I AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SEAL BEACH, CALIFORNIA AMENDING CHAPTER 28, ARTICLE 31 OF THE SEAL BEACH MUNICIPAL CODE RELATING TO THE INTERPRETATION OF THE ZONING ORDINANCE WITH RESPECT TO THE ENACTMENT OF SPECIFIC PLANS THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. Chapter 28, Article 31, Section 2B-3l00 of the Code of the City of Seal Beach, California is hereby amended to read as follows: I Section 28-3100. Interpretation. In interpreting and applying the provisions of this chapter the provisions shall be considered to be the minimum requirements for the promotion of the public health, safety, comfort, convenience and general welfare. It is not intended by this chapter to interfere with or abrogate or annul any easement, covenant or other agreement between parties. When this chapter imposes a greater restriction upon the use of buildings or land or upon the height of buildings or requires larger open spaces than are imposed or required by other ordinances, rules, regu- lations, or by easements, covenants or agreements, the provisions of this chapter shall control. Whenever the City adopts a Specific Plan relating to the development of a designated area of the City, as that term is used in Section 65450 et seq. of the Government Code of the State of California, as may be amended, the provisions and specifications of such an adopted Specific Plan shall supercede any conflicting provisions of this chapter without regard as to whether the provisions and specifications of such Specific Plan are more or less stringent than the provisions of this chapter. Section 2. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause same to be published as required by law.
