highest and lowest elevation of the ground covered by the structure to the highest point of the structure or to the peak of a gable, pitched. monsard or hipped roof or to the finished roofline of a flat roof or top of a parapet required by Uniform Building Code. (3) Exceptions: Those listed as follows may be erected to a maximum height as follows: A. Chimneys - Two feet above roofline as per Uniform Building Code. B. Flagpole - Up to 20 feet (10 feet above roofline maximum). C. Antennae - Up to 10 feet above roofline. Ground antennae to a maximum of 40 feet if located in the rear yard adjacent to the main structure. D. Covered or uncovered stairwells to an open roof deck. The covered area is specifically limited to that area required to shelter the stairwell. (4) Minor Height Variation for Non-Habitable Architectural Features: A. Scope: Non-Habitable architectural features, such as spires. towers, cupolas. belfries. monuments. parapets (not required by Uniform Building Code) and domes may exceed the height limit established for the district in which such structure is located to a maximum of 7 feet if granted pursuant to the procedures contained in this section. B. Procedure: (1) Any person desiring to apply for a Minor Height Variation Permit shall complete and fill out and submit an application. required plans and property owners list to the Director of Planning together with payment of the minor plan review fee 14 days prior to the Planning Commission meeting. Ordinance Number I'l'dGi9 (2) Notice of the application for a minor height variation shall be given to all property owners within 300 feet of the exterior boundaries of the property. C. Revi ew: (1) The Planning Commission shall approve such application, subject to any conditions deemed appropriate, if it makes the following findings: (a) (b) (c) Such variation is appropriate for the architectural style of the building. Such variation is appropriate for the character and integrity of the neighborhood. Such variation does not significantly impair the primary view from any property located within 300 feet. I (2) The decision of the Planning Commission may be appealed to the City Council, which. in order to grant a permi~ must determine that the findings set forth in this section have been met by the applicant. (3) Anyone appealing a decision of the Planning Commission must file a written request, together with the appeal fee within 10 calendar days after the decision is made. Section 2. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law and the same shall take effect as provided by law.
