' I ORDIKANCE NUMBER ~~~ AN ORDINANCE OF THE CITY OF SEAL BEACH REGULATING THE PARKING OF OVERSIZE ANO NON-MOTORIZED VEHICLES ON CITY STREETS, AND AMENDING THE COOE OF THE CITY OF SEAL BEACH, CALIFORNIA THE CITY COUNCIL OF THE CITY OF SEAL BEACH OOES HEREBY OROAIN AS FOLLOWS: ' Section 1. Chapter l3B of the Code of the City of Seal Beach. California, is hereby amended to read as follows: CHAPTE.R l3-B OVERSIZE VEHICLES OVERNIGHT PARKING Sec. l3B-l. Definitions. A. Non-r~otorized Vehicle. A "non-motorized vehicle" is any trailer. camp trailer. semi-trailer or trailer coach as defined by the Vehicle Code. I B. Oversize Vehicle. An "oversize vehicle" is any vehicle or combination of vehicles that exceeds twenty (20) feet in length or ninety (90) inches in width exclusive of projecting lights or devices as allowed by Sections 35l09, 35110 or 35112 of the Vehicle Code as may be amended. I l. Oversized vehicles will exclude any sedan or limousine, manufactured expressly for carrying ten (10) or less passengers. Sec. l3B-2. Overnight Parking. A. Oversize Vehicles. No person shall park or leave standing upon any public street or highway any oversize vehicle or non-motorized vehicle at any time be~ween the hours of 2:00 a.m. and 5:00 a.m. B. Non-Motorized Vehicle Parking. No person shall park or leave standing upon any public street or highway a non-motorized vehicle. regardless of width, which has been detached from its motor vehicle except when such person is actually loading or unloading the same or making repairs of an emergency nature to either the vehicle itself or the adjacent pr~perties. C. Exceptions. The provisions of subsections (A) and (B) of this section shall not apply to the following: 1. Commercial vehicles making pick ups or deliveries of goods. wares or merchandise from or to any building or structure. 2. Any vehicle displaying a valid permit issued by the Chief of Police or his designee. D. Permits. The Chief of Police or his designee may issue a temporary permit for the overnight parking of an over- size or non-motorized vehicle if he makes any of the findings set forth in this section and in addition, determines that the parking of such oversize or non- motorized vehicle will not create a safety hazard. . ' Ordinance Number~t)~ Such permit shall be valid for the time period stated thereon and shall be issued only in the event of' special circumstances which shall include the following: 1. The vehicle belongs to visitors or house guests temporarily residing in the city. Such permit shall be valid for a maximum period of fourteen (14) days. 2. The vehicle is newly purchased and suitable permanent parking or storage is being arranged. Such permit shall be valid for a maximum period of fourteen (14) days. 3. The vehicle belongs to a new resident and suitable permanent parking or storage is being arranged. Such permit shall be valid for a maximum period of fourteen (14) days. , 4. The vehicle is used on a daily basis for work and the parking of such vehicle is not reasonably possible on the owner's premises. Such permit shall be valid for a maximum period of six (6) months and may be renewed for successive six (6) month periods. 5. A twenty-four (24) hour permit may be obtained for the purpose of loading and unloading such vehicle. The Chief of Police shall not issue a permit if he determines that the parking of such oversize or non- motorized vehicle will create a safety hazard such as interference of access of fire trucks or other emergency vehicles. In making such determination, the Police Chief shall consider the width of the subject street. the existence or non-existence of sidewalks, the closeness of residences to the street and other relevant factors. I I Sec. l3B-3. Signing. Pursuant to Vehicle Code Section 22507. signs giving adequate notice of the prohibitions contained in this Chapter shall be placed within the city limits of the City of Seal Beach. Sec. 13B-4. Penalty. Violation of the provisions of this Chapter shall be an infraction subject to the issuance of a citation and shall be punishable by a fine of $25.00. Each day a violation is committed shall be considered a separate offense subject to the issuance of a separate citation. Pursuant to Section 22651 of the Vehicle Code, any non- motorized vehicle or oversize vehicle parked or left standing on a public street or highway in violation of the provisions of this Chapter may be removed from the street or highway upon which such vehicle is parked or left standing.
