ORDINANCE NUMBER /tJ38 AN ORDINANCE OF THE CITY OF SEAL BEACH IMPOSING A 180 DAY MORATORIUM ON THE PROCESSING OF NEW APPLICATIONS FOR RESIDENTIAL CONSTRUCTION IN EXCESS OF 20 DWELLING UNITS PER ACRE COASTWARD OF PACIFIC COAST HIGHWAY IN PLANNING DISTRICT ONE AND DECLARING THE URGENCY THEREOF AND DETERMINING THAT THIS ORDINANCE SHALL TAKE EFFECT IMMEDIATELY. THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES ORDAIN AS FOLLOWS: Section 1. The City shall not accept for processing any applications for residential construction which exceeds a density of 20 dwelling units per acre in Planning District One during the time this ordinance is in effect. Section 2. This Ordinance shall take effect immediately as an emergency measure which is necessary for the preservation of the public peace, health and safety. The reasons for its urgency are as follows, in view of the proposed change in the Coastal Commission Interim Guidelines pertaining to residential development, the City must immediately: (1) Determine the adequacy of public services to handle increased development and redevelopment; (2) Evaluate the parking situation; (3) Evaluate the impact on the school district; (4) Evaluate the effect of various densities on the general welfare of the residents of this City. Section 3. This Ordinance shall expire 180 days from the date hereof unless it is extended by action of the City Council. Section 4. The City Clerk shall certify to the passage and adoption of this Ordinance by the City Council and shall cause the same to be posted or published as required by law.
