HomeMy WebLinkAboutCC Ord 1170 1984-07-30 ORDINANCE NUMBER 1170 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA, ESTABLISHING THE CITY OF SEAL BEACH BIXBY OLD RANCH BUSINESS PARK SPECIFIC PLAN III THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN: WHEREAS, in October, 1973, the City Council adopted a Land Use Element to the General Plan; and WHEREAS, the Land Use Element recommends that specific plans be,prepared as an implementing measure to the General Plan; and III WHEREAS, the City of Seal Beach Bixby Old Ranch Business Park Specific Plan dated July, 1984 includes detailed regulations, conditions and programs to develop the subject property; and WHEREAS, a Draft Environmental Impact Report was prepared for the City of Seal Beach Bixby Old Ranch Business Park Specific Plan; and WHEREAS, the Environmental Quality Control Board held a public hearing on the Draft Environmental Impact Report on October 20, 1983; and WHEREAS, the Planning Commission held public hearings on the City of Seal Beach Bixby Old Ranch Business Park Specific Plan on December 7, 1983 and January lB, 1984; and WHEREAS, the City Council held a public hearing on the City of Seal Beach Bixby Old Ranch Business Park Specific Plan on July 9 1984; and WHEREAS, on July 9, 1984, the City Council moved to certify the City of Seal Beach Bixby Old Ranch Business Park Final Environmental Impact Report. NOW, THEREFORE, the City Council of the City of Seal Beach, California, does hereby ordain as follows: Section 1. The City of Seal Beach Bixby Old Ranch Business Park Specific Plan is hereby adopted as set forth in Exhibit A hereto, which is incorporated herein by this reference. Section 2. The City Clerk shall certify to the passage of this ordinance and cause the same to be published as required by law and the same shall take effect as provided by law. I I I I I I '. , ' Ordinance Number //10 CITY OF SEAL BEACH SPECIFIC PLAN FOR BIXBY OLD RANCH BUSINESS PARK Revised, July 23, 1984 SECTION A: INTRODUCTION 1. AUTHORITY AND SCOPE The adoption of the City of Seal Beach Bixby Old Ranch Business Park Specific Plan by the City of Seal Beach is authorized by the following: a. Title 7, Division 1, Chapter 3, Articles 8 and 9 of the California Government Code (Section 65450 et. seq.). Pursuant to these provisions, the Planning Commission may, or shall if so directed by the City Council, prepare Specific Plans based on the General Plan and drafts of such regulations, programs and legislation as may, in the judgment of the Planning Commission, be required for the systematic execution of the General Plan. Such a Specific Plan may include all detailed regulations, conditions, programs and proposed legislation which may be necessary or convenient for the systematic implementation of each element of the General Plan. 2. PURPOSE AND INTENT The City of Seal Beach Bixby Old Ranch Business Park Specific Plan is prepared to provide for the classification and development of portions of parcels of land as a coordinated comprehensive project so as to take advantage of the superior environment which can result from integrated community planning. The concepts, regulations and conditions established by the Specific Plan are intended to provide for commercial land uses and development standards created specifically for selected portions of the property. The Specific Plan functions as both a ministerial and regulatory document in providing for the systematic means of executing the General Plan of the City of Seal Beach. The Specific Plan provides the opportunity to combine the concepts, procedur~s and regulations of numerous documents into one. The Specific Plan, when adopted by Ordinance, establishes the type, location, intensity and character of development to take place, while providing for creative and imaginative community design concepts which are preferred in dealing with unique site conditions. A1terna~ive zoning regulations, development standards and other regulations have been incorporated into the Specific Plan in return for increased development sensitivity and community amenities to serve the present and future residents of the City of Seal Beach. 3. LOCATION The City of Seal Beach Bixby Old Ranch Business Park Specific Plan applies only to that property cited in the precise legal description in Appendix 1. The conceptual land use development plan (Exhibit A) is the map indicating the proposed development of the property which is subject to the provisions of the Specific Plan. Specifically, the site is located north of the San Diego Freeway west of Seal Beach Boulevard, east and south of the community of Rossmoor. Ordinance Number //70 . 4. NOTES ANO CONDITIONS a. Unless otherwise specified, all development within the Specific Plan shall comply with the City of Seal Beach Municipal Code. Terms used herein shall have the same meaning as defined in the City of Seal Beach Municipal Code unless otherwise defined herein. b. Any details or issues not specifically covered by this Specific Plan shall be subject to the regulations of the City of Seal Beach Municipal Code. c. The approval of development within the Specific Plan area shall be governed by Section 65450 et. seq. of the State of California Government Code. d. All construction within the boundaries of the Specific Plan shall comply with all provisions of the Uniform Building Cod~, including those provisions which address noise and energy and the various mechanical, electrical. plumbing, fire and security codes adopted by the City of Seal Beach as established by the Seal Beach Municipal Code. A special acoustical review of each commercial use within the, Orange County Airport Land Use Commission (AELUP) 60 CNEL shall be approved prior to issuance of building permits. Fire protection (i.e. automatic fire sprinklers) systems shall be included in design of all buildings as approved by the County of Orange Fire Department. e. Modifications to the Specific Plan which do not give rise to conflict with the intent or policies of the Specific Plan as approved may be approved by the City Manager. f. Environmental assessment for any development shall be completed and certified prior to final action on the project. g. Any land use designation not specifically covered by the Specific Plan shall be deemed inappropriate. h. If any regulation, condition, program or portion thereof of the Specific Plan is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision; and the invalidity of such provision shall not affect the validity of the remaining provisions hereof. i. That a contractual agreement between the City and the Developer be drafted as approved by the City Attorney which includes what signal modifications, traffic and median improvements, ~nd developer's contributions of project requirements, as approved by the City Council. j. A Maintenance District for landscape and street maintenance shall be established for all public streets and right-of-way within the project as approved by the City Attorney. k. The Preci.se Site Plan shall space interior street driveways to the office complex so as to provide adequate left-turn pocket space as approved by the City Engineer. The Precise Site Plan shall show striping of the westbound 7th Street connector such that left turning vehicles into the office complex do not impact through traffic,as approved by the City Engineer. 1. The applicant shall provide the City a copy of Federal Aviation Authority Certificate of No Hazard. m. Bicycle facilities shall be provided as approved by the Principal Planner and City Engineer. . , n. Architecture and tenancy of the restaurant sites shall be approved by the City Council. o. Delivery and maintenance vehicles shall operate within the hours of 7:00 a.m. to 7:00 p.m. I I I I I I Ordinance Number ~/;1~ p. The design of buildings shall be in compliance with the State Energy Conservation Standards. q. That all buildings shall be designed as required by the Uniform Building Code to withstand projected seismic acceleration as noted in the Environmental Impact Report. r. All Precise Plan submittals shall be in accordance with the regulations and procedures of the Specific Plan and any conditions of the Specific Plan and EIR Resolution. s. Trees of sufficient size as determined by the City, berms, hedges and thick foliage plants shall be included within the Precise Landscape Plan submittal. All damaged landscaping shall be replaced with plantings of substantially similar size. t. All uses or businesses shall be approved by the City Planning Department. u. A convenient bus stop location shall be incorporated in the Precise Site Plan, location subject to approval of the City Engineer. v. The Precise Lighting Plan shall include lighting for the parking areas which is directed and shielded from the adjacent residents property. The stanchion height is to be ~inimized to prevent direct glare into adjacent residences. Security lighting shall be softened and combined with landscape lighting and directed o~ the site to avoid glare into adjacent residences. w. The Precise Elevation Plans shall utilize non-mirrored glass. x. The Precise Plans shall be in conformance with the conditions of the Airport Land Use Commission as denoted in its letter to the City dated November 21, 1983. y. The dinner house shall be relocated to the souths ide of the 7th Street connector road unless engineering and safety studies show conditions exist which makes the location infeasible. z. That measures to control dust during grading be established subject to approval of the City Engineer. aa. A construction schedule shall be established prior to issuance of building permits which includes a limitation on heavy earth- moving activities to between the hours of 7:00 a.m. and 3:30 p.m. as approved by the City Engineer. bb. Unless otherwise approved by the City Council, the office buildings shall be located 40 feet closer to the south and east property lines than shown in Exhibit A unless the building height is reduced to 60 feet. cc. The developer shall be encouraged to implement a Transportation System Management Plan which includes flex time, staggered hours, and other similar measures. SECTION B: LAND USE DEVELOPMENT PLAN/GENERAL DEVELOPMENT STANDARDS 1. LOCATION The conceptual location of all principal land uses is shown in Exhibit A, Site Plan, with the addition of the restaurant site modification to the souths ide of the 7th Street connector road. All construction within the Specific Plan area shall conform to the Precise Site Plan and the Development Standards. The General Development Standards provide continuity throughout the Specific Plan area by providing generalized standards for all land use areas. 2. LAND USE CATEGORIES There is one land use category within the Specific Plan area: Commercial Land Use - retail, office, service, and restaurant uses as contained in Chapter 28, Seal Beach Municipal Code together with the required parking, service and loading areas for the uses provided. Ordi nance Number II 'If) 3. COMMERCIAL a. Location General commercial uses shall be limited to the three (3) buildings shown in Exhibit A of this plan. Restaurant uses shall be located in the two (2) low rise structures shown in Exhibit A of this plan with restaurant site modification noted in Section A.4.y. of this Specific Plan. b. Permitted Use General commercial, service commercial (to include ancillary cafeteria I uses) and general office uses shall be permitted in the three (3) four-story (4) buildings. Two (2) free-standing restaurants will be located on the eastern portion of the site. Alcoholic beverages and live entertainment will be permitted in the restaurants upon City Council authorization. 4. CIRCULATION a. Location The conceptual street system design shall be generally located as shown on Exhibit A. Precise alignments shall be established during Precise Plan Review in conformance to the standards established by the City Engineer. All access to the site shall be limited to Seal Beach Boulevard. Traffic signal modifications on Seal Beach Boulevard will be required in conformance to the standards established by the City Engineer and Caltrans. b. Street Standards All streets shall conform to the standards established by the City Engineer. .' c. Roadway Setbacks The following minimum setbacks, measured from the roadway right-of- way, shall apply to structures abutting the roadways listed below: I Seal Beach Boulevard San Diego 20 feet 20 feet d. The Precise Site Plan shall incorporate a design of the northeastern parking lot which will discourage shortcutting of traffic through the parking lot to the 7th Street connector or the office complex as approved by the Principal Planner and City Engineer. e. Traffic Modifications on Lampson Avenue and Seal Beach Boulevard The applicant shall provide $115,000 for modifications to traffic control facilities on Lampson and Seal Beach Boulevard, and $32,000 for street maintenance and repair of Seal Beach Boulevard and Lampson Avenue. This shall include: 1. Modernization of traffic controls on Seal Beach Boulevard and Lampson (head, poles and equipment, etc.). 2. Modification to include interconnects on Lampson Avenue from Seal Beach Boulevard to City boundary. 3. Restrip intersection of Lampson and Seal Beach Boulevard. 4. Install new illuminated street name signs at Seal Beach Boulevard and Lampson Avenue intersection. 5. Install new loops and loop protectors at Seal Beach Boulevard and Lampson intersection. 6. Installation of new controller cabinet and related equipment at St. Cloud and Seal Beach Boulevard. I I I I Ordi,nance Number // Jo , f. Armored Guard Rail on Lampson Avenue The applicant shall provide an engineering study, and a maximum contribution of $18,000 for construction of armored guard rails along the south side of Lampson Avenue. g. Median Strip on Seal Beach Boulevard The applicant shall provide a contribution of $35,000 for the construction of a landscaped median strip along the centerline of Seal Beach Boulevard from the intersection of Lampson Avenue to the freeway on andoff-ramp signal. h. The applicant shall construct a screen of the drainage control at Seal Beach Boul~vard to include: 1) 6' block wall, 2) A.C. pavement at flood control driveway, and 3) construct catch basin as approved by the City Engineer and Orange County Flood Control District. 5. BUILDING HEIGHT a. Commercial (office) Unless otherwise approved by the City Council, the maximum building height shall be limited to four (4) stories not to exceed sixty (60) feet unless the Precise Plans show the office buildings located 40 feet closer to the east and south property lines as noted in Section A.4.bb above, in that case seventy (70) feet will be allowed. b. Restaurants The maximum building height shall be limited to two (2) stories not to exceed 25 feet. 6. PARKING a. General Parking Requirements Retail/commercial/service - 1 space per 300 square feet of gross floor area. Restaurant - 1 space per 100 sq. ft. of gross floor area. b. Special Conditions 1) Subterranean parking is specifically authorized. 2) Up to 35% compact parking shall be specifically authorized with the resultant (15%) savings of parking area to specifically be used for additional landscaped open space area on the northeastern side of the 7th Street connector road. c. Parking Dimensions Conventional spaces - 20 ft. length, 9 ft. width. 24 ft. turning radius, 2 ft. landscape overhang permitted. Compact spaces - 16 ft. length. 8 ft. width. 24 ft. turning radius, 1 ft. landscape overhang permitted. 7. DESIGN a. All buildings and/or structures shall be integrated by the design and use of the following elements:. 1) materials 2) textures 3) colors 4) landscaping and boundary treatment 5) courtyards 6) hard surface pavement 7) lighting 8) signing .. b. A landscaping plan shall be developed for the overall project to include consideration for water conservation. Ordinance Number 117~ 8. BOUNDARY TREATMENT a. Walls A wall shall be constructed on the boundary of the site facing the Rossmoor community (Exhibit C). The wall shall be masonry and not exceed a maximum of twelve (12) feet in height if the adjacent 50undwall to be constructed by Caltrans is a corresponding twelve (12) feet in height. b. Landscape Landscaping the boundary of the site along the proposed wall facing the Rossmoor community shall include plant materials which at maturity reach a height of between twenty-five (25) and thirty (30) feet. The trees will be 36. box specimens with a height at the time of planting of 15 to 18 feet. I The Precise Landscape Plan shall include heavy landscaping between proposed restaurants and the northeastern property boundary. c. Walkways The Precise Plan shall include patterned, colored, textured walkways for pedestrians. 9. UTILITIES All utilities shall be underground. 10. REQUIRED SPECIFIC PLAN SUBMITTALS Twenty (20) copies of the following shall be submitted as part of the application for City approval of any development in the Specific Plan area. a. Conceptual or schematic site plan showing all buildings, structures, I parking, circulation and landscaped areas. b. Conceptual or schematic elevations of all buildings and structures showing height of same as well as height of architectural projections. 11. REQUIRED PRECISE PLAN SUBMITTALS a. Fifteen (15) copies of the following shall be submitted for precise plan review by the City Council, approval prior to issuance of building permits. 1. A precise site plan showing all buildings, structures, parking circulation and landscaped areas all shown in accurate dimension detail (1. to 60' scale minimum). The City Council shall review only the height and location of the buildings and the materials, colors and textures of the elevations. Samples of all elevation materials and textures to be submitted for approval. b. Five (5) copies of the following shall be submitted for precise plan reviewf.or staff approval prior to issuance of building permits. 1. A Precise Site Plan showing all buildings, structures, parking circulation and landscaped areas all shown in accurate dimensioned I detail (1. to 60' scale minimum). 2. Samples of all decorative hard surfaces or walkways. 3. Photos or plans of any streetscape furniture. 4. Precise lighting plan showing the type, size, height and location of exterior lights. Ordinance Number J/7tJ I 5. Precise Landscape Plan showing actual location, type, size and number of plants, trees and ground cover. In addition, the plan must specify the design and location of the irrigation system required for maintenance of the landscape and provide concrete curbing or other separate material surrounding the landscape areas. 6. Complete floor plans of all floors of all buildings with rooms labeled as to use. 7. Precise Sign Program Plan for all exterior signage including project identification and directional signs. The actual location, size, shape, height, color, type of illumination must be shown. One of the copies to be colored as proposed and material samples submitted.
