Home My WebLink AboutCC Ord 1014 1977-06-13 1 ORDINANCE NO. /tJ/~ ORDINANCE OF THE CITY OF SEAL BEACH PROHIBITING THE DISCHARGE OF FIRE- WORKS ON PUBLIC BEACHES OR PARKS AND IN SURFS IDE COLONY, LIMITING DISCHARGE ELSEWHERE, AMENDING THE CODE OF THE CITY OF SEAL BEACH, CALIFORNIA, AND PECLARING THE URGENCY THEREOF. ; THE CITY COUNCIL OF THE CITY OF SEAL BEACH DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Code of the City of Seal Beach, California, is hereby amended to add ARTICLE II - FireworkS, Section 9-4 to Chapter 9 which shall read as follows: ARTICLE II - Fireworks 1 Section 9.4 Discharge - Prohibited on public beach or park and in Surfs ide Colony - Limited elsewhere. No person shall possess or ,discharge fireworks or pyrotechnic devices of any type on any public beach or in any public park and in Surfs ide Colony~ and no person shall discharge any fireworks or pyrotechnic devices of any type elsewhere in the City except during the days that the sale of "safe and sane" fire- works is permitted by the City. Public beach, for the purposes of this Section is defined to include all public lands beginning from private property boundaries nearest to the mean high tide line to a point 200 yards offshore. Section 2. The public beaches and parks of the City of Seal Beach are crowded with people during the summer months and particularly on the Fourth of July weekend, and the discharge of any form of fireworks thereon constitutes a threat to the health, safety and welfare of those people making use of the beach. Surfside Colony consists of a community of several hundred people that has extremely limited access, narrow streets, close proximity between buildings, and substandard water system. The discharge of any type of fireworks or pyrotechnic device in Surfs ide Colony unreasonably increases the threat of fire and constitutes a threat to the health, safety and welfare of the residents of the City. The City of Seal Beach presently has no ordinance prohibiting the discharge of fireworks on public beaches and parks and in Surfs ide Colony and therefore the enact- ment of this ordinance is necessary as an urgency ordinance to protect the public health, peace, safety and welfare, and shall take effect immediately.
