Home My WebLink AboutCC Ord 1152 1983-08-22 ORDINANCE NO. //5.:t 1 AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, ~mNDING CHAPTER 15A, OIL, GAS, PETROLEUM OR OTHER HYDROCARBON SUBSTANCE PRODUCTION, ARTICLE I OF THE SEAL BEACH MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. The Code of the City of Seal Beach, California, is hereby amended by amending Chapter 15A, Article 1, Section 15A-l(a) to delete the introductory paragraph and subsections 15A-l(a) (1) and (2) and to renumber subsections 15A-l (a) (3), (4), (5) and (6) as subsections 15A-l (a) (6), (7), (8) and (9) respectively. Section 2. The Code of the City of Seal Beach, California, is hereby amended by amending Chapter 15A, Article 1, Section 15A-l(a) to add a new introductory para- graph and new subsections 15A-l (a) (1), (2), (3), (4), and (5) to read: (a) Production. Every person who engages in the business of producing oil from any well or wells located within this City shall pay an annual license tax for each well operated by such person for the purpose of producing crude oil, gas, or other petroleum substances, com- puted as follows: I (1) One hundred-fifty dollars per producing well, which amount is referred to in this chapter as the "base tax"; plus . ' (2) Thirty dollars per producing well, which amount is referred to in this chapter as the "annual oil permit well fee"; plus (3) The "per-barrel tax" which shall be calculated by multiplying the number of barrels of oil produced and shipped . from the well during each fiscal quarter of the fiscal year by 12.5 cents. Such tax shall be adjusted on July 1,1984,. and each July 1 thereafter by the chang~ I Ordinance Number ~~~~ I in the average producer prices provided by the oil producers in the City'for oil produced in the City during the previous fiscal year, but in no event shall the per-barrel tax be adjusted to a rate below 12.5 cents per barrel of oil produced. Such adjustment shall be determined by the Director of Finance. (4) The base tax and the annual oil permit well fee shall be paid by September 30, 1983 for the 1983-1984 fiscal year and by September 30 for each fiscal year thereafter. The base tax and the annual oil permit well fee shall be paid for each new '.well commencing production after such payment dates within thirty days after the commencement of production for such well. I (5) The Director of Finance shall notify each person required to pay the per-barrel tax of the rate to be used for each fiscal year. Such payment shall be made during each quarter of every fiscal year in the manner provided herein, on or before each succeeding September 30, December 31, March 31 and June 30, respectively. Production during the months of June, July and August shall constitute the measurement of the amount due on or before September 30, for the first quarter of a fiscal year; production during the.months of September, October and November shall constitute the measurement of the amount due on or before December 31; production during the months of December, January and February shall cons~itute the measurement of the amount due on or before March 31; production during the months of March, April and May shall cons~itute the measurement of the amount due on or before June 30. . . ". Section 3. The Code of the City of Seal Beach, California, is hereby amended by amending Chapter l5A, Article 1, Section l5A-l(a) (6) to add a new paragraph (d) to read: .-- J (d) Every person required to have a license under this chapter shall keep full, true, and accurate records as to the amounts of oil produced and shipp~d or sold by it from wells located ... Ordinance Number /I'~~ within the City. In addition, each oil I producer in the City shall keep full, true, and accurate records of any producer prices of such producer for oil produced in the City. All such records shall be kept for a minimum period of three (3) years, and upon the demand of the Director of Fina~ce, shall be made available, together with any shipping documents or sales invoices pertaining to such oil, for the inspection of the Director of Finance at all reasonable times. Section 4. Certi~icatibn and Posting. The City Clerk shall certi~y to-rKe passage and adoption of this ordinance and shall cause the same to be published as required by law.
