Home My WebLink AboutCC Ord 1087 Not Adopted I I I r _ .." . ~ . . . ~ . -~~ ORDINANCE NUMBER IOB7 AN ORDINANCE OF THE CITY OF SEAL BEACH, CALIFORNIA, AUTHORIZING A SAFETY SERVICES TAX ALLOWING FOR EXPENDITURE OF THOSE FUNDS DERIVED FROM SAID TAX AND AMENDING THE CODE OF THE CITY OF SEAL BEACH BY ADDING CHAPTER 22, ARTICLE IX. -4 :x;.:z.ll THE PEOPLE OF THE CITY OF SEAL BEACH, CALIFORNIA DO ORDAIN AS FOLLOWS: Section 1. The Code of the City of Seal Beach, California is hereby amended by adding Chapter 22, Article IX thereto to read: CHAPTER 22, ARTICLE IX SAFETY SERVICES TAX Section 22-77. Authority to Adopt Measure. Chapter 22, Article IX of the Code of the City of Seal Beach, California and the tax authorized herein is adopted pursuant to the provisions of Article 3.5 of Chapter 1 of Part 1 of Division 1 of Title 5 of the Government Code (Section 50075, 50076, and 50077); and the California Constitution Articles XIII A and XIII B. Section 22-78. Authorization to Levy Special Tax. If in any fiscal year commencing July 1, 1981, the City Council shall determine that safety service protection (Police, Fire and Paramedic services) is necessary for the public good, welfare, and safety, and that the cost of providing such services together with other city services will exceed the amount of funds generated through other revenue and income of the city for such services, then it may levy a special tax for such fiscal year on each residential, commercial and vacant parcel of real property within the city in a manner provided herein. This special tax shall be in addition to the annual tax rate allowed by law. Section 22-79. Determination of Amount to be Raised. Each year following adoption of the city's annual budget, the City Council will determine the total amount of expenditures necessary to provide adequate levels of safety services. Maximum Tax Rate/Method of Assessment. After determining the amount of tax to be raised under Section 22-79, the City Council shall apportion said amount among the parcels of real property within the city not exempted by law as. follows: * Includes apartments, condominiums and mutuals I The records of the Orange County Assessor as of March 1 of each year shall determine whether or not any particular lot is unimproved for purposes of this Chapter. Section 22-81. Collection. The City Council may elect to have any special tax authorized under this chapter either collected by the city or in the alternative by the tax collector of the County of Orange. If the services of the tax collector of the County of Orange are elected, the special tax may only be included on the annual tax bill sent out by such tax collector. I A certified copy of the resolution electing to use the services of the tax collector of Orange County shall be filed with said tax collector prior to September 1 of the fiscal year for which the tax is assessed and shall include a list of all parcels of real property to be taxed and the amount of each parcel. Section 22-82. Increase Appropriations Limit. Pursuant to California Constitution Article XIII B, the appropriations limit for the City of Seal Beach will be increased by the aggregate sum collected by levy of this special tax in each of the years covered by the Chapter plus the amount, if any, by which the appropriations limit is decreased by law as a result of the assessment of the special tax set forth in this Chapter. Section 22-83. Funding and Expending Proceeds. Proceeds of any tax levied under this Chapter shall be set apart in a special fund and expended only for the purposes stated in this Chapter. Section 22-84. Unexpended Residue. Unexpended residue of any money raised by the city under this Chapter may only be used in the succeeding year for the purposes stated in this Chapter by lowering the next year's tax by the amount unexpended or returned to the taxpayer on the same pro rata basis as originally levied. Section 22-85. Severability. If any provision of this Chapter or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect any other provision or applications, and to this end the provisions of this Chapter are declared to be severable. ,. ". . ~. I I I Ordinance Number . . Section 22-86. Duration of Amendment or Repeal. The authorization to levy a tax under this Chapter shall expire at the end of fiscal year 1984-85 ending June 30, 1985. This Chapter or any provision thereof may only be amended or repealed by approval of two-thirds of the voters voting on the proposition at any initiative or referendum election. Section 2. This Chapter shall be adopted if approved as an initiative measure by two-thirds of the voters voting at an election to be held on Tuesday, November 4, '1980 and go into effect ten days after the City Council has by resolution declared that such initiative measure was approved by two-thirds of the voters voting thereon. Section 3. Certification and Posting. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published as required by law.
