June 2, 2025
Chair Wheeler called the Planning Commission meeting to order at 7:00 p.m.
Commissioner Campbell led the Pledge of Allegiance.

PUBLIC COMMUNICATIONS
Chair Wheeler opened public communications. Speakers: None. Chair Wheeler closed
public communications.
City Clerk Harper announced that no emailed comments were received.
APPROVAL OF AGENDA
By Motion of the Planning Commission this is the time to notify the public of any changes
to the agenda, re-arrange the order of the agenda, and provide an opportunity for any
member of the Planning Commission or staff to request an item be removed from the
Consent Calendar for separate action.
Motion by Vice Chair Mingione, second by Commissioner Nolta to approve the agenda.

CONSENT CALENDAR
A. Approval of the April 21 , 2025, Planning Commission Minutes
Motion by Commissioner Campbell second by Vice Chair Mingione to approve the consent
calendar.

PUBLIC HEARINGS
B. Minor Use Permit 25-0007
33 B Surfside Avenue
Applicant: Max Nguyen on behalf of Anthony and Mai Nguyen
Request: For Minor Use Permit (MUP 25-0007) to permit a covered roof access structure to
exceed the maximum roof height by 4 feet 6 inches on a new single-family residence and
attached Accessory Dwelling Unit construction in Surfside Colony in the Residential Low
Density (RLD-9) Zoning area.
Recommendation: After conducting the Public Hearing, staff recommends that the Planning
Commission adopt Resolution No. 25-04, APPROVING Minor Use Permit 25-0007 with
Conditions and find the project EXEMPT from CEQA.
Assistant Planner Funes provided a comprehensive staff report.
Commissioner Campbell's questions and concerns were addressed by Planning Manager
Temple.
Chair Wheeler opened the public hearing. Speakers: Lawrence Zero, Applicant: Max
Ngyuen. Chair Wheeler closed the public hearing.
A discussion ensued between Chair Wheeler, Assistant Planner Funes, the applicant, Max
Ngyuen, Senior Assistant City Attorney Greyson, Vice Chair Mingione, and Planning
Manager Temple regarding obtaining recommended approval from the Surfside Colony
Architectural Review Board and continuing the matter to a future meeting.
Chair Wheeler moved, second by Vice Chair Mingione to continue Item B to the June 16,
2025 Planning Commission meeting.

DIRECTOR'S REPORT
Planning Manager Temple announced that the City has released the Draft Environmental
Impact Report (DEIR) for the Housing Element and Zoning Code Update Project and that
the public review period runs to June 23rd. Planning Manager Temple announced that the
Environmental Quality Control Board will meet on Thursday, June 5, 2025 at 6:15 p.m., in
the City Council Chambers to discuss the DEIR.
COMMISSION CONCERNS
There were no commission concerns.
ADJOURNMENT
Chair Wheeler adjourned the Planning Commission meeting at 7:20 p.m. to Monday, June
16, 2025, at 7:00 p.m.
