SEAL BEACH CABLE COMMUNICATIONS FOUNDATION BOARD OF DIRECTORS MEETING MINUTES FOR NOVEMBER l5, 1993 The Board of Directors for the Seal Beach Cable Communications Foundation met November 15, 1993 at 7:00 pm at the Mary Wilson Library in Seal Beach California. Mr. Palmer called the meeting to order at 7:00 pm. PLEDGE OF ALLEGIANCE The pledge of allegiance was led by James Clow. ROLL CALL Mr. Palmer, Mrs. Dahlin, Mr. Clow were present. Mr. Mueller and Mr. Rowland were absent. Marla Kreps from Comcast was present. CONSENT CALENDAR REVIEW OF MINUTES FROM OCTOBER l8 AND NOVEMBER 2, 1993 Mrs. Dahlin asked about the phone bill. Ms. Kreps showed her the bill and the credits for the past two phone bills. Ms. Kreps explained it was a separate check request which she forgot to include. Mrs. Dahlin moved the minutes of October and November be accepted and filed with the above noted correction from page five of the October meeting. Mr. Clow seconded the motion. AYES: Mr. Clow, Mrs. Dahlin, Mr. Palmer NAYS: -0- MOTION PASSED: 3-0 . pg. 2 SBCCF 11/15/93 minutes FINANCIAL REPORT After review of the financial report, Mrs. Dahlin moved the acceptance thereof and Mr. Clow seconded the motion. AYES: NAYS: MOTION Mrs. -0- PASSED: Dahlin, Mr. Clow, Mr. Palmer 3-0 CHECK REQUEST Mrs. Dahlin asked the $900.00 check request so Ms. Kreps said she would include a copy of it in the next minutes. Mrs. Dahlin moved the check request be accepted and filed and Mr. Clow seconded the motion. AYES: Mr. Clow, Mr. Palmer, Mrs. Dahlin NAYS: -0- MOTION PASSED: 3-0 ACCESS FEES FOR ELAINE ALLBEE & NANCY HILL Mr. Clow made the motion to allocate the $35.00 to Elaine Allbee . for her public access program. Mrs. Dahlin seconded the motion. AYES: NAYS: MOTION 3-0 -0- PASSED: 3-0 Mrs. Dahlin questioned Nancy Hill's proposal and wondered if it adhered to the public access programming guidelines. Mr. Palmer added that he had a problem with the show because it was a religious program. Mr. Clow asked, "We can't have religious programs?" Mrs. Dahlin did not think this type of program could be on pUblic access television. Ms. Kreps pointed out the the Board, and read from page one of the guidelines, "No individual will be denied access to SBTV Community Television facilities or channel time on the basis of race, sex, physical disability, religion, political belief, sexual preference, or national origin." . She went on to say that public access is for individuals to produce whatever kind of show they want, provided it does not clash with the programming guidelines. . . . pg. 3 SBCCF 11/15/93 Mrs. Dahlin questioned the limits of the guidelines as to how public access can show Lutheran catechisms or a half hour program from the presbyterian church. Ms. Kreps added that churches within the franchise community can go through the public access classes and produce a show about the Lutheran catechism if an individual wishes. Mr. Palmer commented, the people of Seal Beach are paying to have religious shows. Mr. Palmer then asked Mr. Clow for his opinion. Mr. Clows offered his personal opinion in that a public access producer can produce anything, this is their right. Mr. Palmer then asked if there would be any solicitation of funds. Ms. Kreps stated there would be no solicitation of funds because that violates the public access programming guidelines. Mr. Palmer stated he is worried that every religious group in Seal Beach is going to want to use public access. Mr. Clow asked how many religious groups are in Seal Beach. Mr. Palmer answered, "about five hundred, at least." He expressed the opinion that these groups were everywhere. Ms. Kreps stated that the Board can not discriminate because of religious belief, even if the belief is different from their own. Mrs. Dahlin again asked if these people have the right to do this kind of programming. Mrs. Dahlin expressed concern that by would appear as if the Board of particular religion. After due discussion of other religious shows on SBTV-3 (Jewish, Presbyterian etc) Mr. Palmer stated he really did not like this but there probably is not much of a choice. . . . pg. 4 SBCCF 11/15/93 minutes Ms. Kreps assured the Board once again that Nancy Hill signs a statement that she will follow the public access guidelines. If she does not follow these guidelines her program will not be cablecast. Mr. Clow motioned the Board pay the $35.00 public access studio fee for Nancy Hill. Mrs. Dahlin seconded the motion. AYES: NAYS: MOTION Mr. Clow, -0- PASSED: 3-0 Mrs. Dahlin, Mr. Palmer OLD BUSINESS Ms. Kreps stated that Mr. Guzetta is up to date regarding the twenty five L.O. programs for 1993. Mr. Clow asked who authorized the Founders Day Parade. Mr. Palmer stated this is the first year Comcast has covered this event. Due discussion followed regarding the scheduling of this event, so Ms. Kreps said she would obtain additional information about the Founders Day Parade. There was discussion about the 1st and 2nd quarter news shows done by Mr. Guzetta. Mr. Clow mentioned again he wanted to come down to Comcast and see the programs. Ms. Kreps invited Mr. Clow to come down to Comcast to view the tapes any time. BOARD OF DIRECTORS INSURANCE Ms. Kreps had spoken with Greg from Pollman Insurance. The two different figures of $1,400 and $1,300 represent two different payment plans. The $l,400 would be the total amount due if the remaining balance were paid with monthly payments. If the $1,300 balance is paid off at once there won't be monthly finance charges. The Board discussed paying off the entire amount all at once to avoid additional finance charges. Mr. Clow made the motion to pay the entire remaining balance of the insurance fee. Mrs. Dahlin seconded the motion. AYES: NAYS: MOTION Mr. Palmer, -0- PASSED: 3-0 Mr. Clow, Mrs. Dahlin EQUIPMENT MAINTENANCE Mrs. Dahlin made the motion that this subject be tabled until the full Board is present. Mr. Clow seconded the motion. ~ pg. 5 SBCCF ll/l5/93 minutes AYES: NAYS: MOTION Mr. Clow, -0- PASSED: 3-0 Mr. Palmer, Mrs. Dahlin PROPOSED BUDGET FOR 94 Ms. Kreps explained the $200.00 projected capital expense would be for a new tape cabinet. Ms. Kreps explained the line item amount for access fees is based on four studio shoots per month and three van shoots per year. The Board asked about the budgeted increase for part-time employees. Ms. Kreps explained this was incorporated for wage and cost of living increase. After due discussion, Mrs. Dahlin moved the budget be accepted and filed. Mr. Claw seconded motion. AYES: NAYS: MOTION Mr. Palmer, -0- PASSED: 3-0 Mrs. Dahlin, Mr. Clow ~ AUDIENCE COMMUNICATION Elaine Allbee thanked the Board for funding her program. Nancy Hill also thanked the Board for funding her show. Tam Worth from Leisure World commented she thought the Board of Directors did an excellent job. NEW BUSINESS REMOVING THE PROGRAM "THY KINGDOM COME" Mr. Palmer said he saw this program on channel 3 (but the show was from Long Beach) and the guy was degrading people based on their sexual preference. He went on to say he does not think this show should be put on public access television again because it was degrading people based on their sexual preference and this is something that should be a commercial on some other channel. "I just think it was a nasty religious program," said Mr. Palmer. . . . - pg. 6 SBCCF 11/15/93 minutes Ms. Kreps said this show has aired off and on for a long time. The gentlemen who reque~ted the cablecasting of this show lives in Seal Beach. His request for channel time was then handed to the Board. The program was reviewed by Ms. Kreps who stated that this show does fall within the public access programminq guidelines. Ms. Kreps emphasized again, regardless of the Board's personal opinion, they need to look at the guidelines. Mr. Clow asked if this show was produced by a Seal Beach public access producer. The show was not produced by a public access producer but rather was bicycled to SBTV-3 from a Seal Beach public ~ccess producer. Mr. Clow also asked that if he did not produce the program then why is SBTV-3 showing it. The Public Access Coordinator said SBTV cablecasts bicycled programming, it always has. Programming is accepted from other communities including Los Alamitos. Ms. Kreps added that the Board needs to be careful of making programming decisions based on what they like or don't like because they could open themselves up to a lawsuit based on first amendment principles. People have a right on public access to express their views even if certain individuals or groups do not like or agree with those views. Mr. Palmer quoted the following from the guidelines: Public Access SBTV shall not be used for the presentation of: "any program content which is slanderous, libelous or defamatory, or is disparaging of any racial, ethnic or religious group..." He finds that degrading homosexuals is slanderous and that it should not be put on the public access station in Seal Beach. Further discussion ensued until Mrs. Dahlin made the motion that this should be tabled until the next meeting. Mr. Clow seconded the motion. AYES: NAYS: MOTION Mr. Palmer, -0- PASSED: 3-0 Mrs. Dahlin, Mr. Clow PUBLIC ACCESS REPORT Ms. Kreps advised the Board she would not be teaching any more classes until the first of the year. She also said the production board was booked with shows until January. Tuesday eveninqs are now available for public access productions. Most of the studio shoots have been with the Leisure World producers. They have created a tremendous number of shows this year. . . . pg. 7 SBCCF 11/15/93 minutes CORRESPONDENCE None. BOARD COMMUNICATIONS Mr. Clow asked about selling dubs of local origination programming and dubs of city council/planning commission meetings. There was a character generated message on channel 3 addressing this issue. Ms. Kreps said she was not aware of this but she would look into it. Mr. Clow asked if the Seal Beach Cable Foundation is funding these programs why should Comcast receive money from the dubs. Mr. Clow asked if the B-Bay was fixed yet. Ms. Kreps advised Mr. Clow that Evan Guyer was still working on it. He also asked how long has it been inoperaable. Ms. Kreps responded probably about a month and a half to two months. The reason it was not fixed sooner is because Mr. Guyer has been at Court T.V. Now that Evan is back he is taking care of it. Mrs. Dahlin asked Ms. Kreps why figures were not provided for the line item of estimated income from selling dubs, tape rental, etc from the 1994 budget. Ms. Kreps responded because she had no way of predicting how much money would be generated. The Board asked questions about Larry Means and why the character generated message was on channel 3. Again Ms. Kreps said she would speak with Larry Means and report back to the Board. Mr. Clow suggested that Larry Means should attend the next Seal Beach Cable Foundation meeting. Ms. Kreps stated that Mr. Means is not required to attend these meetings because he is a Comcast employee and does not work for the SBCCF. Mr. Clow also asked if the Seal had been permanently engraved. would be done. Comcast is not using SBCCF equipment to make money. Comcast uses 3/4" machines and tapes whereas the SBCCF uses a 1/2" format. Comcast also has there own dubbing rack to dub tapes. Ms. Kreps asked for a copy of the correspondence Mr. Clow had received so it could be placed in the files. Ms. Kreps also stated that the author of the correspondence never communicated any of these issues to her directly. . . . . . pg. 8 SBCCF 11/15/93 minutes ADJOURNMENT Mrs. Dahlin moved the meeting be adjourned at 8:15 pm.
