AN ORDINANCE OF THE CITWOF SEAL
BEACH ESTABLISHING A SEWER SERVICE
CHARGE.
WHEREAS, the residents and property owners of the Leisure
World area of Seal Beach own, operate and maintain their own
sewer collection system;and
WHEREAS, the residents and property owners of the Surfside
area of this city pay taxes to the Sunset Sanitary District for
operation and maintenance of a sewer collection system; and
WHEREAS, most of the residents and property owners of the
College Park West and the owners of the Rossmoor Business Center
sections of the City of Seal Beach pay taxes to the Los Alamitos
Water District for operation and maintenance of a sewer collection
system; and

WHEREAS, the property owners and residen~s of the Hill and
Ocean areas of the City pay taxes to County Sanitation District
No. 4 for reimbursement to the City of costs incurred in the
operation and maintenance of the sewer collection system serving
these areas; and
WHEREAS, the City's General Fund financed by city wide
property taxes pays for expenditures in connection with the
sewerwge collection system in College Park East and certain
industrial and commercial areas; and
WHEREAS, the purpose of this ordinance is to establish equity
in distributing the cost to the user of the sewer collection system
operated and owned by the City of Seal Beach and to eliminate such
costs being borne by residents aDd taxpayers within the city paying
.taxes and/or charges for such service to other entities.
The City Council of the City of Seal Beach does ordain:
Section 1. The City shall make a monthly service charge
to each residen~ial unit or units, busimess, industrial enterprises
or other entity which has a connection to the city owned sewage
collection systems for the usa of said sewage collection system,
such monthly service charge to be an amount equal to ten percent
(10%) of the water billing to said user.

Section 2. Service charges for maintenance and operation
of the sewage collection system for a particular property shall
be billed on the same bill and to the same ownership as the
water bill for that particular property.

Section 3. In the event that any property in the city is
unoccupied for thirty-two (32) consecutive days during any
two month billing period, and no service is provided or required,
then a pro rated charge shall be made on the basis of a sworn
statement by the owner,or occupant of such vacancy for the
billing period last past.
Section 4. The occupants of each place or premises shall
be liable for payment of all fees and charges as heretofore set
forth in this ordinance. Should any place or premises be
occupied or should the occupant thereof fail to pay all such
fees and charges before the sum becomes delinquent as provided
in Sections 26-11 of the Seal Beach City Code, then, in either
of such events, the owner of snmh places or premises shall be
liable for the payment of all such fees and charges.
Section 5. Should an account for sewage service charge
not be paid on or before the twentieth day of the month in
which it became due, it shall be deemed delinquent and a penalty
of ten percent (10%) shall be added thereof.
Section 6. Effective date. This ordinance shall be effective
Septe~er 1, 1969.

Section 7. Severability. If any section, subsection,
sentence, clause, phrase, or portion of this ordinance, or the
application thereof to any person, firm, copporat~on, or
circumstance, is for any reason held to be invalid or unconsti-
tutional by the dmcision of any court of competent ffurisdiction,
such decision shall not affect the validity of the remaining
portions of thms ordinance. The Council of the City of Seal
Beach hereby declares that it would have adopted this ordinance
and each section, subsection, sentence, clause, phrase, or portion
thereof, irrespective of the fact that anyone or more sections,
subsections, sentence, clause, phrase, or portion be declared
invalid or unconstitutional. '
Section 8. Certification and Posting. The City Clerk
shall certify to the passage and adoption of this ordinance and
shall cause the same to be posted as ired b law.
