RESOLUTION NO. 87-1 A RESOLUTION OF THE RECREATION AND PARKS COMMISSION OF THE CITY OF SEAL BEACH ADOPTING RULES AND REGULATIONS DEFINING THE COMMISSION'S STRUCTURE, DUTIES AND RESPONSIBILITIES, AND RELATED FUNCTIONS. WHEREAS, the Charter of the City of Seal Beach requires that the Commission shall adopt rules and regulations regarding its function; NOW, THEREFORE, THE RECREATION AND PARKS COMMISSION OF THE CITY OF SEAL BEACH DOES RESOLVE that its rules and regulations shall be as follows: ARTICLE I - STRUCTURE Section 1. Membership. Seal Beach shall consist appointed as needed. The Recreation and Parks Commission of the City of of five members, and ex officio members to be Section 2. Election and Officers. The Commission shall, in regular session, following the first day of July of every year, elect from their members a Chairman and Vice-Chairman. The term of office shall be one year and no officer shall serve more than two consecutive terms in the same office. . Section 3. Regular Meetings. The Recreation and Parks Commission shall meet in regular session on, the fourth Wednesday of each month unless it is a holiday. In such case, the same day in the following week shall be designated. Section 4. Special Meetings. Special meetings may be called at any time by the Chairman, or by three members of the Commission, by written notice delivered personally or by mail to each member of the Commission and to each local newspaper of general circulation, radio or television station which has filed with the City Clerk written request for such notice. Such notice must be delivered personally or by mail at least twenty-four (24) hours before the time of such meeting as specified in the notice. The call and notice shall specify the time and place of the special meeting and the business to be transacted. No other business shall be considered at such meeting by the Commission. Such written notice may be dispensed with as to any member who at or prior to the time the meeting convenes files with the City Clerk a written waiver of notice. A telegraphic communication from a member consenting to the holding of a meeting shall be considered a consent in writing. Such written notice may also be dispensed with as to any member who is actually present at the meeting at the time it convenes. Section 5. Quorum. A majority of regular members (3) shall constitute a quorum. . Section 6. Vacancies. Any vacancies, from whatever cause arising, shall be filled by appointment by the City Council. Upon a vacancy occurring leaving an unexpired portion of a term, any appointment to fill such vacancy shall be for the unexpired portion of such term. If a member absents him- self from three consecutive regular meetings of the commission, unless by permission of the commission expressed in its official minutes, or is convicted of a crime involving moral turpitude, or ceases to be a qualified elector of the City, his office shall'become vacant and shall be so declared by the City Council. , Section 7. Committees. Special committees may be appointed by order of the Commission as needs arise. Such committees shall not necessarily be restricted to members of the Commission. The chairman of any special committee shall be a member of the Commission. Section 8. Parliamentary Procedure. Robert's Rules of Order - Revised will govern procedures of the Recreation and Parks Commission business meetings. . a. A majority vote of the members present shall be required to carry a motion, proposal or resolution. All official members present shall vote on every question presented to the Commission. In actions proposed by the Chair, unanimous consent thereto shall have the effect of a motion duly carried. without the necessity of a formal vote. , . '.. . , . . Section 8. b. Under no circumstance is any member to take any action or make any statement committing the Commission as a whole unless given authority to do so by the vote of the Commission. Section 9. Communications. a. Matters coming from public and from civic organizations to be assured of consideration and action at the stated meeting of the Commission, must be received in writing at least seven (7) working days preceding the Commission meeting. b. All written communications to outside groups shall be sent out over the signature of the Director of Recreation and Parks or an officer of the Commission, so officially designated. Section 10. Amendments. The rules and regulations listed here may be amended at any regular meeting of the Recreation and Parks Commission by a majority vote, to be ratified by City 'Council. ARTICLE II - DELINEATION OF DUTIES AND RESPONSIBILITIES Section 1. The following delineates some of the ways the Commission can carry out its duties and responsibilities, as outlined by Ordinance and the Municipal Code of the City of Seal Beach. . a. Give due attention and study to recreation and park service as they affect the welfare of the people of Seal Beach. b. Interpret the services of the Department to the community. c. Interpret community recreation and park needs to each of the public jurisdictions participating in the joint cooperative program. d. Take initiative in planning for future recreation and park areas and facilities, as well as determining means of bringing present areas and facilities up to an acceptable standard. e. Serve as a sounding board against which the Department Administrator and staff may test their plans and ideas. f. Recommend policy, keeping in mind that the adoption of the policy is the prerogative of the City Council and that the Director of Recreation and Parks must have a free hand to carryon the work of the Department within the framework of these policies. g. Enable civic and service organizations to accomplish results through cooperation that they could not possible accomplish alone. . h. Encourage individuals and citizen groups to give funds, property, and manpower for the development and operation of recreation and park facilities. i. Generally enlist community interest in recreation and parks. ARTICLE III - RELATIONSHIPS OF THE COMMISSION Section 1. Relationship of the Commission with the City Council. Commis- sioners shall: a. Know the Ordinance and the role and function of the Commis- sian. b. Meet with the Council from time to time in formal session when policies are needed in order to insure a smooth running operation. . c. Remain warm, friendly and understanding toward the Council, but make decisions on all the facts. d. When making a recommendation to the Council, back it up with written facts, oral communications and action, as necessary. e. Support the overall program of the Council, not just the recreation and parks services. . . .' , , <-. . , . . . . The Director of Recreation and Parks shall: (a) E~ploy required personnel, such as assistants, supervisors, leaders, lifeguards, clerical and maintenance employees in accordance with civil service proceedings and supervise them in the performance of their various duties. (b) Administer, operate and maintain existing recreation and park areas and facilities and plan for the acquisition, development and operation of proposed facilities in accordance with policies approved by the Recreation and Parks Commission and the City Council. (c) Inform the general public of the services and facilities being provided by the Recreation and Parks Department. (d) Solicit suggestions from the general public to improve or increase the effectiveness of the service. (e) Cooperate with governmental and voluntary organizations and agencies in the furtherance of recreation opportunities. (f) Prepare manuals, bulletins and reviews of recreation problems. (g) Provide, upon request, assistance of a technical nature to community agencies and organizations having problems relating to recreation and park areas and facilities and programs. (h) Counsel officials of public and private organizations and interested groups concerning community recreation and leisure activities and assist them in the promotion of recreation services. (i) Conduct studies of local conditions and needs for recrea- tion services and assist with recruitment and training of recreational personnel.
