A RESOLUTION OF THE SEAL BEACH CITY COUNCIL
DECLARING THAT THE PIER BOAT RAMP REPAIR PROJECT
(CIP EM2501) IS URGENTLY NECESSARY TO PROTECT
PUBLIC PROPERTY AND FINDING THAT THE PIER BOAT RAMP
REPAIR PROJECT IS THEREFORE EXEMPT FROM PUBLIC
BIDDING; AWARDING AND AUTHORIZING THE INTERIM CITY
MANAGER OR THEIR DESIGNEE TO EXECUTE A PUBLIC
WORKS AGREEMENT WITH JILK HEAVY CONSTRUCTION,
INC.; AND APPROVING BUDGET AMENDMENT BA #25-12-01
TO ALLOCATE $57,580
WHEREAS, on May 27, 2025, the Seal Beach Pier (Pier) boat ramp sustained
damage caused by DCOR, LLC (DOOR); and,
WHEREAS, the Director of Public Works determined immediate repairs to the boat
ramp are necessary to mitigate further damage and protect public property;
therefore, out of the urgent necessity of the preservation of property, there would
not be sufficient time for public bidding to carry out the Pier Boat Ramp Repair,
CIP EM2501 (Project); and,
WHEREAS, Jilk Heavy Construction, Inc. (Jilk) performed the Seal Beach Pier
Emergency Repair, CIP EM2301, caused by the 2023 Winter Storms; and,
WHEREAS, Jilk is a qualified firm to perform the Project; and,
WHEREAS, on May 30, 2025, Jilk submitted a cost proposal to perform emergency
repair work for the Project; and,
WHEREAS, the City's Charter Section 1010 authorizes the City to dispense with
public bidding as necessary for the preservation of property, and Seal Beach
Municipal Chapter 3.25 also exempts emergency projects from bidding
requirements; and,
WHEREAS, DCOR will fully reimburse City for Project expenditures.
NOW, THEREFORE, the Seal Beach City Council does resolve, declare,
determine, and order as follows:
Section 1. Based on the recitals set forth above, the City Council hereby finds
that the Pier Boat Ramp Repair, CIP EM2501, is urgently necessary
for the preservation of property of the City, and finding that the
contract for the Pier Boar Ramp Repair is therefore exempt from
public bidding requirements.
Section 2. The City Council hereby authorizes the Interim City Manager or their
designee to execute a public works agreement with Jilk Heavy
Construction, Inc., without advertising for bids, for a total not-to-
exceed amount of$47,580.
Section 3. The City Council hereby authorizes the Interim City Manager or their
designee to approve payments in for additional work requests in
connection with the Project in the cumulative not-to-exceed amount
of $5,000.
Section 4. The City Council hereby authorizes the Interim City Manager or their
designee to approve payments for inspection and testing in
connection with the Project in the cumulative not-to-exceed amount
of $5,000.
Section 5. The City Council hereby approves Budget Amendment
#BA 25-12-01 allocating $57,580 to the Damaged Property Account,
as follows:

Section 6. The City Clerk shall certify to the passage and adoption of this
resolution.

regular meeting held on the 23rd day of June 2025 by the following vote:
