" / , . -. - .'> .- ORDINANCE NUMBER ~~~~ AN ORDINANCE OF THE CITY OF SEAL BEACH REGULATING PARKING OF TRUCKS IN RESIDENTIAL AND COMMERCIAL ZONES AND AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA III THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. The Code of the City of Seal Beach, California is hereby amended by adding Ch~pter 13C thereto to read: CHAPTER 13C PARKING OF TRUCKS IN RESIDENTIAL AND COMMERCIAL ZONES S 13C-l. Parking of Trucks in Residential and Commercial Zones. S 13C~2. Exceptions. S 13C-3. Fining. S 13C-4. Penalties. Section 13C-l. Parking of Trucks in Residential and Commercial Zones. I (a) It shall be unlawful for any person, without a permit therefor, to park or store any commercial motor truck, truck trailer and/or trailer having an unladen weight of 6,000 pounds or more or having an overall length exceeding 20 feet, or any commercial truck-tractor and/or trailer, irrespective of weight, upon any public street or on public or private property in the City within the following zones, to wit: R-l Single Family Residential Zone, the R-2 Two-Family Residential Zone, the R-3 Multi-Family Residential Zone, for more than two hours, and the C-O, C-l and C-2 Commercial Zones for more than four (4) hours. Section 13C-2. Exceptions. (a) The Chief of Police, or his designee, shall have the power to issue to any person a parking permit to park vehicles in the areas indicated in Section 13C-l of this Chapter, upon application, whenever he finds that conditions are such that it appears the neighborhood or persons therein would not be adversely affected thereby. Such permit shall be issued for a stated period only if one of the following findings can be met: I. That the vehicle is immobile due to accident or mechanical breakdown; or That the nature of the particular service to be performed or material or equipment to be delivered, requires a longer period of time than the time limit described in Section 13C-l of this Chapter; or (3) That the vehicle is owned or operated by the commercial use on the private property upon which it is to be parked. (1) (2) . (b) Excluded from the provisions of this section shall be a vehicle operated and parked by a registered transient guest of a motel or hotel if such vehicle is parked within approved designated truck parking areas upon the business premises. Truck parking areas shall be submitted to and approved by the Seal Beach City Councilor Traffic Engineering. . 11II""" .. ~ ........... /. I I I Ordinance Number ". '. '. . - (c) The Chief of Police, or his designee, may revoke any permit granted pursuant to the provisions of Section 13C-l of this Chapter, whenever any of the terms or conditions thereof have been willfully violated or when it appears that the neigh- borhood or persons therein are being adversely affected thereby. Such revocation shall be effective two (2) hours after posting notice thereof on the vehicle in question. (d) Any person who feels he is aggrieved by refusal of a permit or revoation of a permit may appeal to the City Council for relief and hearing. The decision of the City Council upon the appeal shall be final after a hearing thereon. (e) Any person who has good cause for being exempted from the operation of the provisions of Sections 13C-l and 13C-2 of this Chapter, may make a written request with the City Clerk and shall state the grounds therefor for such exemption. The City Clerk shall therewith transmit one copy of the request to the Chief of Police. The City Council shall set the matter for hearing and may by resolution, grant, deny, or modify in whole or in part such request. Section 13C-3. Signing. Pursuant to vehicle Code Section 22507, signs giving adequate notice of the prohibitions contained in this Chapter shall be placed within the city limits. Section 13C-4. Penalties. Any person who violates any of the provisions of this Chapter, shall be deemed guilty of an infraction punishable by (a) a fine not exceeding $50 (fifty dollars) for a first violation within one year; (b) a fine not exceeding $100 (one hundred dollars) for a second violation within one year and; (c) a fine not exceeding $250 (two hundred and fifty dollars) for each additional violation within one year. A person shall be deemed guilty of a separate offense for every day during which portion of which any violation of this Chapter is committed, continued or permitted and shall be punishable as provided herein.
