AN ORDINANCE OF THE CITY OF SEAL BEACH AMENDING SEC. 28-1300(4) OF CHAPTER 28 OF THE CODE OF THE CITY OF SEAL BEACH AND AMENDING SEC. 28-1300(6)(a) OF CHAPTER 28 OF THE CODE OF THE CITY OF SEAL BEACH AND DECLARING THE URGENCY THEREOF AND DETERMINING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY. THE CITY COUNCIL DOES ORDAIN AS FOLLOWS: Section 1. Section 28-1300(4) of Chapter 28 of the Code of the City of Seal Beach is hereby amended to read as follows: "28-1300(4) Liquor Store (off-sale); located more than 100 feet from residentially zoned property, a church or school. " Section 2. Section 28-1300(6)(a) of Chapter 28 of the Code of the City of Seal Beach is hereby amended to read as follows: "28-1300(6)(a) Establishments with on-sale liquor and establishments with off-sale liquor located within 100 feet of residentially zoned property, a church or school." Section 3. This ordinance shall take effect immediately as an emergency measure which is necessary for the preservation of the public peace, health and safety. The reasons for its urgency are as follow!:: The location of off-sale liquor in close proximity to churches, schools or residences can pose serious problems of compatibility and in view of a proposal to locate such a use directly across fhe street from a grammar school, the City must determine the compatibility of that use in that location. Section 4. The City Clerk shall certify to the passage and adoption of this ordinance by the City Council and shall cause the same to be posted or published as required by law.
